77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the authority of a political subdivision to impose a fee
1010 to fund a climate or environmental project.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 140, Local Government Code, is amended
1313 by adding Section 140.014 to read as follows:
1414 Sec. 140.014. FEE FOR CLIMATE OR ENVIRONMENTAL PROJECT
1515 PROHIBITED. (a) In this section:
1616 (1) "Climate or environmental project" means a project
1717 undertaken by a political subdivision to reduce greenhouse gas
1818 emissions, mitigate the impacts of climate change, adapt to the
1919 effects of climate change, reduce the amount of pollutants reaching
2020 the environment, or contribute to public awareness of related
2121 matters. The term does not include basic sanitation or waste
2222 disposal services provided by a political subdivision.
2323 (2) "Fee" includes any fee, charge, assessment, or
2424 similar payment required by a political subdivision for a
2525 privilege, service, authorization, permit, license, registration,
2626 certification, filing, or other action or approval by the political
2727 subdivision.
2828 (b) A political subdivision may not impose a fee to fund a
2929 climate or environmental project.
3030 SECTION 2. This Act takes effect September 1, 2025.
