11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter Z, Chapter 29, Education Code, is |
---|
13 | 13 | | amended by adding Section 29.913 to read as follows: |
---|
14 | 14 | | Sec. 29.913. OUTCOMES-BASED CONTRACTS PILOT PROGRAM. (a) |
---|
15 | 15 | | The agency shall establish a pilot program through which school |
---|
16 | 16 | | districts and open-enrollment charter schools, in contracting for a |
---|
17 | 17 | | good or service related to student outcomes, use a funding model |
---|
18 | 18 | | that ties compensation to measurable student outcomes, including |
---|
19 | 19 | | academic performance, graduation rates, and skill proficiency. |
---|
20 | 20 | | (b) The agency shall select at least five school districts |
---|
21 | 21 | | and open-enrollment charter schools to participate in the pilot |
---|
22 | 22 | | program. |
---|
23 | 23 | | (c) To be eligible to participate in the pilot program, a |
---|
24 | 24 | | school district or open-enrollment charter school must agree to |
---|
25 | 25 | | enter into a contract for a good or service related to student |
---|
26 | 26 | | outcomes that: |
---|
27 | 27 | | (1) requires the contracting entity to: |
---|
28 | 28 | | (A) meet clearly defined outcome targets related |
---|
29 | 29 | | to increased student achievement; and |
---|
30 | 30 | | (B) use best practices; |
---|
31 | 31 | | (2) includes specific, quantifiable performance |
---|
32 | 32 | | metrics used to assess the effectiveness of the good or service in |
---|
33 | 33 | | making progress toward outcome targets described by Subdivision |
---|
34 | 34 | | (1)(A); |
---|
35 | 35 | | (3) provides for a funding structure that includes |
---|
36 | 36 | | incentives for meeting or exceeding outcome targets described by |
---|
37 | 37 | | Subdivision (1)(A); and |
---|
38 | 38 | | (4) allows flexibility in the implementation of |
---|
39 | 39 | | educational strategies tailored to the unique needs of each student |
---|
40 | 40 | | served. |
---|
41 | 41 | | (d) From money appropriated or otherwise available for the |
---|
42 | 42 | | purpose, the agency shall award grants to school districts and |
---|
43 | 43 | | open-enrollment charter schools participating in the pilot |
---|
44 | 44 | | program. The amount of each grant must be correlated to the |
---|
45 | 45 | | achievement of outcome targets described by Subsection (c)(1)(A) in |
---|
46 | 46 | | each contract entered into under the pilot program. |
---|
47 | 47 | | (e) Not later than December 1, 2028, the agency shall submit |
---|
48 | 48 | | to the legislature a report on the results of the pilot program. |
---|
49 | 49 | | The report must include the agency's recommendation on whether the |
---|
50 | 50 | | pilot program should be expanded or continued on a statewide basis. |
---|
51 | 51 | | (f) The commissioner may adopt rules as necessary to |
---|
52 | 52 | | implement the pilot program. |
---|
53 | 53 | | (g) This section expires September 1, 2029. |
---|
54 | 54 | | SECTION 2. As soon as practicable but not later than six |
---|
55 | 55 | | months after the effective date of this Act, the Texas Education |
---|
56 | 56 | | Agency shall establish the pilot program required under Section |
---|
57 | 57 | | 29.913, Education Code, as added by this Act. |
---|
58 | 58 | | SECTION 3. This Act takes effect immediately if it receives |
---|
59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
---|
60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
---|
62 | 62 | | Act takes effect September 1, 2025. |
