9 | 9 | | relating to the termination of a lease agreement of a |

10 | 10 | | servicemember's dependent. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 92.017(b), Property Code, is amended to |
---|
13 | 13 | | read as follows: |
---|
14 | 14 | | (b) A tenant who is a servicemember or a dependent of a |
---|
15 | 15 | | servicemember may vacate the dwelling leased by the tenant and |
---|
16 | 16 | | avoid liability for future rent and all other sums due under the |
---|
17 | 17 | | lease for terminating the lease and vacating the dwelling before |
---|
18 | 18 | | the end of the lease term if: |
---|
19 | 19 | | (1) the lease was executed by or on behalf of a person |
---|
20 | 20 | | who, after executing the lease or during the term of the lease, |
---|
21 | 21 | | enters military service; [or] |
---|
22 | 22 | | (2) a servicemember, while in military service, |
---|
23 | 23 | | executes the lease and after executing the lease receives military |
---|
24 | 24 | | orders: |
---|
25 | 25 | | (A) for a permanent change of station; or |
---|
26 | 26 | | (B) to deploy with a military unit for a period of |
---|
27 | 27 | | 90 days or more; or |
---|
28 | 28 | | (3) a servicemember or a spouse of the servicemember, |
---|
29 | 29 | | while the servicemember is in military service, guarantees the |
---|
30 | 30 | | lease on behalf of a dependent, and, after guaranteeing the lease, |
---|
31 | 31 | | the servicemember receives military orders: |
---|
32 | 32 | | (A) for a permanent change of station; or |
---|
33 | 33 | | (B) to deploy with a military unit for a period of |
---|
34 | 34 | | 90 days or more. |
---|
35 | 35 | | SECTION 2. The change in law made by this Act applies only |
---|
36 | 36 | | to a lease entered into or renewed on or after the effective date of |
---|
37 | 37 | | this Act. A lease entered into or renewed before the effective date |
---|
38 | 38 | | of this Act is governed by the law as it existed immediately before |
---|
39 | 39 | | the effective date of this Act, and that law is continued in effect |
---|
40 | 40 | | for that purpose. |
---|
41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
