9 | 9 | | relating to a restriction on the authority of a state agency to |
---|
10 | 10 | | spend appropriated money to provide financial support to certain |
---|
11 | 11 | | organizations and events. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Subchapter C, Chapter 2113, Government Code, is |
---|
14 | 14 | | amended by adding Section 2113.108 to read as follows: |
---|
15 | 15 | | Sec. 2113.108. FINANCIAL SUPPORT FOR CERTAIN ORGANIZATIONS |
---|
16 | 16 | | AND EVENTS. (a) Except as otherwise provided by this section, a |
---|
17 | 17 | | state agency may not spend appropriated money to: |
---|
18 | 18 | | (1) sponsor, partner with, donate to, or otherwise |
---|
19 | 19 | | provide financial support to a news media or nonprofit |
---|
20 | 20 | | organization; or |
---|
21 | 21 | | (2) sponsor or otherwise provide financial support for |
---|
22 | 22 | | a private event. |
---|
23 | 23 | | (b) The restriction provided by Subsection (a) does not |
---|
24 | 24 | | apply to an expenditure by a state agency that is: |
---|
25 | 25 | | (1) specifically authorized by a provision of state |
---|
26 | 26 | | law or the state constitution; or |
---|
27 | 27 | | (2) reasonably related to the duties and functions of |
---|
28 | 28 | | the agency. |
---|
29 | 29 | | (c) This section does not restrict the ability of a state |
---|
30 | 30 | | agency to use appropriated money to: |
---|
31 | 31 | | (1) purchase a subscription to a newspaper or other |
---|
32 | 32 | | periodical; or |
---|
33 | 33 | | (2) pay the costs associated with attendance at a |
---|
34 | 34 | | continuing education course by an employee of the agency if the |
---|
35 | 35 | | course is related to the employee's employment position. |
---|
36 | 36 | | SECTION 2. This Act takes effect September 1, 2025. |
---|
