77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to countywide polling places.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 43.007, Election Code, is amended by
1212 amending Subsection (a) and adding Subsection (q) to read as
1313 follows:
1414 (a) The secretary of state shall implement a program to
1515 allow each commissioners court participating in the program to
1616 [eliminate county election precinct polling places and] establish
1717 countywide polling places at each county election precinct for:
1818 (1) any election required to be conducted by the
1919 county;
2020 (2) any election held as part of a joint election
2121 agreement with a county under Chapter 271;
2222 (3) any election held under contract for election
2323 services with a county under Subchapter D, Chapter 31;
2424 (4) each primary election and runoff primary election
2525 if:
2626 (A) the county chair or county executive
2727 committee of each political party participating in a joint primary
2828 election under Section 172.126 agrees to the use of countywide
2929 polling places; or
3030 (B) the county chair or county executive
3131 committee of each political party required to nominate candidates
3232 by primary election agrees to use the same countywide polling
3333 places; and
3434 (5) each election of a political subdivision located
3535 in the county that is held jointly with an election described by
3636 Subdivision (3) or (4).
3737 (q) Each countywide polling place must be provided with a
3838 poll list for the entire county.
3939 SECTION 2. Sections 43.007(f), (g), (h), (m), and (n),
4040 Election Code, are repealed.
4141 SECTION 3. This Act takes effect September 1, 2025.
