117 A BILL TO BE ENTITLED
128 AN ACT
139 relating to prohibiting the Texas Medical Board from regulating
1410 certain physician advertising.
1511 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1612 SECTION 1. Section 153.002, Occupations Code, is amended by
1713 adding Subsections (c) and (d) to read as follows:
1814 (c) Notwithstanding Subsection (a), the board may not adopt
1915 rules that regulate the advertising of physicians as "board
2016 certified" if the physician:
2117 (1) was initially certified by:
2218 (A) a medical specialty member board of the
2319 American Board of Medical Specialties;
2420 (B) a medical specialty member board of the
2521 American Osteopathic Association Bureau of Osteopathic
2622 Specialists;
2723 (C) the American Board of Oral and Maxillofacial
2824 Surgery; or
2925 (D) any other certifying organization if the
3026 organization submits to the board documentation that the certifying
3127 organization:
3228 (i) has certification requirements that are
3329 substantially equivalent to the requirements of the medical
3430 specialty member boards under Paragraph (A) or (B);
3531 (ii) requires members to complete an
3632 examination that has been psychometrically evaluated for
3733 validation and administered by a testing organization that tests
3834 knowledge and skills in the applicable specialty or subspecialty;
3935 (iii) requires members to have successfully
4036 completed postgraduate training accredited by the Accreditation
4137 Council for Graduate Medical Education or the American Osteopathic
4238 Association in the applicable specialty or subspecialty;
4339 (iv) uses appropriate peer-review
4440 processes;
4541 (v) has a total membership of at least 100
4642 licensed members, fellows, diplomates, or certificate holders from
4743 at least one-third of the states in the United States;
4844 (vi) is exempt from the payment of federal
4945 income taxes under Section 501(a), Internal Revenue Code of 1986,
5046 by being listed as an exempt entity under Section 501(c) of that
5147 code; and
5248 (vii) has a permanent headquarters and
5349 staff; and
5450 (2) in the advertising identifies the certifying
5551 organization by which the physician is certified.
5652 (d) The board may not charge a fee or require submission of
5753 an application by a certifying organization described by Subsection
5854 (c)(1)(D).
5955 SECTION 2. This Act takes effect September 1, 2025.
