88 AN ACT
99 relating to an early childhood integrated data system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle B, Title 3, Human Resources Code, is
1212 amended by adding Chapter 74 to read as follows:
1313 CHAPTER 74. EARLY CHILDHOOD INTEGRATED DATA SYSTEM
1414 Sec. 74.0001. DEFINITIONS. In this chapter:
1515 (1) "Cooperating entity" means the:
1616 (A) Children's Learning Institute at The
1717 University of Texas Health Science Center at Houston;
1818 (B) Department of Family and Protective
1919 Services;
2020 (C) Health and Human Services Commission;
2121 (D) Texas Education Agency;
2222 (E) Texas Workforce Commission; and
2323 (F) Texas Head Start State Collaboration Office.
2424 (2) "Early childhood interagency workgroup" means the
2525 workgroup that promotes collaboration across state agencies
2626 serving families with young children and that consists of
2727 representatives from the following state agencies:
2828 (A) Department of Family and Protective
2929 Services;
3030 (B) Department of State Health Services;
3131 (C) Health and Human Services Commission;
3232 (D) Texas Education Agency; and
3333 (E) Texas Workforce Commission.
3434 (3) "Lead agency" means the state agency designated
3535 under Section 74.0003.
3636 (4) "System" means the early childhood integrated data
3737 system established under this subchapter.
3838 Sec. 74.0002. INITIAL DEVELOPMENT OF EARLY CHILDHOOD
3939 INTEGRATED DATA SYSTEM. (a) Subject to Section 74.0004(1), the
4040 early childhood interagency workgroup shall develop the early
4141 childhood integrated data system for the purpose of facilitating
4242 and strengthening the sharing of data from early childhood programs
4343 across state agencies to:
4444 (1) better inform policy related to those programs at
4545 the state level; and
4646 (2) guide improvements to those programs that support
4747 this state's early childhood goals and priorities and provide
4848 better outcomes for children and families in this state.
4949 (b) The system must be developed in a manner that:
5050 (1) allows for the integration of existing state and
5151 federal data systems that are accessible to the cooperating
5252 agencies and that contain data derived from early childhood
5353 services and programs that serve families with children from birth
5454 through eight years of age, including data related to outcomes
5555 under those services and programs;
5656 (2) allows for the identification of and reporting on:
5757 (A) specific outcome measures using aggregated
5858 data that does not contain any identifying information, to the
5959 extent state or federal law, as applicable, expressly authorizes
6060 that use of the information;
6161 (B) gaps in services and underserved
6262 populations;
6363 (C) opportunities to align services and
6464 programs; and
6565 (D) coordination needs across services and
6666 programs; and
6767 (3) complies with state and federal laws relating to
6868 privacy, cybersecurity, and data collection, including rules
6969 establishing procedures to ensure that there is no unauthorized
7070 duplication or removal of confidential information.
7171 (c) Data other than that described by Subsection (b)(1) may
7272 not be collected for purposes of the system.
7373 Sec. 74.0003. DESIGNATION OF LEAD AGENCY. During the
7474 initial development of the system under Section 74.0002, the early
7575 childhood interagency workgroup shall designate from among the
7676 state entities listed in Sections 74.0001(1)(A) through (E) one
7777 entity to act as the lead agency for the system.
7878 Sec. 74.0004. LEAD AGENCY DUTIES. The lead agency shall:
7979 (1) complete the development of the system initially
8080 developed under Section 74.0002 in a manner consistent with the
8181 requirements of that section;
8282 (2) implement and maintain the system with assistance
8383 from the early childhood interagency workgroup;
8484 (3) provide staff to operate the system; and
8585 (4) using system data, conduct data matching using a
8686 protocol approved by the cooperating entities.
8787 Sec. 74.0005. COOPERATING ENTITIES. (a) The lead agency
8888 and each cooperating entity shall enter into a memorandum of
8989 understanding regarding the sharing of data for purposes of the
9090 system. The memorandum of understanding must specify the data to be
9191 shared consistent with Sections 74.0002(b)(1) and (c) and the
9292 frequency and manner of that data sharing.
9393 (b) Each cooperating entity shall participate in the system
9494 and share data for purposes of the system as required by the
9595 memorandum of understanding.
9696 Sec. 74.0006. REPORTING REQUIREMENTS. (a) Not later than
9797 January 1 of each year, the early childhood interagency workgroup
9898 shall submit to the legislature a report on the workgroup's, lead
9999 agency's, and cooperating entities' progress in developing,
100100 establishing, and operating the system.
101101 (b) The initial report required by Subsection (a) must
102102 include:
103103 (1) the state entity the early childhood interagency
104104 workgroup designated to act as the lead agency;
105105 (2) an interagency data governance plan that includes:
106106 (A) objectives relevant to the system and a
107107 framework for achieving those objectives;
108108 (B) the roles and responsibilities of all state
109109 entities involved in establishing and maintaining the system; and
110110 (C) documentation of relevant state and federal
111111 privacy, cybersecurity, and data collection laws, including rules;
112112 (3) a standardized process for updating the memorandum
113113 of understanding into which the cooperating entities entered under
114114 Section 74.0005;
115115 (4) a design plan that focuses on:
116116 (A) data security, storage, retention,
117117 management, processing, transportation, and analytics and other
118118 products; and
119119 (B) roles and responsibilities of relevant state
120120 entity personnel regarding data integration; and
121121 (5) information on the status of:
122122 (A) hiring project management full-time
123123 equivalents;
124124 (B) grant funding applied for and grant funding
125125 secured; and
126126 (C) the development of an Internet website that
127127 includes a preliminary, publicly available consumer data
128128 dashboard.
129129 (c) Each report required by Subsection (a) following the
130130 initial report must include:
131131 (1) updates to the information required by Subsections
132132 (a)(2) through (5);
133133 (2) an overview on business use cases the system can
134134 support; and
135135 (3) information on the development of analytic tools
136136 based on the business use cases described by Subdivision (2).
137137 Sec. 74.0007. FUNDING. (a) The early childhood
138138 interagency workgroup, the cooperating entities, and the lead
139139 agency may use any available state or federal money to develop the
140140 system.
141141 (b) The lead agency shall actively pursue grants or other
142142 money available from the federal government to operate the system.
143143 SECTION 2. Not later than January 1, 2026, the early
144144 childhood interagency workgroup shall:
145145 (1) designate the lead agency for the early childhood
146146 integrated data system as required by Section 74.0003, Human
147147 Resources Code, as added by this Act; and
148148 (2) submit to the legislature the initial report
149149 required by Section 74.0006, Human Resources Code, as added by this
150150 Act.
151151 SECTION 3. If before implementing any provision of this Act
152152 a state agency determines that a waiver or authorization from a
153153 federal agency is necessary for implementation of that provision,
154154 the agency affected by the provision shall request the waiver or
155155 authorization and may delay implementing that provision until the
156156 waiver or authorization is granted.
157157 SECTION 4. This Act takes effect September 1, 2025.
