BILL ANALYSIS Senate Research Center S.B. 2183 89R12237 PRL-F By: Hinojosa, Adam Local Government 4/4/2025 As Filed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Currently, Texas permits statewide fireworks sales during Independence Day and New Year's Eve, with additional sales allowed near the Texas-Mexico border for Cinco de Mayo. Counties can also choose to permit sales for Texas Independence Day, San Jacinto Day, Memorial Day, and Diwali. S.B. 2183 proposes to standardize these optional and regional sales periods to ensure clarity, fairness, and uniformity across all counties in Texas. As proposed, S.B. 2183 amends current law relating to the periods during which a retail fireworks permit holder may sell fireworks to the public. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2154.202(g), Occupations Code, as follows: (g) Authorizes a retail fireworks permit holder to sell fireworks only to the public, and only during certain periods of time. Deletes existing text authorizing a retail fireworks permit holder, except as provided by Subsection (h) (relating to authorizing the commissioners court of a county by order to allow a retail fireworks permit holder to sell fireworks in that county only to the public and only during certain periods), to sell fireworks only to the public, and only during periods beginning May 1 and ending at midnight on May 5 if the fireworks are sold at a location that is not more than 100 miles from the Texas-Mexico border and that is in a county in which the commissioners court of the county has approved the sale of fireworks during the period. Makes nonsubstantive changes. SECTION 2. Repealer: Section 2154.202(h) (relating to relating to authorizing the commissioners court of a county by order to allow a retail fireworks permit holder to sell fireworks in that county only to the public and only during certain periods), Occupations Code.
