77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the records, management, and taxation of navigation
1010 districts and certain port and harbor facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter J, Chapter 441, Government Code, is
1313 amended by adding Section 441.1681 to read as follows:
1414 Sec. 441.1681. ELECTRONIC STORAGE OF CERTAIN LOCAL
1515 GOVERNMENT RECORDS. (a) The governing body of a navigation
1616 district or port authority, or a board of trustees described by
1717 Chapter 54, Transportation Code, may establish alternative storage
1818 and retention standards and procedures for records of a navigation
1919 district, port authority, or board of trustees. The rules must
2020 establish:
2121 (1) a process for the port commission of a navigation
2222 district or port authority, or a board of trustees described by
2323 Chapter 54, Transportation Code, to use the alternative storage
2424 standards and procedures;
2525 (2) procedures for the conversion of hard copy
2626 documents retained by the custodian of the navigation district,
2727 port authority, or board of trustees described by Chapter 54,
2828 Transportation Code, to an electronic form and the destruction of
2929 the hard copy documents; and
3030 (3) standards for electronic record management and
3131 preservation of documents retained by the custodian of the
3232 navigation district, port authority, or board of trustees described
3333 by Chapter 54, Transportation Code.
3434 (b) The standards and procedures under this section may not
3535 establish a retention period that is shorter than a retention
3636 period prescribed by a state or federal law, regulation, or rule of
3737 court.
3838 SECTION 2. Subchapter Q, Chapter 60, Water Code, is amended
3939 by adding Section 60.503 to read as follows:
4040 Sec. 60.503. CLOSED MEETINGS. Notwithstanding Section
4141 551.103, Government Code, a port commission is not required to make
4242 a recording of the proceedings of a closed meeting to deliberate
4343 security measures, including cybersecurity measures, related to
4444 the navigation district or port authority.
4545 SECTION 3. Section 60.403(a), Water Code, is amended to
4646 read as follows:
4747 (a) A port commission, an authorized designated officer of
4848 the port commission, the executive director of the district or the
4949 port authority, or an authorized representative of the executive
5050 director may make routine purchases or contracts in an amount not to
5151 exceed $50,000. A port commission may delegate authority to an
5252 authorized designated officer of the port commission, the executive
5353 director of the district or the port authority, or an authorized
5454 representative of the executive director to make routine purchases
5555 or contracts in an amount not to exceed $500,000, which shall be
5656 deemed the amount provided for under this chapter for routine
5757 purchases or contracts authorized for the district or port
5858 authority [$100,000].
5959 SECTION 4. Section 2252.909(a), Government Code, as added
6060 by Chapter 1008 (H.B. 2518), Acts of the 88th Legislature, Regular
6161 Session, 2023, is amended to read as follows:
6262 (a) In this section, "governmental entity" has the meaning
6363 assigned by Section 2253.001, except that the term does not include
6464 a:
6565 (1) navigation district;
6666 (2) port authority; or
6767 (3) board of trustees described by Chapter 54,
6868 Transportation Code.
6969 SECTION 5. Section 54.054, Transportation Code, is amended
7070 by amending Subsection (a) and adding Subsection (c) to read as
7171 follows:
7272 (a) Except for routine purchases and contracts and except as
7373 otherwise provided by this chapter, the board may award a contract
7474 involving the expenditure of funds in excess of the amount
7575 applicable to an expenditure of funds by a municipality under
7676 Section 252.021(a), Local Government Code, only by competitive
7777 bidding.
7878 (c) The board, authorized designated officers of the board,
7979 the general manager or port director, or authorized representatives
8080 of the general manager or port director may make routine purchases
8181 or contracts in an amount not to exceed $50,000. A board may
8282 delegate authority to authorized designated officers of the board,
8383 the general manager or port director, and authorized
8484 representatives of the general manager or port director to make
8585 routine purchases or contracts in an amount not to exceed $500,000,
8686 which shall be deemed the amount provided for under this section for
8787 routine purchases or contracts.
8888 SECTION 6. Section 25.07(e), Tax Code, is amended to read as
8989 follows:
9090 (e) In this section, "navigation-related commerce" includes
9191 the following if engaged in by a person:
9292 (1) an activity that requires the person to hold a
9393 maritime-related license or permit issued by a navigation district,
9494 including providing stevedoring, steamship agency, towing,
9595 tugboat, or line handling services;
9696 (2) an activity that requires the person to hold a
9797 franchise issued by a navigation district;
9898 (3) possessing a leasehold interest in property [owned
9999 by a navigation district] that:
100100 (A) connects infrastructure to a public dock; and
101101 (B) is:
102102 (i) owned by a navigation district; or
103103 (ii) managed and controlled by a board of
104104 trustees described by Chapter 54, Transportation Code;
105105 (4) hauling cargo into or across a public dock;
106106 (5) commercial fishing;
107107 (6) constructing, fabricating, cleaning, repairing,
108108 dismantling, or recycling vessels;
109109 (7) pilotage; [or]
110110 (8) an activity described by Section 60.101, 61.162,
111111 or 63.153, Water Code;
112112 (9) operating a cruise ship terminal facility; or
113113 (10) an activity described by Section 54.003 or
114114 54.053, Transportation Code.
115115 SECTION 7. This Act takes effect September 1, 2025.
