77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the exemption from sales and use taxes for certain
1010 information provided by or on behalf of a homeowners' association.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 151.0038(a), Tax Code, is amended to
1313 read as follows:
1414 (a) "Information service" means:
1515 (1) furnishing general or specialized news or other
1616 current information, including financial information, unless
1717 furnished to [:
1818 [(A)] a newspaper or to a radio or television
1919 station licensed by the Federal Communications Commission; [or
2020 [(B) a member of a homeowners association of a
2121 residential subdivision or condominium development, and is
2222 furnished by the association or on behalf of the association;] or
2323 (2) electronic data retrieval or research.
2424 SECTION 2. Section 151.0101, Tax Code, is amended by adding
2525 Subsection (c) to read as follows:
2626 (c) "Taxable services" does not include the provision of
2727 information by or on behalf of a homeowners' association of a
2828 residential subdivision or condominium development to a member of
2929 the association or the member's representative, agent, lender, or
3030 title company, including:
3131 (1) a resale certificate;
3232 (2) a condominium information statement;
3333 (3) any financial information or other record about a
3434 homeowners' association or a member's property;
3535 (4) a copy of a declaration, restriction, or other
3636 organizational document of a homeowners' association; or
3737 (5) other similar information maintained by a
3838 homeowners' association.
3939 SECTION 3. The amendment made by this Act is a clarification
4040 of existing law and does not imply that existing law may be
4141 construed as inconsistent with the law as amended by this Act.
4242 SECTION 4. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
