11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter A, Chapter 21, Education Code, is |
---|
13 | 13 | | amended by adding Section 21.0063 to read as follows: |
---|
14 | 14 | | Sec. 21.0063. NOTICE OF CERTAIN EDUCATOR MISCONDUCT. |
---|
15 | 15 | | (a) If, after investigation by a school district or open-enrollment |
---|
16 | 16 | | charter school, there is reason to believe that a district or school |
---|
17 | 17 | | educator engaged in misconduct described by Section |
---|
18 | 18 | | 21.006(b)(2)(A-1) with a student enrolled at the district or |
---|
19 | 19 | | school, the district or school shall provide written notice of the |
---|
20 | 20 | | misconduct to each parent or guardian of a student enrolled in the |
---|
21 | 21 | | district or school. |
---|
22 | 22 | | (b) The notice required by Subsection (a): |
---|
23 | 23 | | (1) subject to Subdivision (2), must be provided by |
---|
24 | 24 | | mail; and |
---|
25 | 25 | | (2) may be provided by e-mail if the board of trustees |
---|
26 | 26 | | of the school district or the governing body of the open-enrollment |
---|
27 | 27 | | charter school determines that providing the notice by mail would |
---|
28 | 28 | | be too expensive. |
---|
29 | 29 | | SECTION 2. This Act applies beginning with the 2025-2026 |
---|
30 | 30 | | school year. |
---|
31 | 31 | | SECTION 3. This Act takes effect immediately if it receives |
---|
32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
---|
33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
---|
35 | 35 | | Act takes effect September 1, 2025. |
