| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter C, Chapter 382, Health and Safety |
|---|
| 13 | 13 | | Code, is amended by adding Section 382.0651 to read as follows: |
|---|
| 14 | 14 | | Sec. 382.0651. COMMUNITY GROWTH ANALYSIS FOR CERTAIN |
|---|
| 15 | 15 | | CONCRETE FACILITIES. (a) This section applies only to an |
|---|
| 16 | 16 | | application for an authorization to use a standard permit issued |
|---|
| 17 | 17 | | under this chapter for a facility that is: |
|---|
| 18 | 18 | | (1) a concrete crushing facility or a concrete plant |
|---|
| 19 | 19 | | that performs wet batching, dry batching, or central mixing; and |
|---|
| 20 | 20 | | (2) located or proposed to be located: |
|---|
| 21 | 21 | | (A) in the unincorporated area of a county; and |
|---|
| 22 | 22 | | (B) within one mile of a tract of land that has |
|---|
| 23 | 23 | | been subdivided into at least 500 lots for residential use on which |
|---|
| 24 | 24 | | residential construction has not begun on the date the application |
|---|
| 25 | 25 | | is submitted. |
|---|
| 26 | 26 | | (b) The commission by rule shall require an applicant to |
|---|
| 27 | 27 | | submit with the application a projected community growth analysis |
|---|
| 28 | 28 | | that includes: |
|---|
| 29 | 29 | | (1) an assessment of the anticipated social and |
|---|
| 30 | 30 | | economic impact of the proposed facility on future local |
|---|
| 31 | 31 | | communities; and |
|---|
| 32 | 32 | | (2) any other information the commission determines is |
|---|
| 33 | 33 | | necessary to project growth in the area in which the facility is |
|---|
| 34 | 34 | | located or proposed to be located to ensure that the facility will |
|---|
| 35 | 35 | | comply with applicable federal and state air control statutes, |
|---|
| 36 | 36 | | rules, and regulations and the intent of this chapter. |
|---|
| 37 | 37 | | SECTION 2. Section 382.0651, Health and Safety Code, as |
|---|
| 38 | 38 | | added by this Act, applies only to an authorization to use a permit |
|---|
| 39 | 39 | | for which an application is submitted to the Texas Commission on |
|---|
| 40 | 40 | | Environmental Quality on or after the effective date of this Act. |

| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2025. |
