| 12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 13 | 13 | SECTION 1. Chapter 41, Local Government Code, is amended by | |
| 14 | 14 | adding Section 41.005 to read as follows: | |
| 15 | 15 | Sec. 41.005. CREATION OR EXPANSION OF POLITICAL SUBDIVISION | |
| 16 | 16 | IN CORPORATE BOUNDARIES. Notwithstanding any other law, no part of | |
| 17 | 17 | a political subdivision may be created or expanded in the corporate | |
| 18 | 18 | boundaries of a municipality unless the governing body of the | |
| 19 | 19 | municipality by ordinance authorizes the creation or expansion. | |
| 20 | 20 | SECTION 2. Subchapter C, Chapter 42, Local Government Code, | |
| 21 | 21 | is amended by adding Section 42.0423 to read as follows: | |
| 22 | 22 | Sec. 42.0423. CREATION OR EXPANSION OF EMERGENCY SERVICES | |
| 23 | 23 | DISTRICT IN EXTRATERRITORIAL JURISDICTION. Notwithstanding any | |
| 24 | 24 | other law, no part of an emergency services district governed by | |
| 25 | 25 | Chapter 775, Health and Safety Code, may be created or expanded in | |
| 26 | 26 | the extraterritorial jurisdiction of a municipality unless the | |
| 27 | 27 | governing body of the municipality by ordinance authorizes the | |
| 28 | 28 | creation or expansion. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2025. |
