77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to change of venue in certain criminal cases involving a
1010 peace officer.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 31A, Code of Criminal
1313 Procedure, is amended by adding Article 31A.0021 to read as
1414 follows:
1515 Art. 31A.0021. CHANGE OF VENUE FOR CERTAIN OFFENSES
1616 COMMITTED BY PEACE OFFICERS. On a motion by the attorney
1717 representing the state or the defendant or on the judge's own
1818 motion, the judge shall order a change of venue if the defendant:
1919 (1) is a peace officer or was a peace officer at the
2020 time of the alleged offense; and
2121 (2) has been charged with an offense allegedly
2222 committed under color of the defendant's employment as a peace
2323 officer.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a defendant charged with an offense committed on or after the
2626 effective date of this Act. A defendant charged with an offense
2727 committed before the effective date of this Act is governed by the
2828 law in effect on the date the offense was committed, and the former
2929 law is continued in effect for that purpose. For purposes of this
3030 section, an offense was committed before the effective date of this
3131 Act if any element of the offense occurred before that date.
3232 SECTION 3. This Act takes effect September 1, 2025.
