77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibited steering or directing use of certain
1010 facilities for emergency care under certain health benefit plans.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 540, Government Code, as
1313 effective April 1, 2025, is amended by adding Section 540.02611 to
1414 read as follows:
1515 Sec. 540.02611. COMPLIANCE WITH PROHIBITION ON STEERING TO
1616 FACILITY FOR EMERGENCY CARE. A contract to which this subchapter
1717 applies must require the contracting Medicaid managed care
1818 organization to comply with Section 541.062, Insurance Code.
1919 SECTION 2. Subchapter B, Chapter 541, Insurance Code, is
2020 amended by adding Section 541.062 to read as follows:
2121 Sec. 541.062. STEERING OR DIRECTING USE OF FACILITY FOR
2222 EMERGENCY CARE PROHIBITED. (a) In this section, "emergency care"
2323 has the meaning assigned by Section 4201.002.
2424 (b) It is an unfair method of competition or an unfair or
2525 deceptive act or practice in the business of insurance for an
2626 insurer or health maintenance organization, or an individual or
2727 entity acting on behalf of an insurer or health maintenance
2828 organization, to steer or direct an enrollee to use a certain
2929 facility to obtain emergency care.
3030 (c) A violation of this section does not create a private
3131 cause of action under Section 541.151 or 541.251.
3232 SECTION 3. If before implementing any provision of this Act
3333 a state agency determines that a waiver or authorization from a
3434 federal agency is necessary for implementation of that provision,
3535 the agency affected by the provision shall request the waiver or
3636 authorization and may delay implementing the provision until the
3737 waiver or authorization is granted.
3838 SECTION 4. The changes in law made by this Act apply only to
3939 a health benefit plan delivered, issued for delivery, or renewed on
4040 or after January 1, 2026. A health benefit plan delivered, issued
4141 for delivery, or renewed before January 1, 2026, is governed by the
4242 law as it existed immediately before the effective date of this Act,
4343 and that law is continued in effect for that purpose.
4444 SECTION 5. This Act takes effect September 1, 2025.
