11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Subchapter B, Chapter 382, Health and Safety | |
13 | 13 | Code, is amended by adding Section 382.0162 to read as follows: | |
14 | 14 | Sec. 382.0162. MONITORING OF OPACITY OF EMISSIONS FROM | |
15 | 15 | CERTAIN CONCRETE FACILITIES. (a) This section applies only to a | |
16 | 16 | person who holds a permit issued under this chapter or is authorized | |
17 | 17 | to use a permit issued under this chapter relating to the operation | |
18 | 18 | of a facility: | |
19 | 19 | (1) used for concrete crushing; or | |
20 | 20 | (2) that is a concrete plant that performs wet | |
21 | 21 | batching, dry batching, or central mixing. | |
22 | 22 | (b) The commission by rule shall require a person described | |
23 | 23 | by Subsection (a) to staff the site of the permitted facility during | |
24 | 24 | all operational hours with an employee or agent who has received | |
25 | 25 | training on opacity readings, methodology, and procedures to | |
26 | 26 | monitor the opacity of emissions of air contaminants from the | |
27 | 27 | facility in compliance with commission rules. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2025. |
