77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the creation of the consumable hemp products account in
1010 the general revenue fund and imposing fees for licensing
1111 manufacturers of consumable hemp products and registering certain
1212 retailers of consumable hemp products.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 431.011, Health and Safety Code, is
1515 amended by adding Subsection (d) to read as follows:
1616 (d) A penalty collected for a violation of this chapter
1717 involving a consumable hemp product shall be deposited to the
1818 credit of the consumable hemp products account established by
1919 Section 443.005.
2020 SECTION 2. Subchapter A, Chapter 443, Health and Safety
2121 Code, is amended by adding Section 443.005 to read as follows:
2222 Sec. 443.005. CONSUMABLE HEMP PRODUCTS ACCOUNT. (a) The
2323 consumable hemp products account is an account in the general
2424 revenue fund administered by the department.
2525 (b) The account consists of:
2626 (1) appropriations of money to the account by the
2727 legislature;
2828 (2) public or private gifts, grants, or donations,
2929 including federal funds, received for the account;
3030 (3) fees collected under this chapter;
3131 (4) penalties for a violation of:
3232 (A) this chapter; or
3333 (B) Chapter 431, if the violation related to a
3434 consumable hemp product;
3535 (5) interest and income earned on the investment of
3636 money in the account; and
3737 (6) money from any other source deposited in the
3838 account.
3939 (c) The department may accept appropriations and gifts,
4040 grants, or donations from any source to administer and enforce:
4141 (1) this chapter; and
4242 (2) provisions of Chapter 431 relating to a consumable
4343 hemp product.
4444 (d) Money received under Subsection (c) shall be deposited
4545 in the account.
4646 (e) Money in the account may be appropriated only to the
4747 department for the administration and enforcement of:
4848 (1) this chapter; and
4949 (2) provisions of Chapter 431 relating to a consumable
5050 hemp product.
5151 SECTION 3. Subchapter C, Chapter 443, Health and Safety
5252 Code, is amended by adding Section 443.1035 to read as follows:
5353 Sec. 443.1035. LICENSING FEES. (a) An applicant for a
5454 license under this subchapter shall pay an initial licensing fee to
5555 the department in the amount of $10,000 for each location where the
5656 applicant intends to process hemp or manufacture a consumable hemp
5757 product.
5858 (b) Before the department may renew a license as provided by
5959 Section 443.104, a license holder shall pay a renewal fee to the
6060 department in the amount of $10,000 for each location where the
6161 applicant intends to process hemp or manufacture a consumable hemp
6262 product.
6363 SECTION 4. Section 443.2025(f), Health and Safety Code, is
6464 amended to read as follows:
6565 (f) The owner of a location at which consumable hemp
6666 products containing cannabidiol are sold shall annually pay to the
6767 department a registration fee in the amount of $20,000 for each
6868 location owned by the person at which those products are sold [The
6969 department by rule may adopt a registration fee schedule that
7070 establishes reasonable fee amounts for the registration of:
7171 [(1) a single location at which consumable hemp
7272 products containing cannabidiol are sold; and
7373 [(2) multiple locations at which consumable hemp
7474 products containing cannabidiol are sold under a single
7575 registration].
7676 SECTION 5. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2025.
