66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to the periods during which a retail fireworks permit
99 holder may sell fireworks to the public.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2154.202(g), Occupations Code, is
1212 amended to read as follows:
1313 (g) A [Except as provided by Subsection (h), a] retail
1414 fireworks permit holder may sell fireworks only to the public, and
1515 only during periods:
1616 (1) beginning February 25 and ending at midnight on
1717 March 2;
1818 (2) beginning April 16 and ending at midnight on April
1919 21;
2020 (3) beginning May 1 and ending at midnight on May 5;
2121 (4) beginning the Wednesday before the last Monday in
2222 May and ending at midnight on the last Monday in May;
2323 (5) beginning June 24 and ending at midnight on July 4;
2424 (6) beginning five days before the first day of Diwali
2525 and ending at midnight on the last day of Diwali; and
2626 (7) [(2)] beginning December 20 and ending at midnight
2727 on January 1 of the following year[; and
2828 [(3) beginning May 1 and ending at midnight on May 5 if
2929 the fireworks are sold at a location that is not more than 100 miles
3030 from the Texas-Mexico border and that is in a county in which the
3131 commissioners court of the county has approved the sale of
3232 fireworks during the period].
3333 SECTION 2. Section 2154.202(h), Occupations Code, is
3434 repealed.
3535 SECTION 3. This Act takes effect September 1, 2025.
