66 A BILL TO BE ENTITLED
77 AN ACT
88 relating to transparency regarding requirements to complete a
99 certificate or degree program at a public institution of higher
1010 education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 61, Education Code, is
1313 amended by adding Section 61.07771 to read as follows:
1414 Sec. 61.07771. TRANSPARENCY IN CERTIFICATE AND DEGREE
1515 PROGRAM REQUIREMENTS. (a) The board, in consultation with
1616 institutions of higher education, shall adopt rules requiring
1717 institutions of higher education to provide transparency in
1818 certificate and degree program requirements for students enrolling
1919 at or transferring to the institution.
2020 (b) The rules must require each institution of higher
2121 education to:
2222 (1) ensure that the requirements for each certificate
2323 or degree program offered by the institution:
2424 (A) are current, accessible to students enrolled
2525 at the institution and members of the public through the following
2626 sources, as applicable, and uniform at each of the following
2727 sources:
2828 (i) the institution's internal Internet
2929 website for students;
3030 (ii) the institution's Internet website;
3131 and
3232 (iii) the Internet website of the
3333 department at the institution that offers the certificate or degree
3434 program; and
3535 (B) state:
3636 (i) the prerequisites for each course
3737 required as part of the certificate or degree program; and
3838 (ii) any non-course requirements for the
3939 certificate or degree program and, if the institution offers
4040 different tracks for completing the program, those requirements for
4141 each track; and
4242 (2) post on the institution's Internet website the
4343 minimum requirements to be accepted as a transfer student at the
4444 institution.
4545 SECTION 2. (a) Not later than January 1, 2026, the Texas
4646 Higher Education Coordinating Board shall adopt the rules required
4747 by Section 61.07771, Education Code, as added by this Act.
4848 (b) A public institution of higher education shall comply
4949 with the rules adopted under Subsection (a) of this section
5050 beginning with the 2026-2027 academic year.
5151 SECTION 3. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2025.
