77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a restriction on the authority of a state agency to
1010 spend appropriated money to provide financial support to certain
1111 organizations and events.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 2113, Government Code, is
1414 amended by adding Section 2113.108 to read as follows:
1515 Sec. 2113.108. FINANCIAL SUPPORT FOR CERTAIN ORGANIZATIONS
1616 AND EVENTS. (a) Except as otherwise provided by this section, a
1717 state agency may not spend appropriated money to:
1818 (1) sponsor, partner with, donate to, or otherwise
1919 provide financial support to a news media or nonprofit
2020 organization; or
2121 (2) sponsor or otherwise provide financial support for
2222 a private event.
2323 (b) The restriction provided by Subsection (a) does not
2424 apply to an expenditure by a state agency that is:
2525 (1) specifically authorized by a provision of state
2626 law or the state constitution; or
2727 (2) reasonably related to the duties and functions of
2828 the agency.
2929 (c) This section does not restrict the ability of a state
3030 agency to use appropriated money to:
3131 (1) purchase a subscription to a newspaper or other
3232 periodical; or
3333 (2) pay the costs associated with attendance at a
3434 continuing education course by an employee of the agency if the
3535 course is related to the employee's employment position.
3636 SECTION 2. This Act takes effect September 1, 2025.
