| 9 | 9 | | relating to certain energy efficiency performance standards for |

| 10 | 10 | | residential construction. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 12 | 12 | | SECTION 1. Chapter 388, Health and Safety Code, is amended |
|---|
| 13 | 13 | | by adding Section 388.0045 to read as follows: |
|---|
| 14 | 14 | | Sec. 388.0045. RESIDENTIAL BUILDING ENERGY EFFICIENCY |
|---|
| 15 | 15 | | PERFORMANCE STANDARDS FOR ATTIC AND RAFTER ASSEMBLIES. (a) This |
|---|
| 16 | 16 | | section applies only to residential construction. |
|---|
| 17 | 17 | | (b) Notwithstanding any requirement contained in an energy |
|---|
| 18 | 18 | | code adopted under Section 388.003(a) or (b), or a local amendment |
|---|
| 19 | 19 | | adopted under Section 388.003(d), pertaining to the insulation of |
|---|
| 20 | 20 | | unvented attic or unvented enclosed rafter assemblies, a local |
|---|
| 21 | 21 | | jurisdiction shall consider an unvented attic or unvented enclosed |
|---|
| 22 | 22 | | rafter assembly to be in compliance with the requirements of the |
|---|
| 23 | 23 | | portion of the energy code administered and enforced by that local |
|---|
| 24 | 24 | | jurisdiction pertaining to the insulation of unvented attic or |
|---|
| 25 | 25 | | unvented enclosed rafter assemblies if: |
|---|
| 26 | 26 | | (1) the attic or rafter assembly is insulated and air |
|---|
| 27 | 27 | | sealed with air impermeable insulation to an R-value of at least: |
|---|
| 28 | 28 | | (A) 20 if the attic or rafter assembly is located |
|---|
| 29 | 29 | | in climate zone 2 or 3; or |
|---|
| 30 | 30 | | (B) 26 if the attic or rafter assembly is located |
|---|
| 31 | 31 | | in climate zone 4; and |
|---|
| 32 | 32 | | (2) the building in which the attic or rafter assembly |
|---|
| 33 | 33 | | is located: |
|---|
| 34 | 34 | | (A) attains a blower door test result of less |
|---|
| 35 | 35 | | than 3.0 ACH50; |
|---|
| 36 | 36 | | (B) has a mechanical ventilation system that does |
|---|
| 37 | 37 | | not rely solely on a negative pressure strategy; |
|---|
| 38 | 38 | | (C) if insulation is installed below the roof |
|---|
| 39 | 39 | | deck and the exposed portion of the roof rafters is not already |
|---|
| 40 | 40 | | covered by air impermeable insulation to an R-value of at least 20 |
|---|
| 41 | 41 | | or 26, as applicable, has the exposed portion of the roof rafters |
|---|
| 42 | 42 | | wrapped in insulation to an R-value of at least 3, except that the |
|---|
| 43 | 43 | | rafters are not required to be covered by insulation if: |
|---|
| 44 | 44 | | (i) the rafters are directly covered by |
|---|
| 45 | 45 | | drywall or finished ceiling; or |
|---|
| 46 | 46 | | (ii) continuous insulation is installed |
|---|
| 47 | 47 | | above the roof deck; and |
|---|
| 48 | 48 | | (D) contains inside the building's thermal |
|---|
| 49 | 49 | | envelope the building's indoor heating, cooling, and ventilation |
|---|
| 50 | 50 | | equipment, including ductwork. |
|---|
| 51 | 51 | | SECTION 2. This Act takes effect September 1, 2025. |
