77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to compensatory time off for certain state employees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 662.005(b), Government Code, as amended
1212 by Chapters 109 (S.B. 2214), 765 (H.B. 4504), and 950 (S.B. 1727),
1313 Acts of the 88th Legislature, Regular Session, 2023, is reenacted
1414 and amended to read as follows:
1515 (b) Except as provided by Section 662.010, and
1616 notwithstanding Section 659.015 or another law, each of the
1717 following state employees who is required to work on a national or
1818 state holiday that falls on a Saturday or Sunday is entitled to
1919 compensatory time off at the rate of one hour for each hour worked
2020 on the holiday:
2121 (1) an employee of the Department of Family and
2222 Protective Services in the statewide intake division who receives
2323 reports of abuse or neglect;
2424 (2) a peace officer commissioned or appointed, as
2525 applicable, by a state officer or state agency listed under Article
2626 2A.001, Code of Criminal Procedure;
2727 (3) an employee of the Department of Public Safety
2828 who:
2929 (A) performs communications or dispatch services
3030 related to traffic law enforcement; [or]
3131 (B) is a public security officer, as that term is
3232 defined by Section 1701.001, Occupations Code; or
3333 (C) performs criminal intelligence analysis or
3434 crime analysis work related to traffic law enforcement or other
3535 criminal law enforcement;
3636 (4) an employee of the Parks and Wildlife Department
3737 who performs communications and dispatch services to assist law
3838 enforcement officers commissioned by the Parks and Wildlife
3939 Commission in performing law enforcement duties;
4040 (5) an employee of[, or who is employed by] the Texas
4141 Juvenile Justice Department who:
4242 (A) performs [to perform] communication service
4343 duties for the incident reporting center; and
4444 (B) assists [to assist] law enforcement officers
4545 appointed by the office of inspector general of the Texas Juvenile
4646 Justice Department in performing investigative duties; [,] or
4747 (6) [who is employed as] a security officer providing
4848 security and entry searches for secure correctional facilities
4949 operated by the Texas Juvenile Justice Department[,].
5050 SECTION 2. To the extent of any conflict, this Act prevails
5151 over another Act of the 89th Legislature, Regular Session, 2025,
5252 relating to nonsubstantive additions to and corrections in enacted
5353 codes.
5454 SECTION 3. This Act takes effect September 1, 2025.
