| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 2154.202(g), Occupations Code, is |
|---|
| 12 | 12 | | amended to read as follows: |
|---|
| 13 | 13 | | (g) A [Except as provided by Subsection (h), a] retail |
|---|
| 14 | 14 | | fireworks permit holder may sell fireworks only to the public, and |
|---|
| 15 | 15 | | only during periods: |
|---|
| 16 | 16 | | (1) beginning February 25 and ending at midnight on |
|---|
| 17 | 17 | | March 2; |
|---|
| 18 | 18 | | (2) beginning April 16 and ending at midnight on April |
|---|
| 19 | 19 | | 21; |
|---|
| 20 | 20 | | (3) beginning May 1 and ending at midnight on May 5; |
|---|
| 21 | 21 | | (4) beginning the Wednesday before the last Monday in |
|---|
| 22 | 22 | | May and ending at midnight on the last Monday in May; |
|---|
| 23 | 23 | | (5) beginning June 24 and ending at midnight on July 4; |
|---|
| 24 | 24 | | (6) beginning five days before the first day of Diwali |
|---|
| 25 | 25 | | and ending at midnight on the last day of Diwali; and |
|---|
| 26 | 26 | | (7) [(2)] beginning December 20 and ending at midnight |
|---|
| 27 | 27 | | on January 1 of the following year[; and |
|---|
| 28 | 28 | | [(3) beginning May 1 and ending at midnight on May 5 if |
|---|
| 29 | 29 | | the fireworks are sold at a location that is not more than 100 miles |
|---|
| 30 | 30 | | from the Texas-Mexico border and that is in a county in which the |
|---|
| 31 | 31 | | commissioners court of the county has approved the sale of |
|---|
| 32 | 32 | | fireworks during the period]. |

| 33 | 33 | | SECTION 2. Section 2154.202(h), Occupations Code, is |
|---|
| 34 | 34 | | repealed. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2025. |
