79 A BILL TO BE ENTITLED
810 AN ACT
911 relating to requirements for loans or grants provided by the Texas
1012 Transportation Commission to aviation facilities located in
1113 economically disadvantaged counties.
1214 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1315 SECTION 1. Section 21.105(b), Transportation Code, is
1416 amended to read as follows:
1517 (b) Before approving a loan or grant, the commission shall
1618 require that:
1719 (1) the airport or facility remain in the control of
1820 each political subdivision involved for at least 20 years;
1921 (2) the political subdivision disclose the source of
2022 all funds for the project and the political subdivision's ability
2123 to finance and operate the project;
2224 (3) at least:
2325 (A) 10 percent of the total project cost be
2426 provided by sources other than the state; or
2527 (B) if the airport is located in an economically
2628 disadvantaged county, as defined by Section 222.053, five percent
2729 of the total project cost be provided by sources other than the
2830 state; and
2931 (4) the project be adequately planned.
3032 SECTION 2. This Act takes effect September 1, 2025.
