| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 14 | 14 | | Code, is amended by adding Section 382.070 to read as follows: |
|---|
| 15 | 15 | | Sec. 382.070. TRANSFER OF AUTHORIZATION TO USE STANDARD |
|---|
| 16 | 16 | | PERMIT FOR CERTAIN CONCRETE FACILITIES PROHIBITED. (a) |
|---|
| 17 | 17 | | Notwithstanding any other law, the commission may not authorize the |
|---|
| 18 | 18 | | transfer of an authorization to use a standard permit issued under |
|---|
| 19 | 19 | | Section 382.05195 or 382.05198 to a purchaser of the authorized |
|---|
| 20 | 20 | | facility if the facility is: |
|---|
| 21 | 21 | | (1) a concrete plant that performs wet batching, dry |
|---|
| 22 | 22 | | batching, or central mixing; or |
|---|
| 23 | 23 | | (2) a concrete crushing facility. |
|---|
| 24 | 24 | | (b) The commission shall require the person who purchased |
|---|
| 25 | 25 | | the facility to apply for a new authorization to use the applicable |
|---|
| 26 | 26 | | standard permit before operating the facility. |
|---|
| 27 | 27 | | (c) If the commission amended the applicable standard |
|---|
| 28 | 28 | | permit after the date the authorization was issued to the person who |
|---|
| 29 | 29 | | sold the facility, the amended standard permit applies to an |
|---|
| 30 | 30 | | application for an authorization to use the standard permit |
|---|
| 31 | 31 | | submitted by the person who purchased the facility. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2025. |
