77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to notification by the secretary of state when a person
1010 convicted of a felony may register to vote.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 13.007, Election Code, is amended by
1313 adding Subsection (d) to read as follows:
1414 (d) It is an affirmative defense to prosecution under this
1515 section that for a person not eligible to vote under Section
1616 13.001(a)(4):
1717 (1) the person represented on a registration
1818 application that the person is eligible to register to vote; and
1919 (2) the person received notice under Section
2020 15.029(c).
2121 SECTION 2. Subchapter B, Chapter 15, Election Code, is
2222 amended by adding Section 15.029 to read as follows:
2323 Sec. 15.029. NOTIFICATION OF REGISTRATION ELIGIBILITY BY
2424 SECRETARY OF STATE. (a) This section applies to a person who is
2525 ineligible to vote in this state under Section 13.001(a)(4) because
2626 the person was finally convicted of a felony.
2727 (b) The secretary of state shall coordinate with the Texas
2828 Department of Criminal Justice, the Department of Public Safety,
2929 and any other relevant agency to determine when a person to whom
3030 this section applies is no longer ineligible to vote or apply for
3131 voter registration under Section 13.001(a)(4)(A) or (B).
3232 (c) At the time a person to whom this section applies is no
3333 longer ineligible to vote under Section 13.001(a)(4)(A) or (B), the
3434 secretary of state shall use best efforts to provide the person
3535 with:
3636 (1) a notice informing the person in plain language
3737 that the person's felony conviction no longer disqualifies the
3838 person from being eligible to register to vote, including a
3939 complete list of eligibility requirements;
4040 (2) instructions for registration; and
4141 (3) a voter registration application.
4242 (d) The secretary of state shall post on the secretary's
4343 Internet website a generic version of the notice described by
4444 Subsection (c)(1).
4545 (e) The secretary of state shall adopt rules as necessary to
4646 administer this section.
4747 SECTION 3. Section 64.012, Election Code, is amended by
4848 adding Subsection (e) to read as follows:
4949 (e) It is an affirmative defense to prosecution under
5050 Subsection (a)(1) that the person received notice under Section
5151 15.029(c).
5252 SECTION 4. The changes in law made by this Act in amending
5353 Sections 13.007 and 64.012, Election Code, apply only to an offense
5454 committed on or after the effective date of this Act. An offense
5555 committed before the effective date of this Act is governed by the
5656 law in effect when the offense was committed, and the former law is
5757 continued in effect for that purpose. For purposes of this section,
5858 an offense was committed before the effective date of this Act if
5959 any element of the offense occurred before that date.
6060 SECTION 5. This Act takes effect September 1, 2025.
