| 9 | 9 | | relating to the composition and authority of certain subregional |

| 10 | 10 | | boards of regional transportation authorities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 452.112, Transportation Code, is amended |
|---|
| 13 | 13 | | by adding Subsection (a-1) to read as follows: |
|---|
| 14 | 14 | | (a-1) Each member of the subregional board shall appoint an |
|---|
| 15 | 15 | | equal number of members to the committee. |
|---|
| 16 | 16 | | SECTION 2. Section 452.543(a), Transportation Code, is |
|---|
| 17 | 17 | | amended to read as follows: |
|---|
| 18 | 18 | | (a) Except as provided by Section 452.5725(a), a [A] |
|---|
| 19 | 19 | | subregional board shall elect from its membership a presiding |
|---|
| 20 | 20 | | officer, assistant presiding officer, and secretary. |
|---|
| 21 | 21 | | SECTION 3. Section 452.572, Transportation Code, is amended |
|---|
| 22 | 22 | | to read as follows: |
|---|
| 23 | 23 | | Sec. 452.572. BOARD MEMBERSHIP; MUNICIPAL REPRESENTATION. |
|---|
| 24 | 24 | | (a) The subregional board is composed of one member [15 members] |
|---|
| 25 | 25 | | appointed by the governing body [bodies] of each municipality [the |
|---|
| 26 | 26 | | municipalities] in the subregional authority. |
|---|
| 27 | 27 | | (b) The member appointed by the governing body of the |
|---|
| 28 | 28 | | principal [a] municipality is entitled to [appoint more than one |
|---|
| 29 | 29 | | board member may appoint a number of members less than the number |
|---|
| 30 | 30 | | allocated to the municipality. Those appointed members may] cast |
|---|
| 31 | 31 | | three [the same number of] votes [as the number of members |
|---|
| 32 | 32 | | allocated, but a member may not cast a divided vote]. |

| 33 | 33 | | SECTION 4. Subchapter O, Chapter 452, Transportation Code, |
|---|
| 34 | 34 | | is amended by adding Section 452.5725 to read as follows: |
|---|
| 35 | 35 | | Sec. 452.5725. PRESIDING OFFICER. (a) The position of |
|---|
| 36 | 36 | | presiding officer of a subregional board rotates among the members |
|---|
| 37 | 37 | | of the board in an order established by the board. A term as |
|---|
| 38 | 38 | | presiding officer is two years. |
|---|
| 39 | 39 | | (b) A member of the subregional board may not serve |
|---|
| 40 | 40 | | consecutive terms as presiding officer. |
|---|
| 41 | 41 | | SECTION 5. Section 452.578(a), Transportation Code, is |
|---|
| 42 | 42 | | amended to read as follows: |
|---|
| 43 | 43 | | (a) Members [Each member] of the subregional board serve for |
|---|
| 44 | 44 | | [serves a] staggered terms [term] of two years, with the terms of |
|---|
| 45 | 45 | | one-half of the members, or as near to one-half as possible, |
|---|
| 46 | 46 | | expiring[. Eight of the terms begin] on July 1 of each year |
|---|
| 47 | 47 | | [odd-numbered years, and seven terms begin on July 1 of |
|---|
| 48 | 48 | | even-numbered years]. |
|---|
| 49 | 49 | | SECTION 6. The following provisions of the Transportation |
|---|
| 50 | 50 | | Code are repealed: |
|---|
| 51 | 51 | | (1) Section 452.573; |
|---|
| 52 | 52 | | (2) Section 452.574(c); |
|---|
| 53 | 53 | | (3) Section 452.575; |
|---|
| 54 | 54 | | (4) Section 452.576; |
|---|
| 55 | 55 | | (5) Section 452.577; and |
|---|
| 56 | 56 | | (6) Section 452.578(b). |
|---|
| 57 | 57 | | SECTION 7. (a) On the effective date of this Act, the terms |
|---|
| 58 | 58 | | of office of the members of a subregional board described by |
|---|
| 59 | 59 | | Subchapter O, Chapter 452, Transportation Code, as that subchapter |
|---|
| 60 | 60 | | existed immediately before the effective date of this Act, expire. |
|---|
| 61 | 61 | | (b) As soon as practicable after the effective date of this |
|---|
| 62 | 62 | | Act, the appropriate appointing entity shall appoint the members of |
|---|
| 63 | 63 | | a subregional board under Section 452.572, Transportation Code, as |
|---|
| 64 | 64 | | amended by this Act. |
|---|
| 65 | 65 | | (c) As soon as practicable after the members of a |
|---|
| 66 | 66 | | subregional board have been appointed under Section 452.572, |
|---|
| 67 | 67 | | Transportation Code, as amended by this Act, the board members |
|---|
| 68 | 68 | | shall draw lots to determine which board members serve terms |
|---|
| 69 | 69 | | expiring July 1, 2026, and which board members serve terms expiring |
|---|
| 70 | 70 | | July 1, 2027. |
|---|
| 71 | 71 | | SECTION 8. This Act takes effect September 1, 2025. |
