77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a pilot program for outcomes-based contracts at public
1010 schools.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter Z, Chapter 29, Education Code, is
1313 amended by adding Section 29.913 to read as follows:
1414 Sec. 29.913. OUTCOMES-BASED CONTRACTS PILOT PROGRAM. (a)
1515 The agency shall establish a pilot program through which school
1616 districts and open-enrollment charter schools, in contracting for a
1717 good or service related to student outcomes, use a funding model
1818 that ties compensation to measurable student outcomes, including
1919 academic performance, graduation rates, and skill proficiency.
2020 (b) The agency shall select at least five school districts
2121 and open-enrollment charter schools to participate in the pilot
2222 program.
2323 (c) To be eligible to participate in the pilot program, a
2424 school district or open-enrollment charter school must agree to
2525 enter into a contract for a good or service related to student
2626 outcomes that:
2727 (1) requires the contracting entity to:
2828 (A) meet clearly defined outcome targets related
2929 to increased student achievement; and
3030 (B) use best practices;
3131 (2) includes specific, quantifiable performance
3232 metrics used to assess the effectiveness of the good or service in
3333 making progress toward outcome targets described by Subdivision
3434 (1)(A);
3535 (3) provides for a funding structure that includes
3636 incentives for meeting or exceeding outcome targets described by
3737 Subdivision (1)(A); and
3838 (4) allows flexibility in the implementation of
3939 educational strategies tailored to the unique needs of each student
4040 served.
4141 (d) From money appropriated or otherwise available for the
4242 purpose, the agency shall award grants to school districts and
4343 open-enrollment charter schools participating in the pilot
4444 program. The amount of each grant must be correlated to the
4545 achievement of outcome targets described by Subsection (c)(1)(A) in
4646 each contract entered into under the pilot program.
4747 (e) Not later than December 1, 2028, the agency shall submit
4848 to the legislature a report on the results of the pilot program.
4949 The report must include the agency's recommendation on whether the
5050 pilot program should be expanded or continued on a statewide basis.
5151 (f) The commissioner may adopt rules as necessary to
5252 implement the pilot program.
5353 (g) This section expires September 1, 2029.
5454 SECTION 2. As soon as practicable but not later than six
5555 months after the effective date of this Act, the Texas Education
5656 Agency shall establish the pilot program required under Section
5757 29.913, Education Code, as added by this Act.
5858 SECTION 3. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2025.
