88 AN ACT
99 relating to air quality permits for concrete crushing facilities
1010 and concrete plants located in certain areas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 382, Health and Safety
1313 Code, is amended by adding Section 382.0651 to read as follows:
1414 Sec. 382.0651. COMMUNITY GROWTH ANALYSIS FOR CERTAIN
1515 CONCRETE FACILITIES. (a) This section applies only to an
1616 application for an authorization to use a standard permit issued
1717 under this chapter for a facility that is:
1818 (1) a concrete crushing facility or a concrete plant
1919 that performs wet batching, dry batching, or central mixing; and
2020 (2) located or proposed to be located:
2121 (A) in the unincorporated area of a county; and
2222 (B) within one mile of a tract of land that has
2323 been subdivided into at least 500 lots for residential use on which
2424 residential construction has not begun on the date the application
2525 is submitted.
2626 (b) The commission by rule shall require an applicant to
2727 submit with the application a projected community growth analysis
2828 that includes:
2929 (1) an assessment of the anticipated social and
3030 economic impact of the proposed facility on future local
3131 communities; and
3232 (2) any other information the commission determines is
3333 necessary to project growth in the area in which the facility is
3434 located or proposed to be located to ensure that the facility will
3535 comply with applicable federal and state air control statutes,
3636 rules, and regulations and the intent of this chapter.
3737 SECTION 2. Section 382.0651, Health and Safety Code, as
3838 added by this Act, applies only to an authorization to use a permit
3939 for which an application is submitted to the Texas Commission on
4040 Environmental Quality on or after the effective date of this Act.
4141 SECTION 3. This Act takes effect September 1, 2025.
