| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Subchapter B, Chapter 264, Family Code, is | |
| 12 | 12 | amended by adding Section 264.105 to read as follows: | |
| 13 | 13 | Sec. 264.105. PROHIBITED DISCRIMINATION IN FOSTER CARE. | |
| 14 | 14 | (a) Notwithstanding Section 264.0011, in this section, | |
| 15 | 15 | "commission" means the Health and Human Services Commission. | |
| 16 | 16 | (b) The commission, the department, a single source | |
| 17 | 17 | continuum contractor, and any other person may not discriminate or | |
| 18 | 18 | take any adverse action against a person on the basis of the | |
| 19 | 19 | person's sexual orientation, gender identity, or gender expression | |
| 20 | 20 | relating to child welfare services, including the licensure or | |
| 21 | 21 | verification of a foster home or the placement of a child. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2025. |
