10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter A, Chapter 211, Local Government Code | |
12 | 12 | is amended by adding Sections 211.020 to read as follows: | |
13 | 13 | Sec. 211.020. ENFORCEMENT OF CHAPTER. (a) This chapter may | |
14 | 14 | be enforced only through mandamus or declaratory or injunctive | |
15 | 15 | relief. | |
16 | 16 | (b) A political subdivision's immunity from suit is waived | |
17 | 17 | in regard to an action under this chapter. | |
18 | 18 | (c) A court may award court costs and reasonable and | |
19 | 19 | necessary attorney's fees to the prevailing party in an action | |
20 | 20 | under this chapter. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2025. |
