| 10 | 10 | | in out-of-state correctional facilities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Article 49.18, Code of Criminal Procedure, is |
|---|
| 13 | 13 | | amended by adding Subsection (b-1) to read as follows: |
|---|
| 14 | 14 | | (b-1) If a prisoner of a county in this state dies while |
|---|
| 15 | 15 | | confined in an out-of-state penal institution, the justice of the |
|---|
| 16 | 16 | | peace of the precinct where the county jail is located shall conduct |
|---|
| 17 | 17 | | an inquiry into the death and file a written report with the |
|---|
| 18 | 18 | | attorney general not later than the 30th day after the date on which |
|---|
| 19 | 19 | | the prisoner died. The justice of the peace shall make a good faith |
|---|
| 20 | 20 | | effort to obtain all facts relevant to the death and include those |
|---|
| 21 | 21 | | facts in the report. |
|---|
| 22 | 22 | | SECTION 2. Chapter 511, Government Code, is amended by |
|---|
| 23 | 23 | | adding Section 511.01055 to read as follows: |
|---|
| 24 | 24 | | Sec. 511.01055. REPORTS REGARDING PRISONERS CONFINED IN |
|---|
| 25 | 25 | | OUT-OF-STATE CORRECTIONAL FACILITIES. (a) Not later than February |
|---|
| 26 | 26 | | 1 of each year, each county jail shall submit to the commission a |
|---|
| 27 | 27 | | report regarding the confinement of prisoners in out-of-state |
|---|
| 28 | 28 | | correctional facilities during the preceding calendar year. The |
|---|
| 29 | 29 | | report must include: |
|---|
| 30 | 30 | | (1) the total number of prisoners confined in |
|---|
| 31 | 31 | | out-of-state correctional facilities; |
|---|
| 32 | 32 | | (2) the total number of prisoners who died while |
|---|
| 33 | 33 | | confined in out-of-state correctional facilities; and |
|---|
| 34 | 34 | | (3) the total number of prisoners who escaped or |
|---|
| 35 | 35 | | attempted to escape while confined in out-of-state correctional |
|---|
| 36 | 36 | | facilities. |
|---|
| 37 | 37 | | (b) The commission shall prescribe a form for the report |
|---|
| 38 | 38 | | required by Subsection (a). |
|---|
| 39 | 39 | | (c) Not later than March 1 of each year, the commission |
|---|
| 40 | 40 | | shall submit a report summarizing the information submitted under |
|---|
| 41 | 41 | | Subsection (a) for the preceding calendar year to the governor, the |
|---|
| 42 | 42 | | lieutenant governor, the speaker of the house of representatives, |
|---|
| 43 | 43 | | and each standing committee of the legislature with primary |
|---|
| 44 | 44 | | jurisdiction over the commission. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect September 1, 2025. |
