77 AN ACT
88 relating to certain fees charged to tenants of residential
99 properties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 92, Property Code, is
1212 amended by adding Section 92.027 to read as follows:
1313 Sec. 92.027. CERTAIN FEES AND CHARGES PROHIBITED. (a) A
1414 landlord or a person the landlord authorizes to enter into a lease
1515 on the landlord's behalf may not require a tenant to pay in addition
1616 to monthly rent:
1717 (1) a recurring fee or charge for a non-optional
1818 service, including but not limited to:
1919 (A) valet trash collection;
2020 (B) common water-heating systems, or other
2121 shared services, amenities, or utilities and improvements to them;
2222 (C) rental premises upgrades to enable use of
2323 smart devices; or
2424 (D) Internet or cable service from a service
2525 provider the landlord prescribes; or
2626 (2) a billing fee.
2727 (b) A landlord may offer tenants an optional fee-based
2828 service, including a service described in Subsection (a).
2929 SECTION 2. The changes in law made by this Act apply only to
3030 a lease entered into or renewed on or after the effective date of
3131 this Act.
3232 SECTION 3. This Act takes effect September 1, 2025.
