10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Chapter 21, Education Code, is amended by adding |
---|
12 | 12 | | Subchapter P to read as follows: |

13 | 13 | | SUBCHAPTER P. TEXAS COMMISSION ON TEACHER JOB SATISFACTION AND |
---|
14 | 14 | | RETENTION |
---|
15 | 15 | | Sec. 21.751. DEFINITION. In this subchapter, "commission" |
---|
16 | 16 | | means the Texas Commission on Teacher Job Satisfaction and |
---|
17 | 17 | | Retention. |
---|
18 | 18 | | Sec. 21.752. TEXAS COMMISSION ON TEACHER JOB SATISFACTION |
---|
19 | 19 | | AND RETENTION. (a) The Texas Commission on Teacher Job |
---|
20 | 20 | | Satisfaction and Retention is established to develop and make |
---|
21 | 21 | | recommendations for improving teacher job satisfaction and |
---|
22 | 22 | | retention. |
---|
23 | 23 | | (b) The commission is composed of 13 members, consisting of |
---|
24 | 24 | | the following: |
---|
25 | 25 | | (1) one member appointed by the governor; |
---|
26 | 26 | | (2) four members appointed by the lieutenant governor; |
---|
27 | 27 | | and |
---|
28 | 28 | | (3) four members appointed by the speaker of the house |
---|
29 | 29 | | of representatives. |
---|
30 | 30 | | (c) The appointments made by the lieutenant governor and the |
---|
31 | 31 | | speaker of the house of representatives must each consist of: |
---|
32 | 32 | | (1) three members of the applicable legislative |
---|
33 | 33 | | chamber; and |
---|
34 | 34 | | (2) an administrator in the public school system or an |
---|
35 | 35 | | elected member of the board of trustees of a school district. |
---|
36 | 36 | | (d) In making appointments under Subsections (b)(1), (2), |
---|
37 | 37 | | and (3), the governor, lieutenant governor, and speaker of the |
---|
38 | 38 | | house of representatives shall coordinate to ensure that the |
---|
39 | 39 | | membership of the commission reflects, to the extent possible, the |
---|
40 | 40 | | ethnic and geographic diversity of this state. |
---|
41 | 41 | | Sec. 21.753. PRESIDING OFFICER. The governor shall |
---|
42 | 42 | | designate the presiding officer of the commission. |
---|
43 | 43 | | Sec. 21.754. COMPENSATION AND REIMBURSEMENT. A member of |
---|
44 | 44 | | the commission is not entitled to compensation for service on the |
---|
45 | 45 | | commission but is entitled to reimbursement for actual and |
---|
46 | 46 | | necessary expenses incurred in performing commission duties. |
---|
47 | 47 | | Sec. 21.755. COMMISSION PERSONNEL. The commission may hire |
---|
48 | 48 | | employees and hire or contract with legal counsel as necessary to |
---|
49 | 49 | | carry out the purposes of this subchapter. |
---|
50 | 50 | | Sec. 21.756. ADMINISTRATIVE SUPPORT AND FUNDING. (a) |
---|
51 | 51 | | Staff members of the agency shall provide administrative support |
---|
52 | 52 | | for the commission. If the agency employs a staff member whose sole |
---|
53 | 53 | | duty is for support of the commission, selection of the staff member |
---|
54 | 54 | | shall be done in conjunction with the presiding officer or the |
---|
55 | 55 | | presiding officer's designee. |
---|
56 | 56 | | (b) Funding for the administrative, staffing, legal, and |
---|
57 | 57 | | operational expenses of the commission shall be provided by |
---|
58 | 58 | | appropriation to the agency for that purpose. |
---|
59 | 59 | | (c) The agency may procure goods and services to support the |
---|
60 | 60 | | commission's work, including without limitation research and |
---|
61 | 61 | | consulting services, and is delegated all authority and purchasing |
---|
62 | 62 | | functions relating to the purchase of those goods or services |
---|
63 | 63 | | without complying with standard procurement law, rules, |
---|
64 | 64 | | regulations and procedures. If a contract is funded through the |
---|
65 | 65 | | appropriations described in this subchapter, and the agency has |
---|
66 | 66 | | selected the contractor in accordance with Section 29.035(d), then |
---|
67 | 67 | | purchasing requirements including without limitation those set |
---|
68 | 68 | | forth in Section 2254, Section 2155.061, Section 2155.063, and |
---|
69 | 69 | | Section 2155.0755, Government Code, do not apply to the procurement |
---|
70 | 70 | | function under this subchapter. The commission's members shall |
---|
71 | 71 | | vote on the selected contractor and final contract, and if approved |
---|
72 | 72 | | by majority vote, then the commissioner shall execute the contract |
---|
73 | 73 | | on behalf of the commission. |
---|
74 | 74 | | Sec. 21.757. RECOMMENDATIONS. (a) The commission shall |
---|
75 | 75 | | develop recommendations under this subchapter that improve student |
---|
76 | 76 | | outcomes by addressing issues related to teacher job satisfaction |
---|
77 | 77 | | and retention, including: |
---|
78 | 78 | | (1) methods to reduce the paperwork and other |
---|
79 | 79 | | administrative burdens placed on teachers, including by evaluating |
---|
80 | 80 | | the effectiveness of Section 7.060 and other laws in reducing |
---|
81 | 81 | | paperwork for teachers; |
---|
82 | 82 | | (2) the impact of requirements in this code and |
---|
83 | 83 | | commissioner rules on administrative staffing levels in public |
---|
84 | 84 | | schools; |
---|
85 | 85 | | (3) methods to lessen administrative burdens in public |
---|
86 | 86 | | schools to focus more resources on supporting teachers; |
---|
87 | 87 | | (4) the impact of state and federal education law |
---|
88 | 88 | | regarding discipline on teacher job satisfaction and |
---|
89 | 89 | | effectiveness; and |
---|
90 | 90 | | (5) the impact of compliance with federal education |
---|
91 | 91 | | law on teacher job satisfaction and retention, including the impact |
---|
92 | 92 | | on teachers, public school students, and public primary and |
---|
93 | 93 | | secondary education programs in this state if this state were to |
---|
94 | 94 | | decline federal education funding. |
---|
95 | 95 | | (b) The commission may establish one or more working groups |
---|
96 | 96 | | composed of not more than five members of the commission to study, |
---|
97 | 97 | | discuss, and address specific policy issues and recommendations to |
---|
98 | 98 | | refer to the commission for consideration. |
---|
99 | 99 | | Sec. 21.758. REPORT. Not later than December 31, 2026, the |
---|
100 | 100 | | commission shall prepare and deliver a report to the governor and |
---|
101 | 101 | | the legislature that recommends statutory changes to improve |
---|
102 | 102 | | teacher job satisfaction and retention. |
---|
103 | 103 | | Sec. 21.759. PUBLIC MEETINGS AND PUBLIC INFORMATION. (a) |

104 | 104 | | The commission may hold public meetings as needed to fulfill its |
---|
105 | 105 | | duties under this subchapter. |

108 | 108 | | (c) As an advisory body, the commission is not subject to |
---|
109 | 109 | | Chapter 551, Government Code. |
---|
110 | 110 | | (d) The commission is subject to Chapter 552, Government |

111 | 111 | | Code. |
---|
112 | 112 | | Sec. 21.760. COMMISSION ABOLISHED; EXPIRATION. The |
---|
113 | 113 | | commission is abolished and this subchapter expires September 1, |
---|
114 | 114 | | 2027. |
---|
115 | 115 | | SECTION 2. Not later than the 30th day after the effective |
---|
116 | 116 | | date of this Act, the appropriate persons shall make the |
---|
117 | 117 | | appointments required by Section 21.752, Education Code, as added |
---|
118 | 118 | | by this Act. |
---|
119 | 119 | | SECTION 3. This Act takes effect immediately if it receives |
---|
120 | 120 | | a vote of two-thirds of all the members elected to each house, as |
---|
121 | 121 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
122 | 122 | | Act does not receive the vote necessary for immediate effect, this |
---|
123 | 123 | | Act takes effect September 1, 2025. |
