77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the Task Force on Eating Disorders Prevalence.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. DEFINITIONS. In this Act:
1212 (1) "Commission" means the Health and Human Services
1313 Commission.
1414 (2) "Department" means the Department of State Health
1515 Services.
1616 (3) "Task force" means the Task Force on Eating
1717 Disorders Prevalence.
1818 SECTION 2. PURPOSE. The Task Force on Eating Disorders
1919 Prevalence is established to study, evaluate, and make
2020 recommendations to the legislature based on the conclusions
2121 published in the department's report, Eating Disorders Prevalence,
2222 December 2024, regarding:
2323 (1) treatment accessibility for individuals who have
2424 low or no income and are living with an eating disorder;
2525 (2) resource development for low- or no-income
2626 individuals with an eating disorder living in rural areas;
2727 (3) policy developments to assist residents of this
2828 state with recovery from eating disorders;
2929 (4) research and data collection to understand the
3030 causes, prevalence, and effects of eating disorders on this state
3131 and inform effective interventions and treatment;
3232 (5) coordination of services and exploration of
3333 collaboratives among various interested persons, including health
3434 care providers, educators, mental health professionals, and
3535 community organization members, to create an integrated and
3636 cohesive response to eating disorders; and
3737 (6) any recommendations for legislative or other
3838 action necessary to assist people with eating disorders in this
3939 state.
4040 SECTION 3. TASK FORCE COMPOSITION. The task force is
4141 composed of 14 members with expertise in eating disorders,
4242 appointed by the executive commissioner of the commission as
4343 follows:
4444 (1) three members, each of whom specializes and has at
4545 least five years of experience in treating eating disorders at a
4646 health care facility or in private practice, including:
4747 (A) at least one licensed professional counselor
4848 as defined by Section 503.002, Occupations Code; and
4949 (B) at least one licensed clinical social worker
5050 as defined by Section 505.002, Occupations Code;
5151 (2) two members who are physicians, each of whom
5252 specializes and has at least five years of experience in treating
5353 eating disorders;
5454 (3) three members, each of whom is an employee of a
5555 nonprofit organization that serves low- or no-income populations
5656 and is a professional specializing in mental illness or drugs and
5757 alcohol;
5858 (4) two members of the public, each of whom:
5959 (A) has experience as a caregiver to someone
6060 living with an eating disorder; or
6161 (B) has been diagnosed with an eating disorder;
6262 (5) one member who is an attorney with expertise in
6363 mental health issues;
6464 (6) two certified nutritionists, each of whom
6565 specializes and has at least five years of experience in treating
6666 eating disorders; and
6767 (7) one member representing any other entity as the
6868 task force considers necessary.
6969 SECTION 4. OFFICERS. (a) The task force shall, at its
7070 initial meeting, elect from among the task force members a
7171 presiding officer who will be responsible for calling and
7272 conducting meetings.
7373 (b) The task force may elect an assistant presiding officer
7474 and secretary from among the task force members.
7575 SECTION 5. MEETINGS. (a) The task force shall meet at least
7676 two times each year, at a time and place determined by the presiding
7777 officer of the task force.
7878 (b) The task force may meet at other times the task force
7979 considers appropriate. The presiding officer may call a meeting on
8080 the presiding officer's own motion.
8181 (c) The task force may meet by teleconference.
8282 SECTION 6. COMPENSATION; REIMBURSEMENT. A member of the
8383 task force may not receive compensation or reimbursement for the
8484 member's service on the task force.
8585 SECTION 7. GIFTS, GRANTS, AND DONATIONS. The task force may
8686 accept gifts, grants, or donations on behalf of the task force to
8787 carry out the task force's duties under this Act.
8888 SECTION 8. APPLICATION OF OTHER LAW. Chapter 2110,
8989 Government Code, does not apply to the task force.
9090 SECTION 9. REPORT. (a) Not later than December 1, 2026,
9191 the task force shall submit a written report on the task force's
9292 evaluations, conclusions, recommendations, and summaries to the
9393 legislature.
9494 (b) The task force may post written evaluations,
9595 conclusions, recommendations, and summaries on the department's
9696 Internet website.
9797 SECTION 10. ABOLISHMENT; EXPIRATION. The task force is
9898 abolished and this Act expires September 1, 2027.
9999 SECTION 11. EFFECTIVE DATE. This Act takes effect
100100 immediately if it receives a vote of two-thirds of all the members
101101 elected to each house, as provided by Section 39, Article III, Texas
102102 Constitution. If this Act does not receive the vote necessary for
103103 immediate effect, this Act takes effect September 1, 2025.
