77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to authorizing school districts to provide funding using
1010 money received under the Foundation School Program to
1111 community-based organizations for purposes of reimbursing private
1212 employers for paid internships provided to certain students in
1313 career and technology education programs in the district.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter F, Chapter 29, Education Code, is
1616 amended by adding Section 29.189 to read as follows:
1717 Sec. 29.189. CONTRACT TO REIMBURSE FOR PAID INTERNSHIP.
1818 (a) In this section, "community-based organization" has the
1919 meaning assigned by Section 303.001, Labor Code.
2020 (b) To encourage private employers to participate with
2121 school districts in providing career and technology education to
2222 assist students in developing the knowledge, skills, and
2323 competencies necessary for a broad range of career opportunities,
2424 the board of trustees of a school district may contract with a
2525 community-based organization to:
2626 (1) match students in grade 11 or 12 who are
2727 participating in a career and technology education program in the
2828 district with paid internships or similar programs provided by
2929 private employers; and
3030 (2) reimburse private employers for all or part of the
3131 cost of providing paid internships or similar programs to students
3232 described by Subdivision (1) using funds provided to the
3333 community-based organization by the district.
3434 (c) A contract described by Subsection (b) must:
3535 (1) require each paid internship or similar program
3636 provided to the school district's students to primarily promote a
3737 public purpose of the district relating to career and technology
3838 education;
3939 (2) include provisions under which the school district
4040 is granted sufficient control to ensure that the public purpose
4141 under Subdivision (1) is accomplished and the district receives a
4242 benefit from the contract; and
4343 (3) ensure that each student employed under a paid
4444 internship or similar program is paid at least the minimum wage
4545 required by law.
4646 (d) In providing funds to a community-based organization
4747 for the purposes of reimbursing a private employer under a contract
4848 under Subsection (b), the school district may use funds allocated
4949 to the district for career and technology education under Section
5050 48.106.
5151 (e) A community-based organization with which a school
5252 district contracts under Subsection (b) may serve as the employer
5353 of record for a student employed under a paid internship or similar
5454 program provided under a contract described by Subsection (b).
5555 (f) Completion of a paid internship or similar program
5656 provided under a contract described by Subsection (b) may satisfy a
5757 requirement to complete a practicum as part of a school district's
5858 career and technology education program.
5959 SECTION 2. Section 48.106(c), Education Code, is amended to
6060 read as follows:
6161 (c) At least 55 percent of the funds allocated under this
6262 section must be used:
6363 (1) in providing career and technology education
6464 programs in grades 7 through 12; or
6565 (2) in providing funding to a community-based
6666 organization under a contract entered into under Section 29.189 for
6767 purposes of reimbursing private employers for providing paid
6868 internships or similar programs to students in career and
6969 technology education programs.
7070 SECTION 3. This Act takes effect September 1, 2025.
