77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to reports on information regarding certain multifamily
1010 residential developments to the Texas Department of Housing and
1111 Community Affairs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 2306, Government Code, is
1414 amended by adding Section 2306.009 to read as follows:
1515 Sec. 2306.009. REQUIRED REPORT ON CERTAIN MULTIFAMILY
1616 RESIDENTIAL DEVELOPMENTS; PUBLIC DATABASE. (a) This section
1717 applies only to a multifamily residential development that:
1818 (1) receives financial assistance administered under
1919 Chapter 1372;
2020 (2) is allocated housing tax credits under Subchapter
2121 DD; or
2222 (3) receives a property tax exemption in accordance
2323 with Section 303.042, Local Government Code.
2424 (b) Not later than January 1 of each year, each political
2525 subdivision that contains in the political subdivision's
2626 boundaries a multifamily residential development to which this
2727 section applies shall submit to the department a report that
2828 contains:
2929 (1) a list of each of those developments that, during
3030 the preceding year, were:
3131 (A) in operation and receiving the benefits
3232 described by Subsection (a); or
3333 (B) being constructed or rehabilitated; and
3434 (2) for each development described by Subdivision (1):
3535 (A) the name of the developer;
3636 (B) the appraised or estimated value;
3737 (C) the length of the term for which the
3838 development was awarded the benefit described by Subsection (a);
3939 and
4040 (D) any other information the department
4141 requires.
4242 (c) The department shall implement a publicly accessible
4343 database that includes:
4444 (1) the name of each political subdivision that
4545 submits a report under Subsection (b); and
4646 (2) the information included in each report,
4747 aggregated by political subdivision.
4848 (d) The department shall maintain information in the
4949 database implemented under Subsection (c) for each multifamily
5050 residential development included in a report under Subsection (b)
5151 for not less than two years after the date the development's
5252 benefits described by Subsection (a) have ended.
5353 (e) Not later than March 1 of each year, the department
5454 shall prepare and submit to the legislature a written report that
5555 contains the information contained in the database implemented
5656 under Subsection (c).
5757 SECTION 2. This Act takes effect September 1, 2025.
