| 12 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 15 | | SECTION 1. Section 21.105(b), Transportation Code, is |

| 14 | 16 | | amended to read as follows: |

| 15 | 17 | | (b) Before approving a loan or grant, the commission shall |
|---|
| 16 | 18 | | require that: |
|---|
| 17 | 19 | | (1) the airport or facility remain in the control of |
|---|
| 18 | 20 | | each political subdivision involved for at least 20 years; |
|---|
| 19 | 21 | | (2) the political subdivision disclose the source of |
|---|
| 20 | 22 | | all funds for the project and the political subdivision's ability |
|---|
| 21 | 23 | | to finance and operate the project; |
|---|
| 22 | 24 | | (3) at least: |
|---|
| 23 | 25 | | (A) 10 percent of the total project cost be |
|---|
| 24 | 26 | | provided by sources other than the state; or |
|---|
| 25 | 27 | | (B) if the airport is located in an economically |
|---|
| 26 | 28 | | disadvantaged county, as defined by Section 222.053, five percent |
|---|
| 27 | 29 | | of the total project cost be provided by sources other than the |
|---|
| 28 | 30 | | state; and |
|---|
| 29 | 31 | | (4) the project be adequately planned. |

| 30 | 32 | | SECTION 2. This Act takes effect September 1, 2025. |
