88 AN ACT
99 relating to the implementation of diversity, equity, and inclusion
1010 initiatives by providers of electric service.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 31, Utilities Code, is amended by adding
1313 Subchapter C to read as follows:
1414 SUBCHAPTER C. PROHIBITION ON CERTAIN DIVERSITY, EQUITY, AND
1515 INCLUSION INITIATIVES
1616 Sec. 31.101. DEFINITIONS. In this subchapter:
1717 (1) "Diversity, equity, and inclusion office" means an
1818 office, division, or other unit of an electric utility, municipally
1919 owned utility, or retail electric provider established for the
2020 purpose of:
2121 (A) influencing hiring or employment practices
2222 at the utility or provider with respect to race, sex, color, or
2323 ethnicity, other than through the use of color-blind, race-neutral,
2424 and sex-neutral hiring processes in accordance with any applicable
2525 state and federal antidiscrimination laws;
2626 (B) promoting differential treatment or
2727 providing special benefits to individuals on the basis of race,
2828 sex, color, or ethnicity;
2929 (C) promoting policies or procedures designed or
3030 implemented in reference to race, sex, color, or ethnicity, other
3131 than policies or procedures:
3232 (i) approved in writing by the attorney
3333 general; and
3434 (ii) implemented for the sole purpose of
3535 ensuring compliance with any applicable court order or federal law;
3636 or
3737 (D) conducting trainings, programs, or
3838 activities designed or implemented in reference to race, sex,
3939 color, ethnicity, gender identity, or sexual orientation, other
4040 than trainings, programs, or activities:
4141 (i) developed by an attorney;
4242 (ii) approved in writing by the attorney
4343 general; and
4444 (iii) conducted for the sole purpose of
4545 ensuring compliance with any applicable court order or state or
4646 federal law.
4747 (2) "Electric utility" includes an electric
4848 cooperative.
4949 Sec. 31.102. RESPONSIBILITY OF ELECTRIC UTILITY,
5050 MUNICIPALLY OWNED UTILITY, OR RETAIL ELECTRIC PROVIDER REGARDING
5151 DIVERSITY, EQUITY, AND INCLUSION INITIATIVES. An electric utility,
5252 municipally owned utility, or retail electric provider shall ensure
5353 that each unit of the utility or provider does not, except as
5454 required by federal law:
5555 (1) establish or maintain a diversity, equity, and
5656 inclusion office; or
5757 (2) hire or assign an employee of the utility or
5858 provider or contract with a third party to perform the duties of a
5959 diversity, equity, and inclusion office.
6060 Sec. 31.103. COMPLAINT; ENFORCEMENT. (a) A person who has a
6161 reasonable belief that an electric utility, municipally owned
6262 utility, or retail electric provider is violating this subchapter
6363 may file a complaint with the attorney general.
6464 (b) If the attorney general determines that an electric
6565 utility or retail electric provider named in a complaint received
6666 under Subsection (a) is violating this subchapter, the attorney
6767 general may bring an action to enjoin or require compliance with
6868 this subchapter under Section 15.021.
6969 (c) If the attorney general determines that a municipally
7070 owned utility named in a complaint received under Subsection (a) is
7171 violating this subchapter, the attorney general may file a petition
7272 for a writ of mandamus to compel the municipally owned utility to
7373 comply with this subchapter.
7474 (d) A mandamus action under Subsection (c) must be filed in
7575 the county in which the municipally owned utility is located.
7676 SECTION 2. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2025.
