11 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 17 | | SECTION 1. Section 61.132, Natural Resources Code, is |
---|
13 | 18 | | amended by adding Subsections (c-1) and (c-2) to read as follows: |
---|
14 | 19 | | (c-1) To protect the public health, safety, and welfare: |
---|
15 | 20 | | (1) the governing body of a municipality to which |
---|
16 | 21 | | proposed primary and backup dates for space flight activities are |
---|
17 | 22 | | submitted under Subsection (b)(1) by ordinance shall compel the |
---|
18 | 23 | | evacuation of any unauthorized person from a hazard area, as |
---|
19 | 24 | | calculated by the Federal Aviation Administration under 14 C.F.R. |
---|
20 | 25 | | Section 450.133(c), on the date on which space flight activities |
---|
21 | 26 | | are conducted; and |
---|
22 | 27 | | (2) a commissioners court to which proposed primary |
---|
23 | 28 | | and backup dates for space flight activities are submitted under |
---|
24 | 29 | | Subsection (b)(2) or (b-1) by order may compel the evacuation of any |
---|
25 | 30 | | unauthorized person from a hazard area, as calculated by the |
---|
26 | 31 | | Federal Aviation Administration under 14 C.F.R. Section |
---|
27 | 32 | | 450.133(c), on the date on which space flight activities are |
---|
28 | 33 | | conducted. |
---|
29 | 34 | | (c-2) A person commits an offense if the person violates an |
---|
30 | 35 | | ordinance or order adopted under Subsection (c-1). An offense |
---|
31 | 36 | | under this subsection is a Class B misdemeanor, except that the |
---|
32 | 37 | | offense is a Class A misdemeanor if the actor has previously been |
---|
33 | 38 | | convicted of an offense under this subsection. |
---|
34 | 39 | | SECTION 2. (a) Except as provided by Subsection (b) of this |
---|
35 | 40 | | section: |
---|
36 | 41 | | (1) this Act takes effect immediately if it receives a |
---|
37 | 42 | | vote of two-thirds of all the members elected to each house, as |
---|
38 | 43 | | provided by Section 39, Article III, Texas Constitution; and |
---|
39 | 44 | | (2) if this Act does not receive the vote necessary for |
---|
40 | 45 | | immediate effect, this Act takes effect September 1, 2025. |
---|
41 | 46 | | (b) This Act takes effect only if S.B. 2188 or similar |
---|
42 | 47 | | legislation of the 89th Legislature, Regular Session, 2025, |
---|
43 | 48 | | relating to the closure of beaches for space flight activities is |
---|
44 | 49 | | enacted and becomes law. If legislation described by this |
---|
45 | 50 | | subsection is not enacted or does not become law, this Act has no |
---|
46 | 51 | | effect. |
