11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter A, Chapter 31A, Code of Criminal | |
13 | 13 | Procedure, is amended by adding Article 31A.0021 to read as | |
14 | 14 | follows: | |
15 | 15 | Art. 31A.0021. CHANGE OF VENUE FOR CERTAIN OFFENSES | |
16 | 16 | COMMITTED BY PEACE OFFICERS. On a motion by the attorney | |
17 | 17 | representing the state or the defendant or on the judge's own | |
18 | 18 | motion, the judge shall order a change of venue if the defendant: | |
19 | 19 | (1) is a peace officer or was a peace officer at the | |
20 | 20 | time of the alleged offense; and | |
21 | 21 | (2) has been charged with an offense allegedly | |
22 | 22 | committed under color of the defendant's employment as a peace | |
23 | 23 | officer. | |
24 | 24 | SECTION 2. The change in law made by this Act applies only | |
25 | 25 | to a defendant charged with an offense committed on or after the | |
26 | 26 | effective date of this Act. A defendant charged with an offense | |
27 | 27 | committed before the effective date of this Act is governed by the | |
28 | 28 | law in effect on the date the offense was committed, and the former | |
29 | 29 | law is continued in effect for that purpose. For purposes of this | |
30 | 30 | section, an offense was committed before the effective date of this | |
31 | 31 | Act if any element of the offense occurred before that date. | |
32 | 32 | SECTION 3. This Act takes effect September 1, 2025. |
