139 relating to measures to support kindergarten readiness and early
1410 literacy and numeracy skills for public school students, including
15- an early childhood parental support program and prekindergarten
16- programs in public schools, and to funding under the Foundation
17- School Program for certain school districts and to support those
18- measures.

1914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2015 SECTION 1. Section 12.104(b), Education Code, is amended to
2116 read as follows:
2217 (b) An open-enrollment charter school is subject to:
2318 (1) a provision of this title establishing a criminal
2419 offense;
2520 (2) the provisions in Chapter 554, Government Code;
2621 and
2722 (3) a prohibition, restriction, or requirement, as
2823 applicable, imposed by this title or a rule adopted under this
2924 title, relating to:
3025 (A) the Public Education Information Management
3126 System (PEIMS) to the extent necessary to monitor compliance with
32- this subchapter as determined by the agency [commissioner];

8984 Sec. 21.4552. TEACHER LITERACY ACHIEVEMENT AND READING
9085 INTERVENTION ACADEMIES.
9186 SECTION 3. Section 21.4552, Education Code, is amended by
9287 amending Subsections (b) and (d) and adding Subsections (d-1), (g),
9388 (h), and (i) to read as follows:
9489 (b) A literacy achievement academy developed under this
9590 section:
9691 (1) for teachers who provide reading instruction to
9792 students at the kindergarten or first, second, or third grade
9893 level:
9994 (A) must include training in:
10095 (i) effective and systematic instructional
10196 practices in reading, including phonemic awareness, phonics,
10297 fluency, vocabulary, and comprehension; and
10398 (ii) the use of empirically validated
10499 instructional methods that are appropriate for struggling readers;
105100 and
106101 (B) may include training in effective
107102 instructional practices in writing;
108103 (2) for teachers who provide reading instruction to
109104 students at the fourth or fifth grade level:
110105 (A) must include effective instructional
111106 practices that promote student development of reading
112107 comprehension and inferential and critical thinking;
113108 (B) must provide training in the use of
114109 empirically validated instructional methods that are appropriate
115110 for struggling readers; and
116111 (C) may include material on writing instruction;
117112 (3) for teachers who provide reading instruction to
118113 students at the sixth, seventh, or eighth grade level, must include
119114 training in:
120115 (A) strategies to be implemented in English
121116 language arts and other subject areas for multisyllable word
122117 reading, vocabulary development, and comprehension of expository
123118 and narrative text;
124119 (B) an adaptation framework that enables
125120 teachers to respond to differing student strengths and needs,
126121 including adaptations for students of limited English proficiency
127122 or students receiving special education services under Subchapter
128123 A, Chapter 29;
129124 (C) collaborative strategies to increase active
130125 student involvement and motivation to read; and
131126 (D) other areas identified by the commissioner as
132127 essential components of reading instruction; and
133128 (4) [for teachers who provide reading instruction to
134129 students at the seventh or eighth grade level, must include
135130 training in:
136131 [(A) administration of the reading instrument
137132 required by Section 28.006(c-1); and
138133 [(B) interpretation of the results of the reading
139134 instrument required by Section 28.006(c-1) and strategies, based on
140135 scientific research regarding effective reading instruction, for
141136 long-term intensive intervention to target identified student
142137 needs in word recognition, vocabulary, fluency, and comprehension;
143138 and
144139 [(5)] for teachers who provide instruction in
145140 mathematics, science, or social studies to students at the sixth,
146141 seventh, or eighth grade level, must include training in:
147142 (A) strategies for incorporating reading
148143 instruction into the curriculum for the subject area taught by the
149144 teacher; and
150145 (B) other areas identified by the commissioner.
151- (d) Except as provided by Subsection (d-1), from funds
152- provided under Section 48.108 or other available [From] funds
153- [appropriated for that purpose], a classroom teacher who provides
154- instruction to students in kindergarten through third grade and
155- completes [attends] a literacy achievement academy is entitled to
156- receive a stipend from the school district in the amount determined
157- by the commissioner. From funds appropriated for that purpose, a
158- district may provide a stipend to a classroom teacher who provides
159- instruction to students in a grade level above third grade. A
160- stipend received under this subsection is not considered in
161- determining whether a school district is paying the classroom
162- teacher the minimum monthly salary under Section 21.402.
163- (d-1) A school district is not required to provide a stipend
164- under Subsection (d) to a classroom teacher if the teacher:
165- (1) attends the literacy achievement academy as part
166- of an educator preparation program in which the teacher is
167- enrolled;
146+ (d) Except as provided by Subsection (d-1), from [From]
147+ funds provided under Section 48.108 or appropriated for that
148+ purpose, a classroom teacher who provides instruction to students
149+ in kindergarten through third grade and attends a literacy
150+ achievement academy is entitled to receive a stipend from the

174168 (g) The agency shall develop a method for evaluating a
175169 literacy achievement academy to determine the effectiveness of the
176170 academy, including whether the academy improves teaching practices
177171 and student literacy proficiency. A school district or
178172 open-enrollment charter school shall provide any information
179173 requested by the agency for purposes of evaluating literacy
180174 achievement academies under this subsection.
181175 (h) In addition to the literacy achievement academies
182176 developed under Subsection (a), the commissioner shall develop and
183- make available reading intervention academies for teachers or other
184- professionals who provide reading interventions to students who
185- require targeted instruction in foundational reading skills.

219215 the academy, including whether the academy improves teaching
220216 practices and student math proficiency. A school district or
221217 open-enrollment charter school shall provide any information
222218 requested by the agency for purposes of evaluating mathematics
223219 achievement academies under this subsection.
224220 (h) In addition to the mathematics achievement academies
225221 developed under Subsection (a), the commissioner shall develop and
226222 make available mathematics interventionist academies for a teacher
227- or other professional who provides mathematics interventions to
228- students who require targeted instruction in foundational
229- mathematics skills.

235229 SECTION 6. Subchapter C, Chapter 25, Education Code, is
236230 amended by adding Section 25.0816 to read as follows:
237231 Sec. 25.0816. ADDITIONAL DAYS SCHOOL YEAR PLANNING GRANT
238232 PROGRAM. (a) From money appropriated or otherwise available for
239233 the purpose, the agency shall establish and administer a grant
240234 program to provide funding and technical assistance to school
241235 districts and open-enrollment charter schools to plan the school
242236 year and adjust operations as necessary to qualify for the
243237 incentive funding under Section 48.0051.
244238 (b) In awarding grants under the program, the agency shall
245239 prioritize school districts and open-enrollment charter schools
246240 that seek to maximize incentive funding under Section 48.0051.
247241 (c) The agency may solicit and accept gifts, grants, and
248242 donations for purposes of this section.
249243 SECTION 7. Section 25.085(d), Education Code, is amended to
250244 read as follows:
251245 (d) Unless specifically exempted by Section 25.086, a
252246 student enrolled in a school district must attend:
253247 (1) an extended-year program for which the student is
254248 eligible that is provided by the district for students identified
255249 as likely not to be promoted to the next grade level or tutorial
256250 classes required by the district under Section 29.084;
257251 (2) a reading intervention program [an accelerated
258252 reading instruction program] to which the student is assigned under
259253 Section 28.0064 [28.006(g)];
260254 (3) an accelerated instruction program to which the
261255 student is assigned under Section 28.0211;
262256 (4) a basic skills program to which the student is
263257 assigned under Section 29.086; or
264258 (5) a summer program provided under Section 37.008(l)
265259 or Section 37.021.
266260 SECTION 8. The heading to Section 28.006, Education Code,
267261 is amended to read as follows:

272266 (a) The commissioner shall develop recommendations for
273267 school districts for:
274- (1) administering reading instruments to measure
275- students' foundational literacy skills in [diagnose student]
276- reading development and comprehension;
268+ (1) administering reading instruments, including an
269+ instrument developed under Section 28.0063, to diagnose student
270+ foundational literacy skills in reading development and
271+ comprehension;
277272 (2) training educators in administering the reading
278273 instruments; and
279274 (3) applying the results of the reading instruments to

281276 (b) The commissioner shall adopt a [list of] reading
282- instrument [instruments] that a school district shall [may] use at
283- the beginning of the school year to measure a kindergarten
284- student's foundational literacy skills in [diagnose student]
285- reading development and comprehension. A reading instrument
286- adopted under this subsection may include other developmental
287- skills as part of [For use in diagnosing the reading development and
288- comprehension of kindergarten students, the commissioner shall
289- adopt] a multidimensional assessment tool [that includes a reading
277+ instrument [instruments] that a school district shall [may] use to
278+ diagnose the foundational literacy skills in [student] reading
279+ development and comprehension of students enrolled in
280+ kindergarten. A reading instrument adopted under this subsection
281+ may include other developmental skills as part of [For use in
282+ diagnosing the reading development and comprehension of
283+ kindergarten students, the commissioner shall adopt] a
284+ multidimensional assessment tool [that includes a reading
290285 instrument and tests at least three developmental skills, including
291286 literacy. A multidimensional assessment tool administered as
292287 provided by this subsection is considered to be a reading
293288 instrument for purposes of this section. A district-level
294289 committee established under Subchapter F, Chapter 11, may adopt a
295290 list of reading instruments for use in the district in a grade level
296291 other than kindergarten in addition to the reading instruments on
297292 the commissioner's list]. A [Each] reading instrument adopted by
298293 the commissioner [or a district-level committee] must be based on
299294 scientific research concerning foundational literacy skills in
300- reading [skills] development and [reading] comprehension and[. A
301- list of reading instruments adopted under this subsection must]
302- provide for measuring [diagnosing] the foundational literacy
303- skills in reading development and comprehension of students,
304- including students participating in a program under Subchapter B,
305- Chapter 29.
306- (b-1) The commissioner may approve not more than two [an]
307- alternative reading instruments [instrument] for use in measuring
308- [diagnosing] the foundational literacy skills in reading
309- development and comprehension of kindergarten students that
310- complies with the requirements under Subsection (b).

313306 kindergarten level a reading instrument adopted by the commissioner
314307 under Subsection (b) or approved by the commissioner under
315308 Subsection (b-1). The district shall administer the reading
316309 instrument in accordance with the commissioner's recommendations
317310 under Subsection (a)(1) and policies developed by commissioner
318311 rule.
319312 (c-3) The commissioner by rule shall determine the
320313 performance on a [the] reading instrument adopted or approved under
321314 this section [Subsection (b)] that indicates kindergarten
322- readiness. Each reading instrument adopted or approved under this
323- section must provide for the ability to compare the performance
324- that indicates kindergarten readiness on that instrument with the
325- performance that indicates kindergarten readiness on other
326- instruments adopted or approved under this section.

327316 (d) The superintendent of each school district shall:
328317 (1) report to the commissioner and the board of
329- trustees of the district at a public meeting of the board the

344- for which a reading instrument is required to be administered]
345- under this section are [is] available to school districts at no
346- cost.
330+ (f) The agency shall ensure at least one reading instrument
331+ adopted or approved [for each grade level for which a reading
332+ instrument is required to be administered] under this section is
333+ available to school districts at no cost.
347334 (h) The school district shall make a good faith effort to
348335 ensure that the report [notice] required under Subsection (d)(2)
349336 [this section] is provided either in person or electronically [by
350337 regular mail] and that the report [notice] is clear and easy to
351338 understand and is written in English and in the parent or guardian's
352339 native language.
353- (n) Nothing in this section may be construed to circumvent
354- or supplant federal or state law regarding a student who
355- participates in a special education program under Subchapter A,
356- Chapter 29, or a student who is suspected to have a disability and
357- who may be eligible to participate in a special education program
358- under that subchapter.
340+ (n) The admission, review, and dismissal committee of a
341+ student who participates in a school district's special education
342+ program under Subchapter A, Chapter 29, may modify any requirement
343+ for student participation under this section.
359344 SECTION 10. Subchapter A, Chapter 28, Education Code, is
360345 amended by adding Sections 28.0063, 28.0064, 28.0065, and 28.0071
361346 to read as follows:
362347 Sec. 28.0063. EARLY LITERACY AND NUMERACY INSTRUMENTS. (a)
363348 The commissioner shall adopt a list of reading and mathematics
364349 instruments approved or developed by the commissioner for use by
365- school districts in kindergarten through grade three to measure
366- students' foundational literacy skills in reading development and
350+ school districts in kindergarten through grade three to diagnose
351+ foundational literacy skills in reading development and
367352 comprehension and foundational numeracy skills in mathematics.
368353 (b) A reading or mathematics instrument adopted under
369354 Subsection (a) must:
370355 (1) be based on scientific research concerning, as
371356 applicable:
372357 (A) foundational literacy skills in reading
373358 development and comprehension; or
374359 (B) foundational numeracy skills in mathematics;
375360 (2) be capable of being administered at the beginning,
376- middle, and end of the school year;
361+ middle, and end of the school year, except for a substitute
362+ instrument allowed under Subsection (d);
377363 (3) be designed to assess the performance of students
378364 in, as applicable:
379365 (A) the foundational literacy skills components
380366 of the essential knowledge and skills adopted under Section 28.002
381367 for language arts; or
382368 (B) the foundational numeracy skills components
383369 of the essential knowledge and skills adopted under Section 28.002
384370 for mathematics;
385371 (4) be capable of monitoring student progress in a
386372 manner that allows school district staff to identify specific
387373 foundational literacy or numeracy skills in need of targeted
388374 instruction;
389- (5) assess whether a student's skills identified as in
390- need of targeted instruction indicate that the student is at risk,
391- as determined by the agency, of not achieving satisfactory
392- performance on the third grade reading or mathematics assessment
393- administered under Section 39.023;
394- (6) for a reading instrument for students in
395- kindergarten and first grade, include the applicable elements and
396- criteria to serve as the required screenings for dyslexia and
397- related disorders under Section 38.003; and
375+ (5) assess whether a student's performance in
376+ foundational literacy or numeracy skills indicates that the student
377+ is at risk, as determined by the commissioner, of not achieving
378+ satisfactory performance on the third grade reading or mathematics
379+ assessment administered under Section 39.023;
380+ (6) for a reading instrument, include applicable
381+ elements required for a screening for dyslexia and related
382+ disorders under Section 38.003; and
398383 (7) for a reading instrument, allow a school district
399384 to generate a report regarding a student's reading progress that is
400385 clear and easy to understand that may be distributed to the
401386 student's parent in English, Spanish, or, to the extent
402387 practicable, any other language spoken by the parent.
403388 (c) The commissioner shall:
404389 (1) update the list of reading and mathematics
405390 instruments adopted under Subsection (a) not less than once every
406391 four years;
407392 (2) ensure the list adopted under Subsection (a)
408393 includes multiple reading and mathematics instruments;
409394 (3) develop a process by which a school district may
410395 submit an instrument to the commissioner for approval; and
411396 (4) make publicly available the criteria for the
412397 evaluation and approval of an instrument submitted to the
413398 commissioner.
414- (d) The instruments adopted or approved under this section
415- shall be administered as follows:
416- (1) for kindergarten, at the middle and end of the

400+ substitute:
401+ (1) an instrument adopted or approved under Section
402+ 28.006 for an instrument adopted under this section that is
403+ administered to a kindergarten student at the beginning of the
417404 school year;
418- (2) for first and second grade, at the beginning,
419- middle, and end of the school year; and
420- (3) for third grade, at the beginning and middle of the
421- school year.
422- (e) The commissioner shall align and determine
423- comparability of the instruments administered under this section
424- with the following instruments:
425- (1) an instrument adopted or approved under Section
426- 28.006 that is administered to a kindergarten student at the
427- beginning of the school year; and
428- (2) a third grade assessment instrument adopted or
429- developed under Section 39.023 that is administered at the end of
430- the school year for a third grade student.
431- (f) If the commissioner determines that an interim
432- assessment instrument adopted under Section 39.023(o) provides the
433- same intended outcomes as an instrument adopted or approved under
434- this section, the commissioner may substitute that interim
435- assessment instrument for an instrument adopted or approved under
436- this section.
437- (g) A school district shall administer to students in
438- kindergarten through third grade a reading instrument and a
439- mathematics instrument adopted under Subsection (a) in accordance
440- with requirements and recommendations established by the
441- commissioner under this section, including requirements or
442- recommendations related to:
443- (1) administering the instruments;
444- (2) training staff on the instruments; and
445- (3) applying the results of the instruments to the
446- district's instructional program.
447- (h) The superintendent of each school district shall:
405+ (2) an interim assessment instrument adopted or
406+ developed under Section 39.023(o) for an instrument adopted under
407+ this section; or
408+ (3) a third grade assessment instrument adopted or
409+ developed under Section 39.023 for an instrument adopted under this
410+ section that is administered at the end of the school year for a
411+ third grade student.
412+ (e) A school district shall administer to students in
413+ kindergarten through third grade a reading and mathematics
414+ instrument adopted under Subsection (a) in accordance with
415+ requirements established by the commissioner under this section.
416+ (f) The superintendent of each school district shall:
448417 (1) report to the commissioner and the board of
449- trustees of the district at a public meeting of the board the
450- results of a reading or mathematics instrument administered to
451- students under this section; and
452- (2) not later than the earlier of the 20th school day
453- or the 30th calendar day after the date on which the results of a
454- reading or mathematics instrument are available, report, in writing
455- or electronically, to a student's parent or guardian:
418+ trustees of the district the results of a reading or mathematics
419+ instrument administered to students under this section; and
420+ (2) not later than the 30th calendar day after the date
421+ on which the results of a reading or mathematics instrument are
422+ available, report, in writing or electronically, to a student's
423+ parent or guardian:
456424 (A) the student's results on the instrument;
457425 (B) for a reading instrument, the report
458426 described by Subsection (b)(7); and
459427 (C) if the student is determined to be at risk for
460428 dyslexia or a related disorder based on the results of the reading
461429 instrument, information regarding that determination.
462- (i) The agency shall establish a list of reading and
430+ (g) For each student in kindergarten through third grade who
431+ is determined to have dyslexia or a related disorder, the district
432+ shall:
433+ (1) notify the student's parent or guardian of the
434+ determination and provide to the parent or guardian information
435+ regarding the Talking Book Program offered by the Texas State
436+ Library and Archives Commission; and
437+ (2) ensure that the district is complying with the
438+ requirements of Section 29.0031 with respect to the student.
439+ (h) The agency shall establish a list of reading and
463440 mathematics instruments adopted under Subsection (a) for which the
464441 agency has negotiated a price. A school district is not required to
465442 use a method provided by Section 44.031 to purchase an instrument on
466443 the list established under this subsection.
467- (j) A student's parent or guardian may submit a written

469446 enrolled to opt the student out of the administration of a reading

483460 Sec. 28.0064. EARLY LITERACY INTERVENTION FOR CERTAIN
484461 STUDENTS. (a) If a student's results on two consecutive reading
485462 instruments administered under Section 28.0063 indicate that the
486- student is at risk, as determined by the agency, of not achieving
487- satisfactory performance in foundational literacy, a school
488- district shall, as soon as practicable following the receipt of the
489- student's results, provide reading interventions to the student.

494472 by the reading instrument administered under Section 28.0063;
495473 (2) ensure that the student receives the interventions
496474 during a period and at a frequency sufficient to address the areas
497475 described by Subdivision (1);
498476 (3) include effective instructional materials
499477 designed for reading intervention;
500478 (4) be provided by a person:
501479 (A) with training in reading interventions and in
502480 the applicable instructional materials described by Subdivision
503481 (3); and
504482 (B) under the oversight of the school district;
505483 (5) to the extent possible, be provided by one person
506484 for the entirety of the student's reading intervention period; and
507485 (6) meet any additional requirements adopted by the
508486 commissioner.
509487 (c) A school district shall continue providing reading
510488 intervention to a student under this section until the earlier of
511489 the date on which:
512490 (1) the student is no longer determined to be at risk,
513- as determined by the agency, of not achieving satisfactory
491+ as determined by the commissioner, of not achieving satisfactory
514492 performance in foundational literacy on a reading instrument
515493 administered under Section 28.0063; or
516494 (2) the student begins the fourth grade.
517495 (d) In providing reading interventions under this section,
518496 a school district may not remove a student, except under
519497 circumstances for which a student enrolled in the same grade level
520498 who is not receiving reading interventions would be removed, from:
521499 (1) instruction in the foundation curriculum and
522500 enrichment curriculum adopted under Section 28.002 for the grade
523501 level in which the student is enrolled; or
524502 (2) recess or other physical activity that is
525503 available to other students enrolled in the same grade level.
526504 (e) The agency shall approve one or more products that use
527505 an automated, computerized, or other augmented method for providing
528506 reading interventions. The agency may approve a product under this
529507 subsection only if evidence indicates that the product is effective
530508 at promoting mastery of foundational literacy skills.
531509 (f) Subject to appropriation, the agency shall ensure that
532510 at least one product approved under Subsection (e) is available to
533511 school districts at no or reduced cost.
534512 (g) A student's parent or guardian may submit a written
535513 request to the administrator of the campus at which the student is
536- enrolled to opt the student out of all or part of the reading
537- intervention requirements under Subsection (b). A school district
538- may not encourage or direct a parent or guardian to submit a written
539- request under this subsection that would allow the district to not
540- provide reading interventions to the student.

549- (j) Nothing in this section may be construed to circumvent
550- or supplant federal or state law regarding a student who
551- participates in a special education program under Subchapter A,
552- Chapter 29, or a student who is suspected to have a disability and
553- who may be eligible to participate in a special education program
554- under that subchapter.

557536 standards for implementing reading interventions that meet the
558537 requirements of Subsection (b).
559538 (l) Section 2001.0045, Government Code, does not apply to a
560539 rule adopted under this section.
561540 (m) A school district is not required to comply with the
562541 requirements of this section until the commissioner adopts a list
563542 of reading and mathematics instruments under Section 28.0063 and
564543 designates the first school year that districts must comply with
565544 this section. This subsection expires September 1, 2029.
566- Sec. 28.0065. ADAPTIVE VOCABULARY PILOT PROGRAM. (a) The
567- agency shall develop and implement an adaptive vocabulary
568- assessment pilot program to assess vocabulary development in
569- students in kindergarten through third grade.
570- (b) The agency may develop an assessment under the pilot
571- program to assess students in grades other than grades described by
572- Subsection (a).
573- (c) Nothing in this section may be construed to circumvent
574- or supplant federal or state law regarding a student who
575- participates in a special education program under Subchapter A,
576- Chapter 29, or a student who is suspected to have a disability and
577- who may be eligible to participate in a special education program
578- under that subchapter.
545+ Sec. 28.0065. ADAPTIVE VOCABULARY. (a) The agency shall

579556 (d) The commissioner may adopt rules as necessary to
580557 implement this section.
581558 Sec. 28.0071. MATHEMATICS TRAINING FOR KINDERGARTEN
582559 THROUGH EIGHTH GRADE. (a) Each school district and
583560 open-enrollment charter school shall ensure that:
584561 (1) not later than the 2030-2031 school year, each
585562 classroom teacher that provides instruction in mathematics to
586563 students in kindergarten through eighth grade and each principal,
587564 assistant principal, mathematics instructional coach, and
588565 mathematics interventionist at a campus with one of those grade
589566 levels has attended a teacher mathematics achievement academy
590567 developed under Section 21.4553; and
591568 (2) each classroom teacher and principal initially
592569 employed in a grade level or at a campus described by Subdivision
593570 (1) for the 2030-2031 school year or a subsequent school year has
594571 attended a teacher mathematics achievement academy developed under
595572 Section 21.4553 by the end of the teacher's or principal's first
596573 year of placement in that grade level or campus.
597574 (b) The agency shall provide assistance to school districts
598575 and open-enrollment charter schools in complying with the
599576 requirements under this section.
600577 (c) The agency shall:
601578 (1) monitor the implementation of this section; and
602579 (2) periodically report to the legislature on the
603580 implementation of this section and the effectiveness of this
604581 section in improving educational outcomes.
605582 (d) The commissioner may adopt rules to implement this
606583 section.
607584 SECTION 11. Subchapter B, Chapter 28, Education Code, is
608585 amended by adding Section 28.02111 to read as follows:
609586 Sec. 28.02111. THIRD GRADE SUPPLEMENTARY SUPPORTS. (a) The
610587 commissioner shall establish and administer a program for students
611- who are required to be provided accelerated instruction under
612- Section 28.0211(a-1) based on the student's third grade performance
613- through which the student's parent may direct tutoring services to
614- support the student. The agency shall provide to a student
615- described by this subsection a grant in the amount provided under
616- Section 48.317 to purchase from an agency-approved provider
617- tutoring services designed to help improve the student's
618- proficiency in reading.
588+ in the third grade who are required to be provided accelerated
589+ instruction under Section 28.0211(a-1) through which the student's
590+ parent may direct tutoring services to support the student. The
591+ agency shall provide to a student described by this subsection a
592+ grant in the amount provided under Section 48.310 to purchase from
593+ an agency-approved provider tutoring services designed to help
594+ improve the student's proficiency in reading.
619595 (b) The agency shall:
620596 (1) maintain a system of online accounts under which
621597 each student described by Subsection (a) is assigned an account for
622598 the student's parent to access the grant described by Subsection
623599 (a); and
624600 (2) implement the program in a manner that ensures:
625601 (A) ease of use for parents of students who are
626602 eligible for a grant under this section; and
627603 (B) fidelity of spending.
628604 (c) A student may not receive more than one grant under this
629605 section.
630606 (d) The agency may reserve from the total amount of money
631607 available for purposes of the program an amount, not to exceed five
632608 percent of the total amount, to cover the agency's cost of
633609 administering the program.
634610 (e) A school district or open-enrollment charter school in
635611 which a student who receives a grant under this section is enrolled
636612 remains subject to the requirements to provide accelerated
637613 instruction under Section 28.0211.
638614 (f) A school district or open-enrollment charter school
639615 shall provide to the parent of a student described by Subsection (a)
640616 notice of the student's eligibility for a grant under this section,
641617 in a form and manner established by the agency.
642618 (g) A decision by the commissioner regarding the program
643619 under this section is final and may not be appealed.
644620 (h) The commissioner shall adopt rules as necessary to
645621 implement this section.
646- SECTION 12. Section 29.0031, Education Code, is amended by
647- adding Subsection (e) to read as follows:
648- (e) A school district shall notify the parent of a student
649- identified with dyslexia or a related disorder of the Talking Book
650- Program administered by the Texas State Library and Archives
651- Commission and other available audio book services.
652- SECTION 13. Section 29.153, Education Code, is amended by
653- adding Subsections (b-1), (h), and (i) to read as follows:
654- (b-1) Notwithstanding Subsection (b), any child who is at
655- least three years of age is eligible for enrollment in a
656- prekindergarten class under this section if:
657- (1) the class is provided through a partnership
658- between a school district or open-enrollment charter school and a
659- community-based child-care provider described by Subsection (g);
660- and
661- (2) the child receives subsidized child-care services
662- provided through the child-care services program administered by
663- the Texas Workforce Commission.
664- (h) Notwithstanding any other law, a facility or location at
665- which prekindergarten classes are provided by a school district or
666- open-enrollment charter school in partnership with a private entity
667- under this section:
668- (1) must comply with any municipal ordinance
669- applicable to the operation of a private prekindergarten program;
670- and
671- (2) may not be required to comply with any municipal
672- ordinance applicable to the operation of a prekindergarten program
673- by a school district or open-enrollment charter school.
674- (i) A school district shall provide to a community-based
675- child-care provider with which the district directly contracts to
676- provide a prekindergarten class funding for each child in the class
677- who is eligible for enrollment under Subsection (b) in an amount
678- that is equal to not less than 95 percent of the amount of money the
679- district receives for the child under Section 48.108(a-1).
680- SECTION 14. Section 29.1531, Education Code, is amended by
681- amending Subsections (a) and (b) and adding Subsections (c) and (d)
682- to read as follows:
683- (a) Except as provided by Subsection (c), a [A] school
684- district may offer on a tuition basis or use district funds to
685- provide:
686- (1) an additional half-day of prekindergarten classes
687- to children who are eligible for classes under Section 29.153 and
688- are under four years of age; and
689- (2) half-day and full-day prekindergarten classes to
690- children not eligible for classes under Section 29.153.
691- (b) A district that offers a prekindergarten program on a
692- tuition basis:
693- (1) may not adopt a tuition rate for the program that
694- is higher than necessary to cover the added costs of providing the
695- program, including any costs associated with collecting,
696- reporting, and analyzing data under Section 29.1532(c); [and]
697- (2) must submit the proposed tuition rate to the
698- commissioner for approval; and
699- (3) must certify to the commissioner that a
700- prekindergarten private provider that meets the qualifications of
701- Section 29.153(g) is not available to the students for which the
702- tuition would apply.
703- (c) A school district may not charge tuition for a student
704- if a prekindergarten private provider that meets the qualifications
705- of Sections 29.153(g)(1)-(4) is available to the student.
706- (d) The commissioner may adopt rules under this section,
707- including rules establishing whether a private provider is
708- available.
709- SECTION 15. Section 29.1543, Education Code, is amended to

711624 Sec. 29.1543. EARLY EDUCATION REPORTS. The agency shall
712625 produce and make available to the public on the agency's Internet
713626 website annual district and campus-level reports containing
714627 information from the previous school year on early education in
715628 school districts and open-enrollment charter schools. A report
716629 under this section must contain:
717630 (1) the information required by Section 29.1532(c) to
718631 be reported through the Public Education Information Management
719632 System (PEIMS);
720- (2) a description of the [diagnostic] reading
633+ (2) a description of the diagnostic reading
721634 instruments administered in accordance with Section 28.006(c-2)
722635 [28.006(c) or (c-2)];
723636 (3) the number of students who were administered a
724- [diagnostic] reading instrument administered in accordance with
637+ diagnostic reading instrument administered in accordance with
725638 Section 28.006(c-2) [28.006(c) or (c-2)];
726639 (4) the number of students whose scores from a
727- [diagnostic] reading instrument administered in accordance with
640+ diagnostic reading instrument administered in accordance with
728641 Section 28.006(c-2) [28.006(c) or (c-2)] indicate kindergarten
729642 readiness in reading [proficiency];
730643 (5) the number of kindergarten students who were
731- enrolled in a prekindergarten program, including a program offered
732- through a partnership under Section 29.153, in the previous school
733- years [year] in the same district or school as the district or
734- school in which the student attends kindergarten;
644+ enrolled in a prekindergarten program in the previous school year
645+ in the same district or school as the district or school in which
646+ the student attends kindergarten;
735647 (6) the number and percentage of students who perform
736648 satisfactorily on the third grade reading or mathematics assessment
737649 instrument administered under Section 39.023, disaggregated by
738650 whether the student was eligible for free prekindergarten under
739651 Section 29.153;
740652 (7) the number of students described by Subdivision
741653 (6) who attended kindergarten in the district, disaggregated by:
742654 (A) whether the student met the kindergarten
743655 readiness standard on a [the] reading instrument adopted under
744656 Section 28.006;
745657 (B) whether the student attended prekindergarten
746- in the district, including a program offered through a partnership
747- under Section 29.153; and
658+ in the district; and
748659 (C) the type of prekindergarten the student
749660 attended, if applicable; and
750661 (8) the information described by Subdivisions (6) and
751662 (7) disaggregated by whether the student is educationally
752663 disadvantaged.
753- SECTION 16. Section 29.161(c), Education Code, is amended

755666 (c) The system must:
756667 (1) be reflective of research in the field of early
757668 childhood care and education;
758669 (2) be well-grounded in the cognitive, social, and
759670 emotional development of young children;
760671 (3) apply a common set of criteria to each program
761672 provider seeking certification, regardless of the type of program
762673 or source of program funding; and
763674 (4) be capable of fulfilling the reporting and notice
764675 requirements of Section [Sections] 28.006(d) [and (g)].
765- SECTION 17. Subchapter E, Chapter 29, Education Code, is
676+ SECTION 14. Subchapter E, Chapter 29, Education Code, is
766677 amended by adding Section 29.163 to read as follows:
767678 Sec. 29.163. EARLY CHILDHOOD PARENTAL SUPPORT. (a) The
768679 agency shall establish a list of programs that provide early
769680 childhood parental support. The programs must:
770681 (1) provide for optional participation by a parent;
771682 (2) be designed to assist a parent in supporting the
772683 parent's child in attaining kindergarten readiness;
773684 (3) have demonstrated, through evidence including
774- randomized controlled trials, that the program:
685+ random control trials, that the program:
775686 (A) promotes kindergarten readiness; and
776687 (B) increases attendance rates; and
777688 (4) have an established implementation model.
778689 (b) A school district or open-enrollment charter school may
779690 offer a program on the list under Subsection (a) to families with a
780691 child eligible for prekindergarten who reside in the district's or
781692 school's attendance zone.
782- SECTION 18. Section 29.167, Education Code, is amended by

783694 amending Subsections (b-1) and (b-3) and adding Subsection (b-4) to
784695 read as follows:
785696 (b-1) Notwithstanding Subsection (b), each teacher for a
786697 prekindergarten class provided by an entity with which a school
787698 district contracts to provide a prekindergarten program must:
788699 (1) be certified under Subchapter B, Chapter 21, to
789700 teach prekindergarten or supervised by a person who meets the
790701 requirements under Subsection (b); [and]
791702 (2) have one of the following qualifications:
792703 (A) at least two years' experience of teaching in
793704 a nationally accredited child care program or a Texas Rising Star
794705 Program and:
795706 (i) a Child Development Associate (CDA)
796707 credential or another early childhood education credential
797708 approved by the agency; or
798709 (ii) certification offered through a
799710 training center accredited by Association Montessori
800711 Internationale or through the Montessori Accreditation Council for
801712 Teacher Education; or
802713 (B) a qualification described by Subsection
803714 (b)(2)(A), (D), (E), or (F); and
804715 (3) when appropriate, be appropriately certified or be
805716 supervised by a person who is appropriately certified to provide
806717 effective instruction to emergent bilingual students, as defined by
807718 Section 29.052, enrolled in the prekindergarten program.
808719 (b-3) Subsections (b-1), [and] (b-2), and (b-4) and this
809720 subsection expire September 1, 2029.
810721 (b-4) Subsections (b-1) and (b-2) apply to any
811722 prekindergarten class provided by an entity with which a school
812723 district contracts to provide a prekindergarten program under
813724 Section 29.153.
814- SECTION 19. Sections 29.934(b) and (d), Education Code, are

815726 amended to read as follows:
816727 (b) To apply to be designated as a resource campus under
817728 this section, the campus must have received an overall performance
818729 rating under Section 39.054 of D or F, or an overall performance
819730 rating under Section 39.054(a-4)(1) or 39.0546 of "Not Rated," for
820731 three [four] years over a 10-year period of time.
821732 (d) To be designated as a resource campus, the campus must:
822733 (1) implement a targeted improvement plan as described
823734 by Chapter 39A and establish a school community partnership team;
824735 (2) adopt an accelerated campus excellence turnaround
825736 plan as provided by Section 39A.105(b) [except that a classroom
826737 teacher who satisfies the requirements for demonstrated
827738 instructional effectiveness under Section 39A.105(b)(3) must also
828739 hold a current designation assigned under Section 21.3521];
829740 (3) be in a school district that has adopted an
830741 approved local optional teacher designation system under Section
831742 21.3521;
832743 (4) satisfy certain staff criteria by:
833744 (A) requiring a principal or teacher employed at
834745 the campus before the designation to apply for a position to
835746 continue at the campus;
836747 (B) for a subject in the foundation curriculum
837748 under Section 28.002(a)(1):
838749 (i) employing only teachers who have at
839750 least two [three] years of teaching experience; and
840751 (ii) ensuring that at least 50 percent of
841752 teachers hold a current designation assigned under Section 21.3521;
842753 (C) employing at least one school counselor for
843754 every 300 students; and
844755 (D) employing at least one appropriately
845756 licensed professional to assist with the social and emotional needs
846757 of students and staff, who must be a:
847758 (i) family and community liaison;
848759 (ii) clinical social worker;
849760 (iii) specialist in school psychology; or
850761 (iv) professional counselor;
851762 (5) implement a positive behavior program as provided
852763 by Section 37.0013;
853764 (6) implement a family engagement plan as described by
854765 Section 29.168;
855766 (7) develop and implement a plan to use high quality
856767 instructional materials;
857768 (8) if the campus is an elementary or middle school
858769 campus, operate the campus for a school year that qualifies for
859770 funding under Section 48.0051; and
860771 (9) annually submit to the commissioner data and
861772 information required by the commissioner to assess fidelity of
862773 implementation.
863- SECTION 20. Effective September 1, 2028, Section 29.934,

870781 [four] years over a 10-year period of time.
871782 (b-1) Notwithstanding Subsection (b), a campus may apply to
872783 be designated as a resource campus under this section if the campus
873784 received an overall performance rating under Section 39.054 of D or
874785 F, or an overall performance rating under Section 39.054(a-4)(1) or
875786 former Section 39.0546 of "Not Rated," for three years over a
876787 10-year period of time. This subsection expires September 1, 2033.

882793 agreements and engage in efforts to communicate information to
883794 parents, classroom teachers, school districts, and open-enrollment
884795 charter schools regarding the educational value, particularly the
885796 impact on reading and math achievement, of open education resource
886797 instructional materials made available under this subchapter,
887798 including activities to promote, market, and advertise the content
888799 included in and how to use those materials.
889- (b) The commissioner may use appropriated funds or funds
890- appropriated for the development of open education resource
891- instructional materials under this subchapter to pay for activities
892- authorized under this section.
893- SECTION 22. Section 38.003, Education Code, is amended by
894- amending Subsection (a) and adding Subsection (a-1) to read as
895- follows:
896- (a) The State Board of Education shall identify the
897- necessary criteria and elements that provide for universal
898- screening [Students enrolling in public schools in this state shall
899- be screened or tested, as appropriate,] for dyslexia and related
900- disorders for students [at appropriate times in accordance with a
901- program approved by the State Board of Education. The program must
902- include screening at the end of the school year of each student] in
903- kindergarten and [each student in the] first grade.
904- (a-1) The criteria and elements identified under Subsection
905- (a) must be included in the reading instruments adopted or approved
906- under Section 28.0063 and administered in accordance with the
907- timelines established under that section.
908- SECTION 23. Section 39.333, Education Code, is amended to
800+ (b) The commissioner may use appropriated funds to pay for
801+ activities authorized under this section.
802+ SECTION 19. Section 39.333, Education Code, is amended to
909803 read as follows:
910804 Sec. 39.333. REGIONAL AND DISTRICT LEVEL REPORT. As part of
911805 the comprehensive biennial report under Section 39.332, the agency
912806 shall submit a regional and district level report covering the
913807 preceding two school years and containing:
914808 (1) a summary of school district compliance with the
915809 student/teacher ratios and class-size limitations prescribed by
916810 Sections 25.111 and 25.112, including:
917811 (A) the number of campuses and classes at each
918812 campus granted an exception from Section 25.112; and
919813 (B) for each campus granted an exception from
920814 Section 25.112, a statement of whether the campus has been awarded a
921815 distinction designation under Subchapter G or has been identified
922816 as an unacceptable campus under Chapter 39A;
923817 (2) a summary of the exemptions and waivers granted to
924818 campuses and school districts under Section 7.056 or 39.232 and a
925819 review of the effectiveness of each campus or district following
926820 deregulation;
927821 (3) an evaluation of the performance of the system of
928822 regional education service centers based on the indicators adopted
929823 under Section 8.101 and client satisfaction with services provided
930824 under Subchapter B, Chapter 8; and
931825 (4) [an evaluation of accelerated instruction
932826 programs offered under Section 28.006, including an assessment of
933827 the quality of such programs and the performance of students
934828 enrolled in such programs; and
935829 [(5)] the number of classes at each campus that are
936830 currently being taught by individuals who are not certified in the
937831 content areas of their respective classes.
938- SECTION 24. Section 48.005, Education Code, is amended by
939- amending Subsection (a) and adding Subsection (a-1) to read as
940- follows:
941- (a) In this chapter, average daily attendance is:
942- (1) the quotient of the sum of attendance for each day
943- of the minimum number of days of instruction as described under
944- Section 25.081(a) divided by the minimum number of days of
945- instruction;
946- (2) for a district that operates under a flexible year
947- program under Section 29.0821, the quotient of the sum of
948- attendance for each actual day of instruction as permitted by
949- Section 29.0821(b)(1) divided by the number of actual days of
950- instruction as permitted by Section 29.0821(b)(1);
951- (3) for a district that operates under a flexible
952- school day program under Section 29.0822, the average daily
953- attendance as calculated by the commissioner in accordance with
954- Sections 29.0822(d) and (d-1); or
955- (4) except as provided by Subsection (a-1), for a
956- district that operates a half-day program or a full-day program
957- under Section 29.153(c), one-half of the average daily attendance
958- calculated under Subdivision (1).
959- (a-1) Average daily attendance is calculated under
960- Subsection (a)(1) for students:
961- (1) enrolled in a half-day program or full-day program
962- under Section 29.153(c) provided by an eligible private provider
963- under Section 29.171; and
964- (2) assigned to a campus:
965- (A) that is operated under a contract entered
966- into by the district with an entity under Section 11.174 or an
967- eligible private provider under Section 29.171; or
968- (B) of an open-enrollment charter school that is
969- operated by an entity governed by a management contract approved by
970- the agency.
971- SECTION 25. Section 48.0051, Education Code, is amended by

977838 provided by Subsection (b) if the district or school:
978839 (1) provides the minimum number of minutes of
979840 operational and instructional time required under Section 25.081
980841 and commissioner rules adopted under that section over at least 175
981842 [180] days of instruction; and
982843 (2) offers an additional 30 days of half-day
983844 instruction for students enrolled in prekindergarten through
984845 eighth [fifth] grade.
985846 (b) Subject to Subsection (b-1), for [For] a school district
986847 or open-enrollment charter school described by Subsection (a), the
987848 commissioner shall increase the average daily attendance of the
988849 district or school under Section 48.005 by the amount that results
989850 from the quotient of the sum of attendance by students described by
990851 Subsection (a)(2) for each of the 30 additional instructional days
991852 of half-day instruction that are provided divided by 175 [180].
992853 (b-1) For a school district or open-enrollment charter
993854 school described by Subsection (a) that provides at least 200 full
994855 days of instruction to students described by Subsection (a)(2), the
995856 commissioner shall increase the amount computed for the district or
996857 school under Subsection (b) by 50 percent.
997858 (d) This section does not prohibit a school district from
998859 providing the minimum number of minutes of operational and
999860 instructional time required under Section 25.081 and commissioner
1000861 rules adopted under that section over fewer than 175 [180] days of
1001862 instruction.
1002- SECTION 26. Subchapter A, Chapter 48, Education Code, is

1004865 Sec. 48.0052. INCENTIVE FOR ADDITIONAL INSTRUCTIONAL DAYS
1005866 FOR READING INTERVENTIONS. (a) The commissioner shall adjust the
1006867 average daily attendance of a school district or open-enrollment
1007868 charter school under Section 48.005 in the manner provided by
1008869 Subsection (b) if the district or school:
1009870 (1) does not qualify for funding under Section
1010871 48.0051;
1011872 (2) provides the minimum number of minutes of
1012873 operational and instructional time required under Section 25.081
1013- and commissioner rules adopted under that section; and
874+ and commissioner rules adopted under that section over at least 180
875+ days of instruction; and
1014876 (3) offers up to an additional 30 days of half-day
1015877 instruction consisting of reading interventions described by
1016878 Section 28.0064 for students who are required to be provided
1017879 reading interventions under that section.
1018880 (b) For a school district or open-enrollment charter school
1019881 described by Subsection (a), the commissioner shall increase the
1020882 average daily attendance of the district or school under Section
1021883 48.005 by 50 percent of the amount that results from the quotient of
1022884 the sum of attendance by students described by Subsection (a)(3)
1023885 for each of the additional instructional days of half-day
1024886 instruction that are provided divided by 175.
1025887 (c) The agency shall assist school districts and
1026888 open-enrollment charter schools in qualifying for the incentive
1027889 under this section.
1028890 (d) The commissioner shall adopt rules necessary for the
1029891 implementation of this section.
1030- SECTION 27. Section 48.108, Education Code, is amended by
1031- amending Subsections (a), (b), and (c) and adding Subsection (a-1)
1032- to read as follows:
892+ SECTION 22. Sections 48.108(a) and (b), Education Code, are
893+ amended to read as follows:
1033894 (a) For each student in average daily attendance in
1034895 kindergarten through third grade, a school district is entitled to
1035- an annual allotment equal to the basic allotment multiplied by
1036- 0.01.
1037- (a-1) In addition to the allotment under Subsection (a), a
1038- school district is entitled to an annual allotment equal to the
1039- basic allotment multiplied by 0.1 for each student in average daily
1040- attendance in kindergarten through third grade who [0.1 if the
1041- student] is:
896+ an annual allotment equal to the basic allotment multiplied by 0.11
897+ [0.1] if the student is:
1042898 (1) educationally disadvantaged; or
1043899 (2) an emergent bilingual student, as defined by
1044900 Section 29.052, and is in a bilingual education or special language
1045901 program under Subchapter B, Chapter 29.
1046902 (b) Funds allocated under this section must be used to fund:
1047903 (1) the attendance of teachers employed by the
1048904 district at teacher literacy achievement academies under Section
1049905 21.4552 or teacher mathematics achievement academies under Section
1050906 21.4553;
1051907 (2) prekindergarten programs under Subchapters E and
1052908 E-1, Chapter 29; and
1053909 (3) programs and services designed to improve student
1054910 performance in reading and mathematics in prekindergarten through
1055911 third grade, including programs and services designed to assist the
1056912 district in achieving the goals set in the district's early
1057913 childhood literacy and mathematics proficiency plans adopted under
1058914 Section 11.185.
1059- (c) A school district is entitled to an allotment under each
1060- subdivision of Subsection (a-1) [(a)] for which a student
1061- qualifies.
1062- SECTION 28. Subchapter C, Chapter 48, Education Code, is
915+ SECTION 23. Subchapter C, Chapter 48, Education Code, is
1063916 amended by adding Section 48.122 to read as follows:
1064917 Sec. 48.122. EARLY LITERACY INTERVENTION ALLOTMENT. (a)
1065918 Except as provided by Subsections (b) and (c), for each enrolled
1066919 student receiving reading interventions under Section 28.0064, a
1067920 school district is entitled to an annual allotment of $250, or a
1068921 greater amount provided by appropriation.
1069922 (b) A school district may not receive funding under this
1070923 section for a student for which the district receives an allotment
1071924 under Section 48.103.
1072925 (c) A school district may receive funding under this section
1073926 for not more than 10 percent of students enrolled in the district in
1074927 kindergarten through third grade.
1075- SECTION 29. Subchapter G, Chapter 48, Education Code, is
1076- amended by adding Sections 48.316 and 48.317 to read as follows:
1077- Sec. 48.316. EARLY CHILDHOOD PARENTAL SUPPORT FUNDING. (a)
928+ SECTION 24. Section 48.257, Education Code, is amended by
929+ adding Subsection (b-1) to read as follows:
930+ (b-1) If for any school year a school district receives an
931+ adjustment under Subsection (b) and, after that adjustment, is no
932+ longer subject to Subsection (a), the district is entitled to
933+ additional state aid for that school year in an amount equal to the
934+ lesser of:
935+ (1) the difference, if the difference is greater than
936+ zero, between:
937+ (A) the amount to which the district is entitled
938+ under Subchapters B, C, and D less the district's distribution from
939+ the available school fund for that school year; and
940+ (B) the district's tier one maintenance and
941+ operations tax collections for that school year; or
942+ (2) the sum of the district's allotments under
943+ Sections 48.0051, 48.110, and 48.112 for that school year.
944+ SECTION 25. Subchapter G, Chapter 48, Education Code, is
945+ amended by adding Sections 48.310 and 48.315 to read as follows:
946+ Sec. 48.310. EARLY CHILDHOOD PARENTAL SUPPORT FUNDING. (a)
1078947 A school district or open-enrollment charter school that implements
1079948 an early childhood parental support program on the list established
1080949 by the agency under Section 29.163 may elect to receive a funding
1081950 adjustment as provided by this section.
1082951 (b) For each child who is eligible to receive free
1083952 prekindergarten under Section 29.153 and whose family participates
1084953 in an early childhood parental support program under Section 29.163
1085954 offered by a school district or open-enrollment charter school, the
1086955 district or school is entitled to an amount equal to the basic
1087956 allotment multiplied by 0.2.
1088957 (c) For each child for whom a school district or
1089958 open-enrollment charter school receives funding under Subsection
1090959 (b) for a school year, the commissioner shall reduce the district's
1091960 or school's entitlement under this chapter for the subsequent five
1092961 school years by an amount equal to the basic allotment multiplied by
1093962 0.02.
1094963 (d) Notwithstanding any other provision of this chapter or
1095964 Chapter 49, the agency may make a modification to the Foundation
1096965 School Program requirements to ensure that a school district's or
1097966 open-enrollment charter school's entitlement is adjusted only as
1098967 necessary for the district or school to receive funding in
1099968 accordance with this section.
1100- Sec. 48.317. THIRD GRADE SUPPLEMENTARY SUPPORTS GRANT;
969+ Sec. 48.315. THIRD GRADE SUPPLEMENTARY SUPPORTS GRANT;
1101970 FUNDING ADJUSTMENT. (a) A student to whom the agency provides a
1102971 grant under Section 28.02111 is entitled to receive an amount of
1103972 $750, or a greater amount provided by appropriation.
1104973 (b) A student may receive only one grant under Section
1105974 28.02111.
1106975 (c) Subject to Subsection (d), beginning with the 2030-2031
1107976 school year, the agency shall reduce the school district's
1108977 entitlement under this chapter each school year by $750 for each
1109978 student who both:
1110979 (1) received and used a grant under Section 28.02111
1111980 during the preceding school year; and
1112981 (2) was enrolled in the district from kindergarten
1113982 through third grade.
1114983 (d) For a student described by Subsection (c) who is
1115984 eligible to participate in a school district's special education
1116985 program under Section 29.003, the agency shall reduce the
1117986 district's entitlement in accordance with Subsection (c) by $325.
1118987 (e) Notwithstanding Section 7.057, a determination by the
1119988 commissioner under this section is final and may not be appealed.
1120- SECTION 30. The following provisions of the Education Code
989+ SECTION 26. The following sections of the Education Code
1121990 are repealed:
1122991 (1) Section 7.058;
1123992 (2) Section 21.4552(f);
1124993 (3) Section 21.4553(f);
1125994 (4) Sections 28.006(c), (c-1), (g), (g-1), (g-2), (i),

1127996 (5) Section 28.007.
1128- SECTION 31. Sections 12.104, 21.4552, 21.4553, 25.085,
1129- 28.006, 29.153, 29.1543, 29.167, 29.934, and 39.333, Education
1130- Code, as amended by this Act, and Sections 28.0063, 28.0064,
1131- 28.0065, 28.02111, and 29.163, Education Code, as added by this
1132- Act, apply beginning with the 2025-2026 school year.
1133- SECTION 32. (a) Sections 48.005, 48.0051, and 48.108,
1134- Education Code, as amended by this Act, and Sections 48.0052,
1135- 48.122, 48.316, and 48.317, Education Code, as added by this Act,
1136- take effect September 1, 2025.
1137- (b) Except as provided by Subsection (a) of this section or
1138- as otherwise provided by this Act, this Act takes effect
1139- immediately if it receives a vote of two-thirds of all the members
1140- elected to each house, as provided by Section 39, Article III, Texas
1141- Constitution. If this Act does not receive the vote necessary for
1142- immediate effect, this Act takes effect September 1, 2025.

1009+ Section 39, Article III, Texas Constitution. If this Act does not
1010+ receive the vote necessary for immediate effect, this Act takes
1011+ effect September 1, 2025.
