69 A BILL TO BE ENTITLED
710 AN ACT
811 relating to imposition of application fees for certain permits and
912 permit amendments for the disposal of oil and gas waste.
1013 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1114 SECTION 1. Section 91.1013, Natural Resources Code, is
1215 amended by amending Subsections (a) and (b) and adding Subsection
1316 (a-1) to read as follows:
1417 (a) [With each application for a fluid injection well
1518 permit, the applicant shall submit to the commission a
1619 nonrefundable fee of $200.] In this section:
17- (1) "Commercial oil and gas waste separation facility"
18- means a facility that manages but does not dispose of oil and gas
19- waste on site and that is managed by an owner or operator whose
20- primary business is to provide oil field fluid or oil and gas waste
21- management services for compensation.
22- (2) "Commercial surface oil and gas waste disposal
23- facility" means a facility that disposes of oil and gas waste on
24- site and that is managed by an owner or operator whose primary
25- business is to provide oil field fluid or oil and gas waste disposal
26- services for compensation.
27- (3) "Fluid[, "fluid] injection well" means any well

2821 used to inject fluid or gas into the ground in connection with the
2922 exploration or production of oil or gas other than an oil and gas
3023 waste disposal well regulated by the commission pursuant to Chapter
3124 27, Water Code.

3326 authorizing the covering of a controlled area with gas plant
3427 effluent or low-chloride produced water through the use of a
3528 sprinkler or other irrigation system.
36- (5) "Landfarm permit" means a permit authorizing the
37- disposal of low-chloride, water-based oil and gas waste, including
38- drilling fluid, by mixing or tilling the fluid or waste into the
39- natural soil so that the waste will not migrate from the area
40- covered by the landfarm permit.
41- (6) "Landtreatment permit" means a permit authorizing
42- the disposal of oil-based oil and gas waste, including oil-based
43- drilling fluid, oil-impacted soil, or other oil and gas waste, by
44- mixing or tilling the fluid, soil, or waste into the natural soil to
45- degrade the fluid, impacted soil, or waste so that the fluid,
46- impacted soil, or waste will not migrate from the area covered by
47- the landtreatment permit.
29+ (3) "Landfarm permit" means a permit authorizing the
30+ disposal of low chloride, water-based drilling fluid or oil and gas
31+ waste by mixing or tilling the fluid or waste into the natural soil
32+ so that the waste will not migrate from the area covered by the
33+ landfarm permit.
34+ (4) "Landtreatment permit" means a permit authorizing
35+ the disposal of oil-based drilling fluid, oil-impacted soil, or oil
36+ and gas waste by mixing or tilling the fluid, soil, or waste into
37+ the natural soil to degrade the fluid, impacted soil, or waste so
38+ that the fluid, impacted soil, or waste will not migrate from the
39+ area covered by the landtreatment permit.
4840 (a-1) With each application for a fluid injection well
4941 permit, the applicant shall submit to the commission a
5042 nonrefundable fee of $200.
5143 (b) An applicant [With each application] for a permit to
5244 store, treat, or dispose of certain oil and gas waste [discharge to
5345 surface water under this chapter and commission rules, other than a
5446 permit for a discharge that meets National Pollutant Discharge
5547 Elimination System requirements for agricultural or wildlife use,
5648 the applicant] shall submit to the commission a nonrefundable fee
5749 for that application as follows:
5850 (1) $500 for an application for a landfarm,
5951 landtreatment, or land application permit or permit amendment;
6052 (2) $2,000 for an application for a commercial oil and
6153 gas waste separation facility permit;
6254 (3) $1,000 for an application for an amendment to a
63- commercial oil and gas waste separation facility permit;
55+ commercial waste separation facility permit;
6456 (4) $3,000 for an application for a commercial surface
65- oil and gas waste disposal facility permit; and
57+ oil and gas waste facility permit; and
6658 (5) $1,000 for an application for an amendment to a
67- commercial surface oil and gas waste disposal facility [of $300].
59+ commercial surface waste facility permit [of $300].
6860 SECTION 2. Section 91.1013, Natural Resources Code, as
6961 amended by this Act, applies only to an application for the issuance
7062 or amendment of a permit that is filed with the Railroad Commission
7163 of Texas on or after the effective date of this Act. An application
7264 for a permit filed before the effective date of this Act is governed
7365 by the law in effect on the date of the filing, and the former law is
7466 continued in effect for that purpose.
7567 SECTION 3. This Act takes effect September 1, 2025.
