77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to aquifer storage and recovery projects that transect a
1010 portion of the Edwards Aquifer.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 27.051(i), Water Code, is amended to
1313 read as follows:
1414 (i) For purposes of this subsection, "Edwards Aquifer" has
1515 the meaning assigned by Section 26.046(a). Except as otherwise
1616 provided by this subsection, the commission may not authorize by
1717 rule or permit an injection well that transects or terminates in the
1818 Edwards Aquifer. The commission by rule or permit may authorize:
1919 (1) injection of groundwater withdrawn from the
2020 Edwards Aquifer;
2121 (2) injections of storm water, flood water, or
2222 groundwater through improved sinkholes or caves located in karst
2323 topographic areas; [or]
2424 (3) injections of water made in accordance with
2525 Section 1.44(e)(3), Chapter 626, Acts of the 73rd Legislature,
2626 Regular Session, 1993; or
2727 (4) an aquifer storage and recovery project that
2828 includes an ASR injection well, as defined by Section 27.151, that
2929 transects the Edwards Aquifer in Medina County for the injection of
3030 water into a geologic formation that underlies the Edwards Aquifer.
3131 SECTION 2. Not later than March 1, 2026, the Texas
3232 Commission on Environmental Quality shall adopt rules to implement
3333 Section 27.051(i), Water Code, as amended by this Act.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2025.
