| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife | |
| 12 | 12 | Code, is amended by adding Section 43.3515 to read as follows: | |
| 13 | 13 | Sec. 43.3515. OWNERSHIP OF BREEDER DEER. (a) Except as | |
| 14 | 14 | provided by Subsection (c), a breeder deer is the personal property | |
| 15 | 15 | of a deer breeder if the breeder deer is: | |
| 16 | 16 | (1) born and raised in captivity; | |
| 17 | 17 | (2) held in accordance with a permit issued under | |
| 18 | 18 | Section 43.352; and | |
| 19 | 19 | (3) permanently and legibly tattooed in one ear with | |
| 20 | 20 | the unique identification number that is assigned to the deer | |
| 21 | 21 | breeder. | |
| 22 | 22 | (b) To the extent of a conflict, this section prevails over | |
| 23 | 23 | Section 1.011 or 1.013. | |
| 24 | 24 | (c) Subsection (a) does not apply to a breeder deer that is | |
| 25 | 25 | intentionally released into the wild from the deer breeder's | |
| 26 | 26 | facility. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
