77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the revocation of a driver's license for failure to pay
1010 a civil penalty imposed by the Texas Ethics Commission.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 571, Government Code, is
1313 amended by adding Section 571.178 to read as follows:
1414 Sec. 571.178. REVOCATION OF DRIVER'S LICENSE. If a person
1515 does not pay a civil penalty imposed by the commission within 60
1616 days of the date the commission imposed the civil penalty, and the
1717 civil penalty has not otherwise been waived under this subchapter,
1818 the commission shall notify the Texas Department of Public Safety
1919 and request that the department revoke the person's driver's
2020 license.
2121 SECTION 2. Section 521.294, Transportation Code, is amended
2222 to read as follows:
2323 Sec. 521.294. DEPARTMENT'S DETERMINATION FOR LICENSE
2424 REVOCATION. The department shall revoke the person's license if
2525 the department:
2626 (1) determines that the person:
2727 (A) [(1)] is incapable of safely operating a
2828 motor vehicle;
2929 (B) [(2)] has not complied with the terms of a
3030 citation issued by a jurisdiction that is a party to the Nonresident
3131 Violator Compact of 1977 for a traffic violation to which that
3232 compact applies;
3333 (C) [(3)] has failed to provide medical records
3434 or has failed to undergo medical or other examinations as required
3535 by a panel of the medical advisory board;
3636 (D) [(4)] has failed to pass an examination
3737 required by the director under this chapter; or
3838 (E) [(5)] has committed an offense in another
3939 state or Canadian province that, if committed in this state, would
4040 be grounds for revocation; or
4141 (2) is notified by the Texas Ethics Commission in
4242 accordance with Section 571.178, Government Code, that the person
4343 has not paid a civil penalty imposed by the commission within 60
4444 days following the date the civil penalty was imposed.
4545 SECTION 3. Section 521.312(c), Transportation Code, is
4646 amended to read as follows:
4747 (c) The department may not reinstate a license revoked under
4848 Section 521.294(1)(E) [521.294(5)] until the court that filed the
4949 report for which the license was revoked files an additional report
5050 on final disposition of the case.
5151 SECTION 4. Section 571.178, Government Code, as added by
5252 this Act, applies only to the payment of a civil penalty or fine
5353 imposed by the Texas Ethics Commission on or after the effective
5454 date of this Act. The payment of a civil penalty or fine imposed by
5555 the Texas Ethics Commission before the effective date of this Act is
5656 governed by the law in effect on the date the penalty or fine was
5757 imposed, and the former law is continued in effect for that purpose.
5858 SECTION 5. This Act takes effect September 1, 2025.
