88 AN ACT
99 relating to establishing a highway construction mitigation program
1010 for certain highway construction projects.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1313 is amended by adding Section 201.626 to read as follows:
1414 Sec. 201.626. HIGHWAY CONSTRUCTION MITIGATION PROGRAM. (a)
1515 In this section:
1616 (1) "Highway construction mitigation program" means
1717 the highway construction mitigation program established under this
1818 section.
1919 (2) "Highway construction project" means a project
2020 involving the construction, maintenance, demolition, or
2121 improvement of a state highway.
2222 (b) For the purpose of mitigating the negative effects of a
2323 highway construction project on adjacent neighborhoods, the
2424 department by rule shall establish and implement a highway
2525 construction mitigation program to fund projects that:
2626 (1) reduce the impact of dust and noise from a highway
2727 construction project and mitigate air quality issues caused by a
2828 highway construction project;
2929 (2) reduce the impact of adverse environmental
3030 consequences caused by a highway construction project;
3131 (3) relocate fencing or other property structures as
3232 necessary to accommodate a highway construction project; and
3333 (4) restore or repair damage caused by a highway
3434 construction project to structures or fixtures located 500 feet or
3535 less from the highway construction project.
3636 (c) The highway construction mitigation program must
3737 provide grants to eligible applicants to fund projects described by
3838 Subsection (b). For purposes of the highway construction
3939 mitigation program, an eligible applicant includes:
4040 (1) the owner of a single-family home or duplex
4141 located 500 feet or less from a highway construction project;
4242 (2) the owner of a multi-family home located 500 feet
4343 or less from a highway construction project;
4444 (3) a religious organization that qualifies under
4545 Section 11.20, Tax Code, that owns a structure located 500 feet or
4646 less from a highway construction project; or
4747 (4) a public school district in which a public school
4848 campus is located 500 feet or less from a highway construction
4949 project.
5050 (d) A metropolitan planning organization or local authority
5151 shall ensure that the department provides highway construction
5252 mitigation program services for each highway construction project
5353 occurring within the boundaries of the organization or authority.
5454 SECTION 2. Notwithstanding Section 201.626, Transportation
5555 Code, as added by this Act, the Texas Department of Transportation
5656 is not required to comply with that section before January 1, 2026.
5757 SECTION 3. This Act takes effect September 1, 2025.
