9 | 9 | | relating to the confidentiality of certain home address information |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 25.025(a), Tax Code, as amended by |
---|
13 | 13 | | Chapters 76 (S.B. 617), 152 (S.B. 870), 430 (H.B. 1911), 765 (H.B. |
---|
14 | 14 | | 4504), and 937 (S.B. 1525), Acts of the 88th Legislature, Regular |
---|
15 | 15 | | Session, 2023, is reenacted and amended to read as follows: |
---|
16 | 16 | | (a) This section applies only to: |
---|
17 | 17 | | (1) a current or former peace officer as defined by |
---|
18 | 18 | | Article 2A.001, Code of Criminal Procedure, and the spouse or |
---|
19 | 19 | | surviving spouse of the peace officer; |
---|
20 | 20 | | (2) the adult child of a current peace officer as |
---|
21 | 21 | | defined by Article 2A.001, Code of Criminal Procedure; |
---|
22 | 22 | | (3) a current or honorably retired county jailer as |
---|
23 | 23 | | defined by Section 1701.001, Occupations Code; |
---|
24 | 24 | | (4) an employee of the Texas Department of Criminal |
---|
25 | 25 | | Justice; |
---|
26 | 26 | | (5) a commissioned security officer as defined by |
---|
27 | 27 | | Section 1702.002, Occupations Code; |
---|
28 | 28 | | (6) an individual who shows that the individual, the |
---|
29 | 29 | | individual's child, or another person in the individual's household |
---|
30 | 30 | | is a victim of family violence as defined by Section 71.004, Family |
---|
31 | 31 | | Code, by providing: |
---|
32 | 32 | | (A) a copy of a protective order issued under |
---|
33 | 33 | | Chapter 85, Family Code, or a magistrate's order for emergency |
---|
34 | 34 | | protection issued under Article 17.292, Code of Criminal Procedure; |
---|
35 | 35 | | or |
---|
36 | 36 | | (B) other independent documentary evidence |
---|
37 | 37 | | necessary to show that the individual, the individual's child, or |
---|
38 | 38 | | another person in the individual's household is a victim of family |
---|
39 | 39 | | violence; |
---|
40 | 40 | | (7) an individual who shows that the individual, the |
---|
41 | 41 | | individual's child, or another person in the individual's household |
---|
42 | 42 | | is a victim of sexual assault or abuse, stalking, or trafficking of |
---|
43 | 43 | | persons by providing: |
---|
44 | 44 | | (A) a copy of a protective order issued under |
---|
45 | 45 | | Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a |
---|
46 | 46 | | magistrate's order for emergency protection issued under Article |
---|
47 | 47 | | 17.292, Code of Criminal Procedure; or |
---|
48 | 48 | | (B) other independent documentary evidence |
---|
49 | 49 | | necessary to show that the individual, the individual's child, or |
---|
50 | 50 | | another person in the individual's household is a victim of sexual |
---|
51 | 51 | | assault or abuse, stalking, or trafficking of persons; |
---|
52 | 52 | | (8) a participant in the address confidentiality |
---|
53 | 53 | | program administered by the attorney general under Subchapter B, |
---|
54 | 54 | | Chapter 58, Code of Criminal Procedure, who provides proof of |
---|
55 | 55 | | certification under Article 58.059, Code of Criminal Procedure; |
---|
56 | 56 | | (9) a federal judge, a federal bankruptcy judge, a |
---|
57 | 57 | | marshal of the United States Marshals Service, a state judge, or a |
---|
58 | 58 | | family member of a federal judge, a federal bankruptcy judge, a |
---|
59 | 59 | | marshal of the United States Marshals Service, or a state judge; |
---|
60 | 60 | | (10) a current or former district attorney, criminal |
---|
61 | 61 | | district attorney, or county or municipal attorney whose |
---|
62 | 62 | | jurisdiction includes any criminal law or child protective services |
---|
63 | 63 | | matters; |
---|
64 | 64 | | (11) a current or former employee of a district |
---|
65 | 65 | | attorney, criminal district attorney, or county or municipal |
---|
66 | 66 | | attorney whose jurisdiction includes any criminal law or child |
---|
67 | 67 | | protective services matters; |
---|
68 | 68 | | (12) an officer or employee of a community supervision |
---|
69 | 69 | | and corrections department established under Chapter 76, |
---|
70 | 70 | | Government Code, who performs a duty described by Section 76.004(b) |
---|
71 | 71 | | of that code; |
---|
72 | 72 | | (13) a criminal investigator of the United States as |
---|
73 | 73 | | described by Article 2A.002(a), Code of Criminal Procedure; |
---|
74 | 74 | | (14) a current or honorably retired police officer or |
---|
75 | 75 | | inspector of the United States Federal Protective Service; |
---|
76 | 76 | | (15) a current or former United States attorney, |
---|
77 | 77 | | assistant United States attorney, federal public defender, deputy |
---|
78 | 78 | | federal public defender, or assistant federal public defender and |
---|
79 | 79 | | the spouse and child of the attorney or public defender; |
---|
80 | 80 | | (16) a current or former employee of the office of the |
---|
81 | 81 | | attorney general who is or was assigned to a division of that office |
---|
82 | 82 | | the duties of which involve law enforcement or are performed under |
---|
83 | 83 | | Chapter 231, Family Code; |
---|
84 | 84 | | (17) a medical examiner or person who performs |
---|
85 | 85 | | forensic analysis or testing who is employed by this state or one or |
---|
86 | 86 | | more political subdivisions of this state; |
---|
87 | 87 | | (18) a current or former member of the United States |
---|
88 | 88 | | armed forces who has served in an area that the president of the |
---|
89 | 89 | | United States by executive order designates for purposes of 26 |
---|
90 | 90 | | U.S.C. Section 112 as an area in which armed forces of the United |
---|
91 | 91 | | States are or have engaged in combat; |
---|
92 | 92 | | (19) a current or former employee of the Texas |
---|
93 | 93 | | Juvenile Justice Department or of the predecessors in function of |
---|
94 | 94 | | the department; |
---|
95 | 95 | | (20) a current or former juvenile probation or |
---|
96 | 96 | | supervision officer certified by the Texas Juvenile Justice |
---|
97 | 97 | | Department, or the predecessors in function of the department, |
---|
98 | 98 | | under Title 12, Human Resources Code; |
---|
99 | 99 | | (21) a current or former employee of a juvenile |
---|
100 | 100 | | justice program or facility, as those terms are defined by Section |
---|
101 | 101 | | 261.405, Family Code; |
---|
102 | 102 | | (22) a current or former employee of the Texas Civil |
---|
103 | 103 | | Commitment Office or the predecessor in function of the office or a |
---|
104 | 104 | | division of the office; |
---|
105 | 105 | | (23) a current or former employee of a federal judge or |
---|
106 | 106 | | state judge; |
---|
107 | 107 | | (24) a current or former child protective services |
---|
108 | 108 | | caseworker, adult protective services caseworker, or investigator |
---|
109 | 109 | | for the Department of Family and Protective Services or a current or |
---|
110 | 110 | | former employee of a department contractor performing child |
---|
111 | 111 | | protective services caseworker, adult protective services |
---|
112 | 112 | | caseworker, or investigator functions for the contractor on behalf |
---|
113 | 113 | | of the department; |
---|
114 | 114 | | (25) an elected public officer; |
---|
115 | 115 | | (26) a firefighter or volunteer firefighter or |
---|
116 | 116 | | emergency medical services personnel as defined by Section 773.003, |
---|
117 | 117 | | Health and Safety Code; |
---|
118 | 118 | | (27) a customs and border protection officer or border |
---|
119 | 119 | | patrol agent of United States Customs and Border Protection or the |
---|
120 | 120 | | spouse, surviving spouse, or adult child of a customs and border |
---|
121 | 121 | | protection officer or border patrol agent; |
---|
122 | 122 | | (28) [(27) a current or former attorney for the |
---|
123 | 123 | | Department of Family and Protective Services |
---|
124 | 124 | | [(27)] a current or former employee or contract staff |
---|
125 | 125 | | member of a university health care provider at a corrections |
---|
126 | 126 | | facility operated by the Texas Department of Criminal Justice or |
---|
127 | 127 | | the Texas Juvenile Justice Department; [and] |
---|
128 | 128 | | (29) [(28)] a current or former attorney for the |
---|
129 | 129 | | Department of Family and Protective Services; |
---|
130 | 130 | | (30) a nurse as defined by Section 301.002, |
---|
131 | 131 | | Occupations Code; and |
---|
132 | 132 | | (31) a physician as defined by Section 151.002, |
---|
133 | 133 | | Occupations Code. |
---|
134 | 134 | | SECTION 2. To the extent of any conflict, this Act prevails |
---|
135 | 135 | | over another Act of the 89th Legislature, Regular Session, 2025, |
---|
136 | 136 | | relating to nonsubstantive additions to and corrections in enacted |
---|
137 | 137 | | codes. |
---|
138 | 138 | | SECTION 3. This Act takes effect immediately if it receives |
---|
139 | 139 | | a vote of two-thirds of all the members elected to each house, as |
---|
140 | 140 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
141 | 141 | | Act does not receive the vote necessary for immediate effect, this |
---|
142 | 142 | | Act takes effect September 1, 2025. |
