77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to certain energy efficiency performance standards for
1010 residential construction.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 388, Health and Safety Code, is amended
1313 by adding Section 388.0045 to read as follows:
1414 Sec. 388.0045. RESIDENTIAL BUILDING ENERGY EFFICIENCY
1515 PERFORMANCE STANDARDS FOR ATTIC AND RAFTER ASSEMBLIES. (a) This
1616 section applies only to residential construction.
1717 (b) Notwithstanding any requirement contained in an energy
1818 code adopted under Section 388.003(a) or (b), or a local amendment
1919 adopted under Section 388.003(d), pertaining to the insulation of
2020 unvented attic or unvented enclosed rafter assemblies, a local
2121 jurisdiction shall consider an unvented attic or unvented enclosed
2222 rafter assembly to be in compliance with the requirements of the
2323 portion of the energy code administered and enforced by that local
2424 jurisdiction pertaining to the insulation of unvented attic or
2525 unvented enclosed rafter assemblies if:
2626 (1) the attic or rafter assembly is insulated and air
2727 sealed with air impermeable insulation to an R-value of at least:
2828 (A) 20 if the attic or rafter assembly is located
2929 in climate zone 2 or 3; or
3030 (B) 26 if the attic or rafter assembly is located
3131 in climate zone 4; and
3232 (2) the building in which the attic or rafter assembly
3333 is located:
3434 (A) attains a blower door test result of less
3535 than 3.0 ACH50;
3636 (B) has a mechanical ventilation system that does
3737 not rely solely on a negative pressure strategy;
3838 (C) if insulation is installed below the roof
3939 deck and the exposed portion of the roof rafters is not already
4040 covered by air impermeable insulation to an R-value of at least 20
4141 or 26, as applicable, has the exposed portion of the roof rafters
4242 wrapped in insulation to an R-value of at least 3, except that the
4343 rafters are not required to be covered by insulation if:
4444 (i) the rafters are directly covered by
4545 drywall or finished ceiling; or
4646 (ii) continuous insulation is installed
4747 above the roof deck; and
4848 (D) contains inside the building's thermal
4949 envelope the building's indoor heating, cooling, and ventilation
5050 equipment, including ductwork.
5151 SECTION 2. This Act takes effect September 1, 2025.
