77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to prohibiting a public school from retaliating against an
1010 employee for reporting certain misconduct.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C-1, Chapter 22, Education Code, is
1313 amended by adding Section 22.097 to read as follows:
1414 Sec. 22.097. DISCRIMINATION AND RETALIATION PROHIBITED. A
1515 school district or open-enrollment charter school may not
1616 discipline, retaliate against, or otherwise discriminate against a
1717 district or school employee who in good faith makes a report that
1818 alleges misconduct described by Section 22.093(c)(1)(A) or (B) to
1919 the school district or open-enrollment charter school, a law
2020 enforcement agency, or any other appropriate authority.
2121 SECTION 2. This Act applies beginning with the 2025-2026
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2025.
