611 A BILL TO BE ENTITLED
712 AN ACT
813 relating to the evacuation of unauthorized persons from a hazard
914 area in connection with space flight activities; creating a
1015 criminal offense.
1116 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1217 SECTION 1. Section 61.132, Natural Resources Code, is
1318 amended by adding Subsections (c-1) and (c-2) to read as follows:
1419 (c-1) To protect the public health, safety, and welfare:
1520 (1) the governing body of a municipality to which
1621 proposed primary and backup dates for space flight activities are
1722 submitted under Subsection (b)(1) by ordinance shall compel the
1823 evacuation of any unauthorized person from a hazard area, as
1924 calculated by the Federal Aviation Administration under 14 C.F.R.
2025 Section 450.133(c), on the date on which space flight activities
2126 are conducted; and
2227 (2) a commissioners court to which proposed primary
2328 and backup dates for space flight activities are submitted under
2429 Subsection (b)(2) or (b-1) by order may compel the evacuation of any
2530 unauthorized person from a hazard area, as calculated by the
2631 Federal Aviation Administration under 14 C.F.R. Section
2732 450.133(c), on the date on which space flight activities are
2833 conducted.
2934 (c-2) A person commits an offense if the person violates an
3035 ordinance or order adopted under Subsection (c-1). An offense
3136 under this subsection is a Class B misdemeanor, except that the
3237 offense is a Class A misdemeanor if the actor has previously been
3338 convicted of an offense under this subsection.
3439 SECTION 2. (a) Except as provided by Subsection (b) of this
3540 section:
3641 (1) this Act takes effect immediately if it receives a
3742 vote of two-thirds of all the members elected to each house, as
3843 provided by Section 39, Article III, Texas Constitution; and
3944 (2) if this Act does not receive the vote necessary for
4045 immediate effect, this Act takes effect September 1, 2025.
4146 (b) This Act takes effect only if S.B. 2188 or similar
4247 legislation of the 89th Legislature, Regular Session, 2025,
4348 relating to the closure of beaches for space flight activities is
4449 enacted and becomes law. If legislation described by this
4550 subsection is not enacted or does not become law, this Act has no
4651 effect.
