77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to school district policies on dating violence.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 11.252(a), Education Code, is amended to
1212 read as follows:
1313 (a) Each school district shall have a district improvement
1414 plan that is developed, evaluated, and revised annually, in
1515 accordance with district policy, by the superintendent with the
1616 assistance of the district-level committee established under
1717 Section 11.251. The purpose of the district improvement plan is to
1818 guide district and campus staff in the improvement of student
1919 performance for all student groups in order to attain state
2020 standards in respect to the achievement indicators adopted under
2121 Section 39.053(c). The district improvement plan must include
2222 provisions for:
2323 (1) a comprehensive needs assessment addressing
2424 district student performance on the achievement indicators, and
2525 other appropriate measures of performance, that are disaggregated
2626 by all student groups served by the district, including categories
2727 of ethnicity, socioeconomic status, sex, and populations served by
2828 special programs, including students in special education programs
2929 under Subchapter A, Chapter 29;
3030 (2) measurable district performance objectives for
3131 all appropriate achievement indicators for all student
3232 populations, including students in special education programs
3333 under Subchapter A, Chapter 29, and other measures of student
3434 performance that may be identified through the comprehensive needs
3535 assessment;
3636 (3) strategies for improvement of student performance
3737 that include:
3838 (A) instructional methods for addressing the
3939 needs of student groups not achieving their full potential;
4040 (B) evidence-based practices that address the
4141 needs of students for special programs, including:
4242 (i) suicide prevention programs, in
4343 accordance with Subchapter G, Chapter 38, which include a parental
4444 or guardian notification procedure;
4545 (ii) conflict resolution programs;
4646 (iii) violence prevention programs; and
4747 (iv) dyslexia treatment programs;
4848 (C) dropout reduction;
4949 (D) integration of technology in instructional
5050 and administrative programs;
5151 (E) positive behavior interventions and support,
5252 including interventions and support that integrate best practices
5353 on grief-informed and trauma-informed care;
5454 (F) staff development for professional staff of
5555 the district;
5656 (G) career education to assist students in
5757 developing the knowledge, skills, and competencies necessary for a
5858 broad range of career opportunities;
5959 (H) accelerated education; and
6060 (I) implementation of a comprehensive school
6161 counseling program under Section 33.005;
6262 (4) strategies for providing to elementary school,
6363 middle school, junior high school, and high school students, those
6464 students' teachers and school counselors, and those students'
6565 parents information about:
6666 (A) higher education admissions and financial
6767 aid opportunities, including state financial aid opportunities
6868 such as the TEXAS grant program and the Teach for Texas grant
6969 program established under Chapter 56;
7070 (B) the need for students to make informed
7171 curriculum choices to be prepared for success beyond high school;
7272 and
7373 (C) sources of information on higher education
7474 admissions and financial aid;
7575 (5) resources needed to implement identified
7676 strategies;
7777 (6) staff responsible for ensuring the accomplishment
7878 of each strategy;
7979 (7) timelines for ongoing monitoring of the
8080 implementation of each improvement strategy;
8181 (8) formative evaluation criteria for determining
8282 periodically whether strategies are resulting in intended
8383 improvement of student performance;
8484 (9) the policy under Section 38.0041 addressing sexual
8585 abuse and other maltreatment of children; [and]
8686 (10) the trauma-informed care policy required under
8787 Section 38.036; and
8888 (11) the policy on dating violence required under
8989 Section 37.0831.
9090 SECTION 2. Section 37.0831(b), Education Code, is amended
9191 to read as follows:
9292 (b) A dating violence policy must:
9393 (1) include:
9494 (A) a definition of dating violence that includes
9595 the intentional use of physical, sexual, verbal, or emotional abuse
9696 by a person to harm, threaten, intimidate, or control another
9797 person in a dating relationship, as defined by Section 71.0021,
9898 Family Code;
9999 (B) a clear statement that dating violence is not
100100 tolerated at school; [and]
101101 (C) [reporting] procedures, protocols, and
102102 guidelines for reporting and responding to incidents [students who
103103 are victims] of dating violence that are focused on victim safety,
104104 including:
105105 (i) a procedure for [immediately] notifying
106106 the parent or guardian of a student about a report received by the
107107 district identifying the student as an alleged victim or
108108 perpetrator of dating violence as soon as reasonably possible,
109109 subject to Subparagraph (ii); and
110110 (ii) a requirement that a school district
111111 notify the parent or guardian of a student identified as an alleged
112112 victim of dating violence before the district notifies the parent
113113 or guardian of a student identified as an alleged perpetrator of
114114 dating violence; and
115115 (D) interim measures to protect and support
116116 victims of dating violence during the pendency of the school's
117117 disciplinary process, including protection from retaliation, and
118118 any other accommodations available to those victims at the school;
119119 and
120120 (2) address safety planning, enforcement of
121121 protective orders, school-based alternatives to protective orders,
122122 training for teachers and administrators at each district campus
123123 that instructs students in grade six or higher, counseling for
124124 affected students, and awareness education for students and
125125 parents.
126126 SECTION 3. Each school district shall implement a policy on
127127 dating violence, as required by Section 37.0831, Education Code, as
128128 amended by this Act, not later than the beginning of the 2025-2026
129129 school year.
130130 SECTION 4. This Act takes effect immediately if it receives
131131 a vote of two-thirds of all the members elected to each house, as
132132 provided by Section 39, Article III, Texas Constitution. If this
133133 Act does not receive the vote necessary for immediate effect, this
134134 Act takes effect September 1, 2025.
