77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to notice of certain misconduct committed by a public
1010 school educator.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 21, Education Code, is
1313 amended by adding Section 21.0063 to read as follows:
1414 Sec. 21.0063. NOTICE OF CERTAIN EDUCATOR MISCONDUCT.
1515 (a) If, after investigation by a school district or open-enrollment
1616 charter school, there is reason to believe that a district or school
1717 educator engaged in misconduct described by Section
1818 21.006(b)(2)(A-1) with a student enrolled at the district or
1919 school, the district or school shall provide written notice of the
2020 misconduct to each parent or guardian of a student enrolled in the
2121 district or school.
2222 (b) The notice required by Subsection (a):
2323 (1) subject to Subdivision (2), must be provided by
2424 mail; and
2525 (2) may be provided by e-mail if the board of trustees
2626 of the school district or the governing body of the open-enrollment
2727 charter school determines that providing the notice by mail would
2828 be too expensive.
2929 SECTION 2. This Act applies beginning with the 2025-2026
3030 school year.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
