77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to automobile liability insurance requirements for
1010 transportation network company drivers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1954.051(b), Insurance Code, is amended
1313 to read as follows:
1414 (b) Insurance maintained under this subchapter must allow a
1515 transportation network company driver to use a personal vehicle to
1616 transport transportation network company riders for compensation
1717 and cover the driver while:
1818 (1) the driver is logged on to the transportation
1919 network company's digital network as provided by Section 1954.052;
2020 or
2121 (2) the driver is engaged in a prearranged ride with a
2222 transportation network company rider in the vehicle as provided by
2323 Section 1954.053.
2424 SECTION 2. Section 1954.052, Insurance Code, is amended to
2525 read as follows:
2626 Sec. 1954.052. INSURANCE REQUIREMENTS: WITHOUT
2727 TRANSPORTATION NETWORK COMPANY RIDER IN VEHICLE [BETWEEN
2828 PREARRANGED RIDES]. At the time a transportation network company
2929 driver is logged on to the transportation network company's digital
3030 network and is available to receive transportation network requests
3131 but is not engaged in a prearranged ride or is engaged in a
3232 prearranged ride without a transportation network company rider in
3333 the vehicle, the automobile insurance policy must provide:
3434 (1) the following minimum amounts of liability
3535 insurance coverage:
3636 (A) $50,000 for bodily injury to or death for
3737 each person in an incident;
3838 (B) $100,000 for bodily injury to or death of a
3939 person per incident; and
4040 (C) $25,000 for damage to or destruction of
4141 property of others in an incident;
4242 (2) uninsured or underinsured motorist coverage where
4343 required by Section 1952.101; and
4444 (3) personal injury protection coverage where
4545 required by Section 1952.152.
4646 SECTION 3. Section 1954.053, Insurance Code, is amended to
4747 read as follows:
4848 Sec. 1954.053. INSURANCE REQUIREMENTS: WITH TRANSPORTATION
4949 NETWORK COMPANY RIDER IN VEHICLE [DURING PREARRANGED RIDES]. At
5050 the time a transportation network company driver is engaged in a
5151 prearranged ride with a transportation network company rider in the
5252 vehicle, the automobile insurance policy must provide, at a
5353 minimum:
5454 (1) coverage with a total aggregate limit of liability
5555 of $1 million for death, bodily injury, and property damage for each
5656 incident;
5757 (2) uninsured or underinsured motorist coverage where
5858 required by Section 1952.101; and
5959 (3) personal injury protection coverage where
6060 required by Section 1952.152.
6161 SECTION 4. The changes in law made by this Act apply only to
6262 an automobile insurance policy delivered, issued for delivery, or
6363 renewed on or after January 1, 2026. An automobile insurance policy
6464 delivered, issued for delivery, or renewed before January 1, 2026,
6565 is governed by the law as it existed immediately before the
6666 effective date of this Act, and that law is continued in effect for
6767 that purpose.
6868 SECTION 5. This Act takes effect September 1, 2025.
