88 AN ACT
99 relating to the monitoring of the opacity of emissions from certain
1010 concrete facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 382, Health and Safety
1313 Code, is amended by adding Section 382.0162 to read as follows:
1414 Sec. 382.0162. MONITORING OF OPACITY OF EMISSIONS FROM
1515 CERTAIN CONCRETE FACILITIES. (a) This section applies only to a
1616 person who holds a permit issued under this chapter or is authorized
1717 to use a permit issued under this chapter relating to the operation
1818 of a facility:
1919 (1) used for concrete crushing; or
2020 (2) that is a concrete plant that performs wet
2121 batching, dry batching, or central mixing.
2222 (b) The commission by rule shall require a person described
2323 by Subsection (a) to staff the site of the permitted facility during
2424 all operational hours with an employee or agent who has received
2525 training on opacity readings, methodology, and procedures to
2626 monitor the opacity of emissions of air contaminants from the
2727 facility in compliance with commission rules.
2828 SECTION 2. This Act takes effect September 1, 2025.
