9 | 9 | | relating to the membership of and qualifications for the Texas |
---|
10 | 10 | | Lottery Commission. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 467.021, Government Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | Sec. 467.021. MEMBERSHIP. (a) The commission is composed |
---|
15 | 15 | | of seven [five] members appointed by the governor with the advice |
---|
16 | 16 | | and consent of the senate as follows: |
---|
17 | 17 | | (1) five voting members appointed as provided by |
---|
18 | 18 | | Subsection (c); and |
---|
19 | 19 | | (2) two nonvoting members appointed as provided by |
---|
20 | 20 | | Subsection (d). |
---|
21 | 21 | | (b) In making appointments to the commission, the governor |
---|
22 | 22 | | shall strive to achieve representation by all the population groups |
---|
23 | 23 | | of the state [with regard to economic status, sex, race, and |
---|
24 | 24 | | ethnicity]. |
---|
25 | 25 | | (c) In appointing the five voting commission members, the |
---|
26 | 26 | | governor shall appoint: |
---|
27 | 27 | | (1) one member who is a peace officer or an individual |
---|
28 | 28 | | with law enforcement experience; |
---|
29 | 29 | | (2) one member who is an attorney licensed to practice |
---|
30 | 30 | | law in this state; |
---|
31 | 31 | | (3) one member who is a certified public accountant; |
---|
32 | 32 | | and |
---|
33 | 33 | | (4) one [One] member who has [must have] experience in |
---|
34 | 34 | | the bingo industry. |
---|
35 | 35 | | (d) In appointing the two nonvoting commission members, the |
---|
36 | 36 | | governor shall appoint: |
---|
37 | 37 | | (1) one member who represents the Texas Food and Fuel |
---|
38 | 38 | | Association from a list of persons suggested by the association; |
---|
39 | 39 | | and |
---|
40 | 40 | | (2) one member who is an individual with knowledge of |
---|
41 | 41 | | the gaming industry. |
---|
42 | 42 | | (e) Commission members serve at the pleasure of the |
---|
43 | 43 | | governor. |
---|
44 | 44 | | SECTION 2. Section 467.024, Government Code, is amended by |
---|
45 | 45 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
46 | 46 | | follows: |
---|
47 | 47 | | (a) An individual is not eligible to be [an] appointed or |
---|
48 | 48 | | serve as a voting member of the commission if the individual: |
---|
49 | 49 | | (1) is registered, certified, or licensed by a |
---|
50 | 50 | | regulatory agency in the field of bingo or lottery; |
---|
51 | 51 | | (2) owns or controls, directly or indirectly, more |
---|
52 | 52 | | than a 10 percent interest in a business entity or other |
---|
53 | 53 | | organization regulated by the commission or receiving funds from |
---|
54 | 54 | | the commission; |
---|
55 | 55 | | (3) is employed by or participates in the management |
---|
56 | 56 | | of a business entity or other organization regulated by or |
---|
57 | 57 | | receiving funds from the commission; |
---|
58 | 58 | | (4) uses or receives a substantial amount of tangible |
---|
59 | 59 | | goods, services, or funds from the commission, other than |
---|
60 | 60 | | compensation or reimbursement authorized by law for commission |
---|
61 | 61 | | membership, attendance, or expenses; |
---|
62 | 62 | | (5) is an officer, employee, or paid consultant of a |
---|
63 | 63 | | Texas trade association in the field of bingo or lottery; |
---|
64 | 64 | | (6) is required to register as a lobbyist under |
---|
65 | 65 | | Chapter 305 because of the person's activities for compensation on |
---|
66 | 66 | | behalf of a profession related to the operation of the commission; |
---|
67 | 67 | | (7) is married to an individual described by |
---|
68 | 68 | | Subdivisions (2)-(6); |
---|
69 | 69 | | (8) has been convicted of a felony or of any crime |
---|
70 | 70 | | involving moral turpitude; or |
---|
71 | 71 | | (9) is not a citizen of the United States. |
---|
72 | 72 | | (a-1) An individual is not eligible to be appointed or serve |
---|
73 | 73 | | as a nonvoting member of the commission if the individual: |
---|
74 | 74 | | (1) has been convicted of a felony or of any crime |
---|
75 | 75 | | involving moral turpitude; or |
---|
76 | 76 | | (2) is not a citizen of the United States. |
---|
77 | 77 | | SECTION 3. (a) The change in law made by this Act in the |
---|
78 | 78 | | qualifications of members of the Texas Lottery Commission does not |
---|
79 | 79 | | affect the entitlement of a member serving on the commission |
---|
80 | 80 | | immediately before the effective date of this Act to continue to |
---|
81 | 81 | | serve for the remainder of the member's term. As the terms of |
---|
82 | 82 | | commission members expire, the governor shall appoint or reappoint |
---|
83 | 83 | | a member who has the qualifications required for a member under |
---|
84 | 84 | | Section 467.021, Government Code, as amended by this Act. |
---|
85 | 85 | | (b) As soon as practicable after the effective date of this |
---|
86 | 86 | | Act, the governor shall appoint two nonvoting members to the Texas |
---|
87 | 87 | | Lottery Commission as required by Section 467.021(d), Government |
---|
88 | 88 | | Code, as added by this Act. |
---|
89 | 89 | | SECTION 4. This Act takes effect immediately if it receives |
---|
90 | 90 | | a vote of two-thirds of all the members elected to each house, as |
---|
91 | 91 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
92 | 92 | | Act does not receive the vote necessary for immediate effect, this |
---|
93 | 93 | | Act takes effect September 1, 2025. |
