88 AN ACT
99 relating to the authority of the Texas Commission on Environmental
1010 Quality to authorize the transfer of an authorization to use a
1111 standard permit for certain concrete facilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1414 Code, is amended by adding Section 382.070 to read as follows:
1515 Sec. 382.070. TRANSFER OF AUTHORIZATION TO USE STANDARD
1616 PERMIT FOR CERTAIN CONCRETE FACILITIES PROHIBITED. (a)
1717 Notwithstanding any other law, the commission may not authorize the
1818 transfer of an authorization to use a standard permit issued under
1919 Section 382.05195 or 382.05198 to a purchaser of the authorized
2020 facility if the facility is:
2121 (1) a concrete plant that performs wet batching, dry
2222 batching, or central mixing; or
2323 (2) a concrete crushing facility.
2424 (b) The commission shall require the person who purchased
2525 the facility to apply for a new authorization to use the applicable
2626 standard permit before operating the facility.
2727 (c) If the commission amended the applicable standard
2828 permit after the date the authorization was issued to the person who
2929 sold the facility, the amended standard permit applies to an
3030 application for an authorization to use the standard permit
3131 submitted by the person who purchased the facility.
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2025.
