88 AN ACT
99 relating to the confidentiality of certain home address information
1010 in property tax appraisal records.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 25.025(a), Tax Code, as amended by
1313 Chapters 76 (S.B. 617), 152 (S.B. 870), 430 (H.B. 1911), 765 (H.B.
1414 4504), and 937 (S.B. 1525), Acts of the 88th Legislature, Regular
1515 Session, 2023, is reenacted and amended to read as follows:
1616 (a) This section applies only to:
1717 (1) a current or former peace officer as defined by
1818 Article 2A.001, Code of Criminal Procedure, and the spouse or
1919 surviving spouse of the peace officer;
2020 (2) the adult child of a current peace officer as
2121 defined by Article 2A.001, Code of Criminal Procedure;
2222 (3) a current or honorably retired county jailer as
2323 defined by Section 1701.001, Occupations Code;
2424 (4) an employee of the Texas Department of Criminal
2525 Justice;
2626 (5) a commissioned security officer as defined by
2727 Section 1702.002, Occupations Code;
2828 (6) an individual who shows that the individual, the
2929 individual's child, or another person in the individual's household
3030 is a victim of family violence as defined by Section 71.004, Family
3131 Code, by providing:
3232 (A) a copy of a protective order issued under
3333 Chapter 85, Family Code, or a magistrate's order for emergency
3434 protection issued under Article 17.292, Code of Criminal Procedure;
3535 or
3636 (B) other independent documentary evidence
3737 necessary to show that the individual, the individual's child, or
3838 another person in the individual's household is a victim of family
3939 violence;
4040 (7) an individual who shows that the individual, the
4141 individual's child, or another person in the individual's household
4242 is a victim of sexual assault or abuse, stalking, or trafficking of
4343 persons by providing:
4444 (A) a copy of a protective order issued under
4545 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4646 magistrate's order for emergency protection issued under Article
4747 17.292, Code of Criminal Procedure; or
4848 (B) other independent documentary evidence
4949 necessary to show that the individual, the individual's child, or
5050 another person in the individual's household is a victim of sexual
5151 assault or abuse, stalking, or trafficking of persons;
5252 (8) a participant in the address confidentiality
5353 program administered by the attorney general under Subchapter B,
5454 Chapter 58, Code of Criminal Procedure, who provides proof of
5555 certification under Article 58.059, Code of Criminal Procedure;
5656 (9) a federal judge, a federal bankruptcy judge, a
5757 marshal of the United States Marshals Service, a state judge, or a
5858 family member of a federal judge, a federal bankruptcy judge, a
5959 marshal of the United States Marshals Service, or a state judge;
6060 (10) a current or former district attorney, criminal
6161 district attorney, or county or municipal attorney whose
6262 jurisdiction includes any criminal law or child protective services
6363 matters;
6464 (11) a current or former employee of a district
6565 attorney, criminal district attorney, or county or municipal
6666 attorney whose jurisdiction includes any criminal law or child
6767 protective services matters;
6868 (12) an officer or employee of a community supervision
6969 and corrections department established under Chapter 76,
7070 Government Code, who performs a duty described by Section 76.004(b)
7171 of that code;
7272 (13) a criminal investigator of the United States as
7373 described by Article 2A.002(a), Code of Criminal Procedure;
7474 (14) a current or honorably retired police officer or
7575 inspector of the United States Federal Protective Service;
7676 (15) a current or former United States attorney,
7777 assistant United States attorney, federal public defender, deputy
7878 federal public defender, or assistant federal public defender and
7979 the spouse and child of the attorney or public defender;
8080 (16) a current or former employee of the office of the
8181 attorney general who is or was assigned to a division of that office
8282 the duties of which involve law enforcement or are performed under
8383 Chapter 231, Family Code;
8484 (17) a medical examiner or person who performs
8585 forensic analysis or testing who is employed by this state or one or
8686 more political subdivisions of this state;
8787 (18) a current or former member of the United States
8888 armed forces who has served in an area that the president of the
8989 United States by executive order designates for purposes of 26
9090 U.S.C. Section 112 as an area in which armed forces of the United
9191 States are or have engaged in combat;
9292 (19) a current or former employee of the Texas
9393 Juvenile Justice Department or of the predecessors in function of
9494 the department;
9595 (20) a current or former juvenile probation or
9696 supervision officer certified by the Texas Juvenile Justice
9797 Department, or the predecessors in function of the department,
9898 under Title 12, Human Resources Code;
9999 (21) a current or former employee of a juvenile
100100 justice program or facility, as those terms are defined by Section
101101 261.405, Family Code;
102102 (22) a current or former employee of the Texas Civil
103103 Commitment Office or the predecessor in function of the office or a
104104 division of the office;
105105 (23) a current or former employee of a federal judge or
106106 state judge;
107107 (24) a current or former child protective services
108108 caseworker, adult protective services caseworker, or investigator
109109 for the Department of Family and Protective Services or a current or
110110 former employee of a department contractor performing child
111111 protective services caseworker, adult protective services
112112 caseworker, or investigator functions for the contractor on behalf
113113 of the department;
114114 (25) an elected public officer;
115115 (26) a firefighter or volunteer firefighter or
116116 emergency medical services personnel as defined by Section 773.003,
117117 Health and Safety Code;
118118 (27) a customs and border protection officer or border
119119 patrol agent of United States Customs and Border Protection or the
120120 spouse, surviving spouse, or adult child of a customs and border
121121 protection officer or border patrol agent;
122122 (28) [(27) a current or former attorney for the
123123 Department of Family and Protective Services
124124 [(27)] a current or former employee or contract staff
125125 member of a university health care provider at a corrections
126126 facility operated by the Texas Department of Criminal Justice or
127127 the Texas Juvenile Justice Department; [and]
128128 (29) [(28)] a current or former attorney for the
129129 Department of Family and Protective Services;
130130 (30) a nurse as defined by Section 301.002,
131131 Occupations Code; and
132132 (31) a physician as defined by Section 151.002,
133133 Occupations Code.
134134 SECTION 2. To the extent of any conflict, this Act prevails
135135 over another Act of the 89th Legislature, Regular Session, 2025,
136136 relating to nonsubstantive additions to and corrections in enacted
137137 codes.
138138 SECTION 3. This Act takes effect immediately if it receives
139139 a vote of two-thirds of all the members elected to each house, as
140140 provided by Section 39, Article III, Texas Constitution. If this
141141 Act does not receive the vote necessary for immediate effect, this
142142 Act takes effect September 1, 2025.
