77 AN ACT
88 relating to the creation of the Texas Commission on Teacher Job
99 Satisfaction and Retention.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 21, Education Code, is amended by adding
1212 Subchapter P to read as follows:
1313 SUBCHAPTER P. TEXAS COMMISSION ON TEACHER JOB SATISFACTION AND
1414 RETENTION
1515 Sec. 21.751. DEFINITION. In this subchapter, "commission"
1616 means the Texas Commission on Teacher Job Satisfaction and
1717 Retention.
1818 Sec. 21.752. TEXAS COMMISSION ON TEACHER JOB SATISFACTION
1919 AND RETENTION. (a) The Texas Commission on Teacher Job
2020 Satisfaction and Retention is established to develop and make
2121 recommendations for improving teacher job satisfaction and
2222 retention.
2323 (b) The commission is composed of 13 members, consisting of
2424 the following:
2525 (1) one member appointed by the governor;
2626 (2) four members appointed by the lieutenant governor;
2727 and
2828 (3) four members appointed by the speaker of the house
2929 of representatives.
3030 (c) The appointments made by the lieutenant governor and the
3131 speaker of the house of representatives must each consist of:
3232 (1) three members of the applicable legislative
3333 chamber; and
3434 (2) an administrator in the public school system or an
3535 elected member of the board of trustees of a school district.
3636 (d) In making appointments under Subsections (b)(1), (2),
3737 and (3), the governor, lieutenant governor, and speaker of the
3838 house of representatives shall coordinate to ensure that the
3939 membership of the commission reflects, to the extent possible, the
4040 ethnic and geographic diversity of this state.
4141 Sec. 21.753. PRESIDING OFFICER. The governor shall
4242 designate the presiding officer of the commission.
4343 Sec. 21.754. COMPENSATION AND REIMBURSEMENT. A member of
4444 the commission is not entitled to compensation for service on the
4545 commission but is entitled to reimbursement for actual and
4646 necessary expenses incurred in performing commission duties.
4747 Sec. 21.755. COMMISSION PERSONNEL. The commission may hire
4848 employees and hire or contract with legal counsel as necessary to
4949 carry out the purposes of this subchapter.
5050 Sec. 21.756. ADMINISTRATIVE SUPPORT AND FUNDING. (a)
5151 Staff members of the agency shall provide administrative support
5252 for the commission. If the agency employs a staff member whose sole
5353 duty is for support of the commission, selection of the staff member
5454 shall be done in conjunction with the presiding officer or the
5555 presiding officer's designee.
5656 (b) Funding for the administrative, staffing, legal, and
5757 operational expenses of the commission shall be provided by
5858 appropriation to the agency for that purpose.
5959 (c) The agency may procure goods and services to support the
6060 commission's work, including without limitation research and
6161 consulting services, and is delegated all authority and purchasing
6262 functions relating to the purchase of those goods or services
6363 without complying with standard procurement law, rules,
6464 regulations and procedures. If a contract is funded through the
6565 appropriations described in this subchapter, and the agency has
6666 selected the contractor in accordance with Section 29.035(d), then
6767 purchasing requirements including without limitation those set
6868 forth in Section 2254, Section 2155.061, Section 2155.063, and
6969 Section 2155.0755, Government Code, do not apply to the procurement
7070 function under this subchapter. The commission's members shall
7171 vote on the selected contractor and final contract, and if approved
7272 by majority vote, then the commissioner shall execute the contract
7373 on behalf of the commission.
7474 Sec. 21.757. RECOMMENDATIONS. (a) The commission shall
7575 develop recommendations under this subchapter that improve student
7676 outcomes by addressing issues related to teacher job satisfaction
7777 and retention, including:
7878 (1) methods to reduce the paperwork and other
7979 administrative burdens placed on teachers, including by evaluating
8080 the effectiveness of Section 7.060 and other laws in reducing
8181 paperwork for teachers;
8282 (2) the impact of requirements in this code and
8383 commissioner rules on administrative staffing levels in public
8484 schools;
8585 (3) methods to lessen administrative burdens in public
8686 schools to focus more resources on supporting teachers;
8787 (4) the impact of state and federal education law
8888 regarding discipline on teacher job satisfaction and
8989 effectiveness; and
9090 (5) the impact of compliance with federal education
9191 law on teacher job satisfaction and retention, including the impact
9292 on teachers, public school students, and public primary and
9393 secondary education programs in this state if this state were to
9494 decline federal education funding.
9595 (b) The commission may establish one or more working groups
9696 composed of not more than five members of the commission to study,
9797 discuss, and address specific policy issues and recommendations to
9898 refer to the commission for consideration.
9999 Sec. 21.758. REPORT. Not later than December 31, 2026, the
100100 commission shall prepare and deliver a report to the governor and
101101 the legislature that recommends statutory changes to improve
102102 teacher job satisfaction and retention.
103103 Sec. 21.759. PUBLIC MEETINGS AND PUBLIC INFORMATION. (a)
104104 The commission may hold public meetings as needed to fulfill its
105105 duties under this subchapter.
106106 (b) The commission may hold public meetings as needed to
107107 fulfill its duties under this subchapter.
108108 (c) As an advisory body, the commission is not subject to
109109 Chapter 551, Government Code.
110110 (d) The commission is subject to Chapter 552, Government
111111 Code.
112112 Sec. 21.760. COMMISSION ABOLISHED; EXPIRATION. The
113113 commission is abolished and this subchapter expires September 1,
114114 2027.
115115 SECTION 2. Not later than the 30th day after the effective
116116 date of this Act, the appropriate persons shall make the
117117 appointments required by Section 21.752, Education Code, as added
118118 by this Act.
119119 SECTION 3. This Act takes effect immediately if it receives
120120 a vote of two-thirds of all the members elected to each house, as
121121 provided by Section 39, Article III, Texas Constitution. If this
122122 Act does not receive the vote necessary for immediate effect, this
123123 Act takes effect September 1, 2025.
