77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the membership of and qualifications for the Texas
1010 Lottery Commission.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 467.021, Government Code, is amended to
1313 read as follows:
1414 Sec. 467.021. MEMBERSHIP. (a) The commission is composed
1515 of seven [five] members appointed by the governor with the advice
1616 and consent of the senate as follows:
1717 (1) five voting members appointed as provided by
1818 Subsection (c); and
1919 (2) two nonvoting members appointed as provided by
2020 Subsection (d).
2121 (b) In making appointments to the commission, the governor
2222 shall strive to achieve representation by all the population groups
2323 of the state [with regard to economic status, sex, race, and
2424 ethnicity].
2525 (c) In appointing the five voting commission members, the
2626 governor shall appoint:
2727 (1) one member who is a peace officer or an individual
2828 with law enforcement experience;
2929 (2) one member who is an attorney licensed to practice
3030 law in this state;
3131 (3) one member who is a certified public accountant;
3232 and
3333 (4) one [One] member who has [must have] experience in
3434 the bingo industry.
3535 (d) In appointing the two nonvoting commission members, the
3636 governor shall appoint:
3737 (1) one member who represents the Texas Food and Fuel
3838 Association from a list of persons suggested by the association;
3939 and
4040 (2) one member who is an individual with knowledge of
4141 the gaming industry.
4242 (e) Commission members serve at the pleasure of the
4343 governor.
4444 SECTION 2. Section 467.024, Government Code, is amended by
4545 amending Subsection (a) and adding Subsection (a-1) to read as
4646 follows:
4747 (a) An individual is not eligible to be [an] appointed or
4848 serve as a voting member of the commission if the individual:
4949 (1) is registered, certified, or licensed by a
5050 regulatory agency in the field of bingo or lottery;
5151 (2) owns or controls, directly or indirectly, more
5252 than a 10 percent interest in a business entity or other
5353 organization regulated by the commission or receiving funds from
5454 the commission;
5555 (3) is employed by or participates in the management
5656 of a business entity or other organization regulated by or
5757 receiving funds from the commission;
5858 (4) uses or receives a substantial amount of tangible
5959 goods, services, or funds from the commission, other than
6060 compensation or reimbursement authorized by law for commission
6161 membership, attendance, or expenses;
6262 (5) is an officer, employee, or paid consultant of a
6363 Texas trade association in the field of bingo or lottery;
6464 (6) is required to register as a lobbyist under
6565 Chapter 305 because of the person's activities for compensation on
6666 behalf of a profession related to the operation of the commission;
6767 (7) is married to an individual described by
6868 Subdivisions (2)-(6);
6969 (8) has been convicted of a felony or of any crime
7070 involving moral turpitude; or
7171 (9) is not a citizen of the United States.
7272 (a-1) An individual is not eligible to be appointed or serve
7373 as a nonvoting member of the commission if the individual:
7474 (1) has been convicted of a felony or of any crime
7575 involving moral turpitude; or
7676 (2) is not a citizen of the United States.
7777 SECTION 3. (a) The change in law made by this Act in the
7878 qualifications of members of the Texas Lottery Commission does not
7979 affect the entitlement of a member serving on the commission
8080 immediately before the effective date of this Act to continue to
8181 serve for the remainder of the member's term. As the terms of
8282 commission members expire, the governor shall appoint or reappoint
8383 a member who has the qualifications required for a member under
8484 Section 467.021, Government Code, as amended by this Act.
8585 (b) As soon as practicable after the effective date of this
8686 Act, the governor shall appoint two nonvoting members to the Texas
8787 Lottery Commission as required by Section 467.021(d), Government
8888 Code, as added by this Act.
8989 SECTION 4. This Act takes effect immediately if it receives
9090 a vote of two-thirds of all the members elected to each house, as
9191 provided by Section 39, Article III, Texas Constitution. If this
9292 Act does not receive the vote necessary for immediate effect, this
9393 Act takes effect September 1, 2025.
