77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the definition of ectopic pregnancy.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 245.002(4-a), Health and Safety Code, is
1212 amended to read as follows:
1313 (4-a) "Ectopic pregnancy" means the implantation of a
1414 fertilized egg or embryo in any location except the healthy
1515 endometrial lining of the main uterine cavity, including:
1616 (A) outside of the uterus;
1717 (B) in an intrauterine location at which the
1818 fertilized egg or embryo becomes nonviable, such as a cervical,
1919 cornual, heterotopic, or intramyometrial implantation site; or
2020 (C) in a scarred portion of the uterus.
2121 SECTION 2. Section 171.063(c), Health and Safety Code, is
2222 amended to read as follows:
2323 (c) Before the physician provides an abortion-inducing
2424 drug, the physician must:
2525 (1) examine the pregnant woman in person;
2626 (2) independently verify that a pregnancy exists;
2727 (3) document, in the woman's medical record, the
2828 gestational age and [intrauterine] location of the pregnancy to
2929 determine whether an ectopic pregnancy exists;
3030 (4) determine the pregnant woman's blood type, and for
3131 a woman who is Rh negative, offer to administer Rh immunoglobulin
3232 (RhoGAM) at the time the abortion-inducing drug is administered or
3333 used or the abortion is performed or induced to prevent Rh
3434 incompatibility, complications, or miscarriage in future
3535 pregnancies;
3636 (5) document whether the pregnant woman received
3737 treatment for Rh negativity, as diagnosed by the most accurate
3838 standard of medical care; and
3939 (6) ensure the physician does not provide an
4040 abortion-inducing drug for a pregnant woman whose pregnancy is more
4141 than 49 days of gestational age.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
