11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Section 1954.051(b), Insurance Code, is amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (b) Insurance maintained under this subchapter must allow a |
---|
15 | 15 | | transportation network company driver to use a personal vehicle to |
---|
16 | 16 | | transport transportation network company riders for compensation |
---|
17 | 17 | | and cover the driver while: |
---|
18 | 18 | | (1) the driver is logged on to the transportation |
---|
19 | 19 | | network company's digital network as provided by Section 1954.052; |
---|
20 | 20 | | or |
---|
21 | 21 | | (2) the driver is engaged in a prearranged ride with a |
---|
22 | 22 | | transportation network company rider in the vehicle as provided by |
---|
23 | 23 | | Section 1954.053. |
---|
24 | 24 | | SECTION 2. Section 1954.052, Insurance Code, is amended to |
---|
25 | 25 | | read as follows: |
---|
26 | 26 | | Sec. 1954.052. INSURANCE REQUIREMENTS: WITHOUT |
---|
27 | 27 | | TRANSPORTATION NETWORK COMPANY RIDER IN VEHICLE [BETWEEN |
---|
28 | 28 | | PREARRANGED RIDES]. At the time a transportation network company |
---|
29 | 29 | | driver is logged on to the transportation network company's digital |
---|
30 | 30 | | network and is available to receive transportation network requests |
---|
31 | 31 | | but is not engaged in a prearranged ride or is engaged in a |
---|
32 | 32 | | prearranged ride without a transportation network company rider in |
---|
33 | 33 | | the vehicle, the automobile insurance policy must provide: |
---|
34 | 34 | | (1) the following minimum amounts of liability |
---|
35 | 35 | | insurance coverage: |
---|
36 | 36 | | (A) $50,000 for bodily injury to or death for |
---|
37 | 37 | | each person in an incident; |
---|
38 | 38 | | (B) $100,000 for bodily injury to or death of a |
---|
39 | 39 | | person per incident; and |
---|
40 | 40 | | (C) $25,000 for damage to or destruction of |
---|
41 | 41 | | property of others in an incident; |
---|
42 | 42 | | (2) uninsured or underinsured motorist coverage where |
---|
43 | 43 | | required by Section 1952.101; and |
---|
44 | 44 | | (3) personal injury protection coverage where |
---|
45 | 45 | | required by Section 1952.152. |
---|
46 | 46 | | SECTION 3. Section 1954.053, Insurance Code, is amended to |
---|
47 | 47 | | read as follows: |

48 | 48 | | Sec. 1954.053. INSURANCE REQUIREMENTS: WITH TRANSPORTATION |
---|
49 | 49 | | NETWORK COMPANY RIDER IN VEHICLE [DURING PREARRANGED RIDES]. At |
---|
50 | 50 | | the time a transportation network company driver is engaged in a |
---|
51 | 51 | | prearranged ride with a transportation network company rider in the |
---|
52 | 52 | | vehicle, the automobile insurance policy must provide, at a |
---|
53 | 53 | | minimum: |
---|
54 | 54 | | (1) coverage with a total aggregate limit of liability |
---|
55 | 55 | | of $1 million for death, bodily injury, and property damage for each |
---|
56 | 56 | | incident; |
---|
57 | 57 | | (2) uninsured or underinsured motorist coverage where |
---|
58 | 58 | | required by Section 1952.101; and |
---|
59 | 59 | | (3) personal injury protection coverage where |
---|
60 | 60 | | required by Section 1952.152. |
---|
61 | 61 | | SECTION 4. The changes in law made by this Act apply only to |
---|
62 | 62 | | an automobile insurance policy delivered, issued for delivery, or |
---|
63 | 63 | | renewed on or after January 1, 2026. An automobile insurance policy |
---|
64 | 64 | | delivered, issued for delivery, or renewed before January 1, 2026, |
---|
65 | 65 | | is governed by the law as it existed immediately before the |
---|
66 | 66 | | effective date of this Act, and that law is continued in effect for |
---|
67 | 67 | | that purpose. |
---|
68 | 68 | | SECTION 5. This Act takes effect September 1, 2025. |
