77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of a cottage food production operation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 437.001(2-b), Health and Safety Code, is
1212 amended to read as follows:
1313 (2-b) "Cottage food production operation" means an
1414 individual, operating out of the individual's home, who:
1515 (A) produces at the individual's home, subject to
1616 Section 437.0196:
1717 (i) a baked good that is not a time and
1818 temperature control for safety food, as defined by Section
1919 437.0196;
2020 (ii) candy;
2121 (iii) coated and uncoated nuts;
2222 (iv) unroasted nut butters;
2323 (v) fruit butters;
2424 (vi) a canned jam or jelly;
2525 (vii) a fruit pie;
2626 (viii) dehydrated fruit or vegetables,
2727 including dried beans;
2828 (ix) popcorn and popcorn snacks;
2929 (x) cereal, including granola;
3030 (xi) dry mix;
3131 (xii) vinegar;
3232 (xiii) pickled fruit or vegetables,
3333 including beets and carrots, that are preserved in vinegar, brine,
3434 or a similar solution at an equilibrium pH value of 4.6 or less;
3535 (xiv) mustard;
3636 (xv) roasted coffee or dry tea;
3737 (xvi) a dried herb or dried herb mix;
3838 (xvii) plant-based acidified canned goods;
3939 (xviii) fermented vegetable products,
4040 including products that are refrigerated to preserve quality;
4141 (xix) frozen raw and uncut fruit or
4242 vegetables; or
4343 (xx) any other food that is not a time and
4444 temperature control for safety food, as defined by Section
4545 437.0196;
4646 (B) [has an annual gross income of $50,000 or
4747 less from the sale of food described by Paragraph (A);
4848 [(C)] sells the foods produced under Paragraph
4949 (A) only directly to consumers; and
5050 (C) [(D)] delivers products to the consumer at
5151 the point of sale or another location designated by the consumer.
5252 SECTION 2. As soon as practicable after the effective date
5353 of this Act, the executive commissioner of the Health and Human
5454 Services Commission shall adopt the rules necessary to implement
5555 the change in law made by this Act.
5656 SECTION 3. This Act takes effect September 1, 2025.
