88 AN ACT
99 relating to the development of a severe weather adaptation plan by
1010 certain entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Title 7, Government Code, is amended by adding
1313 Chapter 795 to read as follows:
1414 CHAPTER 795. SEVERE WEATHER ADAPTATION PLAN
1515 Sec. 795.001. PARTICIPATING ENTITIES. Not later than
1616 September 1 of each even-numbered year, each of the following
1717 entities shall publish a severe weather adaptation plan to assess
1818 the entity's role with respect to severe weather events:
1919 (1) the Department of Agriculture;
2020 (2) the Department of Public Safety of the State of
2121 Texas;
2222 (3) the General Land Office;
2323 (4) the Health and Human Services Commission;
2424 (5) the independent organization certified under
2525 Section 39.151, Utilities Code, for the ERCOT power region;
2626 (6) the office of the comptroller;
2727 (7) the Parks and Wildlife Department;
2828 (8) the Public Utility Commission of Texas;
2929 (9) the Texas A&M Forest Service;
3030 (10) the Texas Commission on Environmental Quality;
3131 (11) the Texas Department of Housing and Community
3232 Affairs;
3333 (12) the Texas Department of Insurance;
3434 (13) the Texas Department of Transportation;
3535 (14) the Texas Division of Emergency Management; and
3636 (15) the Texas Water Development Board.
3737 Sec. 795.002. PLAN. For purposes of this chapter, a severe
3838 weather adaptation plan is a strategy to identify, minimize, and
3939 adequately prepare for the effects of an increased incidence and
4040 prevalence of severe weather on the social, economic, and
4141 ecological systems of this state and to manage the risks associated
4242 with severe weather. A plan under this section must be based on
4343 current research-based science that identifies the likely effects
4444 on this state from severe weather events.
4545 Sec. 795.003. CONTENTS OF PLAN. (a) An entity's severe
4646 weather adaptation plan must include:
4747 (1) a severe weather vulnerability assessment;
4848 (2) a review of existing programs in the context of
4949 severe weather events;
5050 (3) specific steps necessary for the entity to fulfill
5151 its mission during severe weather events;
5252 (4) an analysis of the effects implementing the steps
5353 identified under Subdivision (3) would have on the entity's budget
5454 during the next 2, 5, and 10 years;
5555 (5) potential sources of funding to support the
5656 entity's efforts to adapt to an increased incidence and prevalence
5757 of severe weather events; and
5858 (6) a statewide strategy to monitor the continuing
5959 effects of severe weather events.
6060 (b) In developing a severe weather adaptation plan, each
6161 entity subject to this chapter shall consult with:
6262 (1) the Houston Advanced Research Center; and
6363 (2) the Office of the Texas State Climatologist in the
6464 Department of Atmospheric Sciences, College of Arts and Sciences,
6565 Texas A&M University.
6666 Sec. 795.004. POSTING OF PLAN. Not later than September 1
6767 of each even-numbered year, each entity subject to this chapter
6868 shall post the entity's severe weather adaptation plan on a
6969 publicly accessible Internet website and electronically submit a
7070 copy of the plan to:
7171 (1) the governor, lieutenant governor, and speaker of
7272 the house of representatives;
7373 (2) the presiding officer of each standing committee
7474 or subcommittee of the legislature with primary jurisdiction over
7575 environmental matters; and
7676 (3) the executive director of the Texas Commission on
7777 Environmental Quality.
7878 Sec. 795.005. AUDIT OF PLAN. A severe weather adaptation
7979 plan is subject to audit by the state auditor in accordance with
8080 Chapter 321.
8181 SECTION 2. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2025.
