613 A BILL TO BE ENTITLED
714 AN ACT
815 relating to the disclosure of certain information regarding a
916 record of a collision or violation involving a person operating a
1017 railroad locomotive or train.
1118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1219 SECTION 1. Section 192.005, Transportation Code, is amended
1320 to read as follows:
1421 Sec. 192.005. RECORD OF COLLISION OR VIOLATION. If a person
1522 operating a railroad locomotive or train is involved in a collision
1623 with another train, [or] a motor vehicle, or a pedestrian or is
1724 arrested for violation of a law relating to the person's operation
1825 of a railroad locomotive or train:
1926 (1) the number of or other identifying information on
2027 the person's driver's license or commercial driver's license may not
2128 be included in any report of the collision or violation; and
2229 (2) the person's involvement in the collision or
2330 violation may not be recorded in the person's individual driving
2431 record maintained by the Department of Public Safety.
2532 SECTION 2. Chapter 192, Transportation Code, is amended by
2633 adding Section 192.006 to read as follows:
2734 Sec. 192.006. DISCLOSURE OF CERTAIN INFORMATION FROM RECORD
2835 OF COLLISION OR VIOLATION. The personally identifying information
2936 of a railroad locomotive or train crew shall be redacted from a
3037 report of a collision or violation described by Section 192.005(1)
3138 and may not be disclosed except:
3239 (1) to a law enforcement officer or agent;
3340 (2) to a state attorney;
3441 (3) to the railroad company;
3542 (A) on whose tracks the collision or violation
3643 occurred; or
3744 (B) who employed the crew at the time of the
3845 collision or violation;
3946 (4) to a regulatory agency with oversight of
4047 railroads;
4148 (5) to a person specifically authorized by court order
4249 to receive the information, if access to the information is
4350 necessary to the performance of the person's duties; or
4451 (6) to legal counsel representing a party injured in a
4552 collision or as a result of a violation that is the subject of the
4653 report, on receipt of a letter requesting that information.
4754 SECTION 3. This Act takes effect September 1, 2025.
