77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the termination of a lease agreement of a
1010 servicemember's dependent.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 92.017(b), Property Code, is amended to
1313 read as follows:
1414 (b) A tenant who is a servicemember or a dependent of a
1515 servicemember may vacate the dwelling leased by the tenant and
1616 avoid liability for future rent and all other sums due under the
1717 lease for terminating the lease and vacating the dwelling before
1818 the end of the lease term if:
1919 (1) the lease was executed by or on behalf of a person
2020 who, after executing the lease or during the term of the lease,
2121 enters military service; [or]
2222 (2) a servicemember, while in military service,
2323 executes the lease and after executing the lease receives military
2424 orders:
2525 (A) for a permanent change of station; or
2626 (B) to deploy with a military unit for a period of
2727 90 days or more; or
2828 (3) a servicemember or a spouse of the servicemember,
2929 while the servicemember is in military service, guarantees the
3030 lease on behalf of a dependent, and, after guaranteeing the lease,
3131 the servicemember receives military orders:
3232 (A) for a permanent change of station; or
3333 (B) to deploy with a military unit for a period of
3434 90 days or more.
3535 SECTION 2. The change in law made by this Act applies only
3636 to a lease entered into or renewed on or after the effective date of
3737 this Act. A lease entered into or renewed before the effective date
3838 of this Act is governed by the law as it existed immediately before
3939 the effective date of this Act, and that law is continued in effect
4040 for that purpose.
4141 SECTION 3. This Act takes effect September 1, 2025.
